A permit from the Roads and Traffic Authority (RTA) is not required, given it is not an RTA road<br />

nor within 100metres <str<strong>on</strong>g>of</str<strong>on</strong>g> traffic light c<strong>on</strong>trolled intersecti<strong>on</strong>. A road opening permit from Council<br />

and payment will <str<strong>on</strong>g>be</str<strong>on</strong>g> required in accordance with <str<strong>on</strong>g>council</str<strong>on</strong>g>’s fees and charges. The c<strong>on</strong>sultant has<br />

certified th<strong>at</strong> the traffic management plan has <str<strong>on</strong>g>be</str<strong>on</strong>g>en prepared in accordance with RTA – Traffic<br />

C<strong>on</strong>trol <strong>at</strong> Worksites Manual Versi<strong>on</strong> 3.0 (2003).<br />

Erosi<strong>on</strong> c<strong>on</strong>trol measures are descri<str<strong>on</strong>g>be</str<strong>on</strong>g>d textually <strong>on</strong>ly <strong>on</strong> the plan in terms <str<strong>on</strong>g>of</str<strong>on</strong>g> type, loc<strong>at</strong>i<strong>on</strong> and<br />

maintenance th<strong>at</strong> appear adequ<strong>at</strong>e, however their loc<strong>at</strong>i<strong>on</strong> are not shown sp<strong>at</strong>ially <strong>on</strong> the plan, such<br />

th<strong>at</strong> these can <str<strong>on</strong>g>be</str<strong>on</strong>g> verified by inspecti<strong>on</strong> for compliance purposes. To avoid any misinterpret<strong>at</strong>i<strong>on</strong>,<br />

this requirement can <str<strong>on</strong>g>be</str<strong>on</strong>g> covered by c<strong>on</strong>diti<strong>on</strong>s.<br />

Overall the applicant has complied with c<strong>on</strong>diti<strong>on</strong> 3 <str<strong>on</strong>g>of</str<strong>on</strong>g> the pre-commencement c<strong>on</strong>diti<strong>on</strong>.<br />

CONSULTATION<br />

Meetings were <str<strong>on</strong>g>held</str<strong>on</strong>g> with the c<strong>on</strong>sultant and applicant regarding the flow p<strong>at</strong>h and driveway.<br />

FINANCIAL CONSIDERATIONS<br />

Drainage works associ<strong>at</strong>ed with the reloc<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the pipeline and easement <str<strong>on</strong>g>be</str<strong>on</strong>g>nefit the applicant<br />

<strong>on</strong>ly and as such all costs for any survey, legal and c<strong>on</strong>structi<strong>on</strong> should <str<strong>on</strong>g>be</str<strong>on</strong>g> borne by the applicant.<br />

CONSULTATION WITH OTHER COUNCIL DEPARTMENTS<br />

Technical Services have c<strong>on</strong>sulted with the Engineering Assessment Unit from Envir<strong>on</strong>ment and<br />

Regula<str<strong>on</strong>g>to</str<strong>on</strong>g>ry Services.<br />

SUMMARY<br />

The applicant’s DA No.177/03 for a dual occupancy development <strong>at</strong> 15 Pears<strong>on</strong> Avenue Gord<strong>on</strong><br />

was approved by Commissi<strong>on</strong>er Bly in the Land and Envir<strong>on</strong>ment Court <strong>on</strong> 16 March 2004, with<br />

three s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er drainage pre-commencement c<strong>on</strong>diti<strong>on</strong>s imposed.<br />

The applicant has submitted a Secti<strong>on</strong> 88B instrument and Linen plan for executi<strong>on</strong> which is signed<br />

by both owners <str<strong>on</strong>g>of</str<strong>on</strong>g> No.15 and No.17. The document<strong>at</strong>i<strong>on</strong> addresses the extinguishment and cre<strong>at</strong>i<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> a new 1.6 metre wide easement, upsized pipe and restricti<strong>on</strong> <strong>on</strong> use for the overland flow p<strong>at</strong>h.<br />

S<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er plans and details, drawings GD 2.1, GD 2.2, GD 2.4, GD 2.5 and GD 2.6, prepared by<br />

K.R Stubbs & Associ<strong>at</strong>es Pty Ltd were submitted and the drainage details assessed. Revised<br />

drawings, GD 2.1, GD 2.4 and GD 2.7 Revisi<strong>on</strong> D, was submitted showing amended levels <str<strong>on</strong>g>to</str<strong>on</strong>g><br />
