i. Provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a 600mm diameter pipe reloc<strong>at</strong>ed al<strong>on</strong>g the eastern boundary and <str<strong>on</strong>g>to</str<strong>on</strong>g> aband<strong>on</strong> the<br />

existing 450mm diameter pipe. The pipeline is sized <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>at</strong>er for the calcul<strong>at</strong>ed 1 in 20 year<br />

ARI design flow <str<strong>on</strong>g>of</str<strong>on</strong>g> 860 L/s.<br />

ii. Install<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a new gr<strong>at</strong>ed pit <strong>at</strong> the comm<strong>on</strong> boundary <str<strong>on</strong>g>of</str<strong>on</strong>g> No.15 and 17 <str<strong>on</strong>g>to</str<strong>on</strong>g> rec<strong>on</strong>nect in<str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />

existing 450mm diameter pipe th<strong>at</strong> will remain in No.17 downstream.<br />

iii. Provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a relief overflow route over the reloc<strong>at</strong>ed pipeline <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>vey surface flows in<br />

iv.<br />

excess <str<strong>on</strong>g>of</str<strong>on</strong>g> the road pit capacity, requiring terms for Restricti<strong>on</strong> <strong>on</strong> Use varying in width.<br />

Provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> additi<strong>on</strong>al road drainage pits and pipe work <strong>on</strong> the northern side <str<strong>on</strong>g>of</str<strong>on</strong>g> Burgoyne<br />

Street as a c<strong>on</strong>sequence <str<strong>on</strong>g>of</str<strong>on</strong>g> a new driveway access <str<strong>on</strong>g>to</str<strong>on</strong>g> the proposed development.<br />

v. Provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> an increased Easement <str<strong>on</strong>g>to</str<strong>on</strong>g> drain w<strong>at</strong>er 1.6m in width which complies with DCP<br />

Vari<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> Terms <str<strong>on</strong>g>of</str<strong>on</strong>g> easement<br />

Both properties <strong>at</strong> No.15 & No.17 Pears<strong>on</strong> Avenue are burdened by a 1.22 metre wide drainage<br />

easement, indic<strong>at</strong>ed <strong>on</strong> the drainage layout plan as Attachment 2, as LD 932 and LD 944<br />

respectively. In these documents, the terms <str<strong>on</strong>g>be</str<strong>on</strong>g>nefit the Council <strong>on</strong>ly, allowing surface and<br />

s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>ers from Burgoyne Street and Pears<strong>on</strong> Avenue, with specific reference for c<strong>on</strong>veyance <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er by a 450mm diameter pipe.<br />

Both LD 932 and 944 are required <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> extinguished with a new easement cre<strong>at</strong>ed pursuant <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

Secti<strong>on</strong> 88B <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>veyancing Act 1919. Document<strong>at</strong>i<strong>on</strong> is required <str<strong>on</strong>g>to</str<strong>on</strong>g> address:<br />

• The upsized pipe,<br />

• restricti<strong>on</strong> <strong>on</strong> use for the overland flow p<strong>at</strong>h, and<br />

• c<strong>on</strong>sent from No.17 for the discharge <str<strong>on</strong>g>of</str<strong>on</strong>g> priv<strong>at</strong>e s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er across their land from No15.<br />

The applicant has submitted a Secti<strong>on</strong> 88B instrument and linen plan for executi<strong>on</strong> which is signed<br />

by both owners <str<strong>on</strong>g>of</str<strong>on</strong>g> No.15 and No.17 which appears <str<strong>on</strong>g>to</str<strong>on</strong>g> address the above requirements s<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>rily.<br />

Downstream <str<strong>on</strong>g>of</str<strong>on</strong>g> No.17, the s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er is c<strong>on</strong>veyed across another four properties until the public<br />

system in Mt William Street. However, c<strong>on</strong>sents were not required as the four properties do not<br />

have easements and the 450mm pipeline termin<strong>at</strong>es in<str<strong>on</strong>g>to</str<strong>on</strong>g> an existing n<strong>at</strong>ural gully within No.17.<br />

Assessment <str<strong>on</strong>g>of</str<strong>on</strong>g> proposed s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er drainage<br />

Attached are reduced scale plans <str<strong>on</strong>g>of</str<strong>on</strong>g> drawing GD 2.1 as Attachment 3 showing the S<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er<br />

management, and partial drawing GD 2.4 showing the relief overflow p<strong>at</strong>h as Attachment 4.<br />

Drainage details submitted <str<strong>on</strong>g>to</str<strong>on</strong>g> support the applic<strong>at</strong>i<strong>on</strong> were assessed and are c<strong>on</strong>sidered s<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry.<br />

The following critical issues are noted:<br />

i. Any up welling <str<strong>on</strong>g>of</str<strong>on</strong>g> s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er <strong>at</strong> the transiti<strong>on</strong> pit (pit 10) <str<strong>on</strong>g>be</str<strong>on</strong>g>tween the upsized pipe (600mm)<br />

in<str<strong>on</strong>g>to</str<strong>on</strong>g> the existing pipe (450mm) is c<strong>on</strong>sidered indifferent as the magnitude <str<strong>on</strong>g>of</str<strong>on</strong>g> overflows across<br />

No.17 is unchanged. The origin <str<strong>on</strong>g>of</str<strong>on</strong>g> overflow may either occur from over<str<strong>on</strong>g>to</str<strong>on</strong>g>pping <str<strong>on</strong>g>of</str<strong>on</strong>g> the kerb or<br />

from the internal pit (pit 10) within No.15. Intermedi<strong>at</strong>e pits (pit 10, 12 & 13) in the property,<br />
