PURPOSE OF REPORT<br />

To c<strong>on</strong>sider a request for the proposed reloc<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a Council s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er drainage pipeline and<br />

easement loc<strong>at</strong>ed within No 15 Pears<strong>on</strong> Avenue, Gord<strong>on</strong>.<br />

BACKGROUND<br />

The applicant, Quirante Holdings Pty Ltd, submitted a Development Applic<strong>at</strong>i<strong>on</strong> (DA No.177/03)<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> Council for a dual occupancy development <strong>at</strong> 15 Pears<strong>on</strong> Avenue Gord<strong>on</strong>. As a c<strong>on</strong>sequence <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the Land and Envir<strong>on</strong>ment Court proceedings No.11324 <str<strong>on</strong>g>of</str<strong>on</strong>g> 2003, the development was approved by<br />

Commissi<strong>on</strong>er Bly <strong>on</strong> 16 March 2004.<br />

Granting <str<strong>on</strong>g>of</str<strong>on</strong>g> the development was subject <str<strong>on</strong>g>to</str<strong>on</strong>g> the c<strong>on</strong>diti<strong>on</strong>s in Annexure ‘A’ <str<strong>on</strong>g>of</str<strong>on</strong>g> the proceedings<br />

(Attachment 1) comprising three s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er drainage pre-commencement c<strong>on</strong>diti<strong>on</strong>s:<br />

• Requirement <str<strong>on</strong>g>to</str<strong>on</strong>g> vary the terms <str<strong>on</strong>g>of</str<strong>on</strong>g> the easement in No.17 Pears<strong>on</strong>, downstream.<br />

• Formalise the drainage works proposed in No.15 Pears<strong>on</strong> Avenue by submissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> design plans<br />

• Requirement for Road Opening applic<strong>at</strong>i<strong>on</strong> for works in Burgoyne Street.<br />

The applicant has submitted revised s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er plans and details, drawings GD 2.1 and GD 2.2,<br />

Revisi<strong>on</strong> C d<strong>at</strong>ed February 2003, and GD 2.4 Revisi<strong>on</strong> C d<strong>at</strong>ed June 2003, GD 2.5 and GD 2.6<br />

Revisi<strong>on</strong> C d<strong>at</strong>ed August 2004, prepared by K.R Stubbs & Associ<strong>at</strong>es Pty Ltd.<br />

COMMENTS<br />

Current situ<strong>at</strong>i<strong>on</strong><br />

S<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er run<str<strong>on</strong>g>of</str<strong>on</strong>g>f from Burgoyne Street and Pears<strong>on</strong> Avenue c<strong>on</strong>verge in road pits <strong>on</strong> the southern<br />

boundary <str<strong>on</strong>g>of</str<strong>on</strong>g> No.15 which is then c<strong>on</strong>veyed downstream by a 450mm diameter pipe. The pipe<br />

travels near the eastern boundary across No.15 in<str<strong>on</strong>g>to</str<strong>on</strong>g> No.17, discharging in<str<strong>on</strong>g>to</str<strong>on</strong>g> a n<strong>at</strong>ural gully about 6<br />

metres <str<strong>on</strong>g>be</str<strong>on</strong>g>fore the northern boundary <str<strong>on</strong>g>of</str<strong>on</strong>g> No.17, as shown <strong>on</strong> drainage layout plan, Attachment 2.<br />

Pits near the southern boundary <str<strong>on</strong>g>of</str<strong>on</strong>g> No.15 are loc<strong>at</strong>ed in the road sag <str<strong>on</strong>g>of</str<strong>on</strong>g> Burgoyne Street. As such,<br />

overflows in excess <str<strong>on</strong>g>of</str<strong>on</strong>g> the public drainage system, over<str<strong>on</strong>g>to</str<strong>on</strong>g>p the kerb and run<str<strong>on</strong>g>of</str<strong>on</strong>g>f overland across<br />

No.15 in a northerly directi<strong>on</strong> over the gully coinciding with the pipe.<br />

Proposal<br />

The s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er plans and detail drawings prepared by K.R Stubbs and Associ<strong>at</strong>es was reviewed<br />

and seeks <str<strong>on</strong>g>to</str<strong>on</strong>g> modify the drainage system by:<br />
