SUMMARY<br />

Reece Pty Ltd submitted a DA No.1572/03 for a two s<str<strong>on</strong>g>to</str<strong>on</strong>g>rey commercial development and<br />

associ<strong>at</strong>ed car parking <strong>at</strong> 8 West Street, Pymble th<strong>at</strong> was approved by Commissi<strong>on</strong>er Hussey in the<br />

Land and Envir<strong>on</strong>ment Court <strong>on</strong> 14 Oc<str<strong>on</strong>g>to</str<strong>on</strong>g><str<strong>on</strong>g>be</str<strong>on</strong>g>r 2004, with four deferred commencement provisi<strong>on</strong>s:<br />

Revised s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er plans and details, drawings C1-C7 Revisi<strong>on</strong> A, d<strong>at</strong>ed 16 February <strong>2005</strong>, as well<br />

as structural drawings S1-S18, Revisi<strong>on</strong> A d<strong>at</strong>ed 18 Novem<str<strong>on</strong>g>be</str<strong>on</strong>g>r 2004, prepared by Appleyard<br />

Forrest C<strong>on</strong>sulting Engineers Pty Ltd was submitted. Overall, the design was found <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> in<br />

accordance with DCP 47 requirements and is c<strong>on</strong>sidered s<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry.<br />

By virtue <str<strong>on</strong>g>of</str<strong>on</strong>g> the requirement <str<strong>on</strong>g>to</str<strong>on</strong>g> loc<strong>at</strong>e the building <str<strong>on</strong>g>to</str<strong>on</strong>g> the western boundary situ<strong>at</strong>ed over the current<br />

drainage system comprising a 1050mm diameter pipeline and easement, substantial infrastructure is<br />

required for the reloc<strong>at</strong>i<strong>on</strong>. Works involve an install<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> an upsized pipe line <str<strong>on</strong>g>to</str<strong>on</strong>g> 1200mm<br />

diameter, provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> bolt pit lids <str<strong>on</strong>g>to</str<strong>on</strong>g> prevent surcharging due <str<strong>on</strong>g>to</str<strong>on</strong>g> a pressured pipeline, <str<strong>on</strong>g>be</str<strong>on</strong>g>nching in<br />

pits, as well as provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> removal slab panel <str<strong>on</strong>g>to</str<strong>on</strong>g> allow c<strong>on</strong>tinued access for maintenance. The<br />

redundant 1050mm pipeline within No.8 is <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> removed and the trench backfilled.<br />

The property is vulnerable <str<strong>on</strong>g>to</str<strong>on</strong>g> overflows from a sag drainage pit fr<strong>on</strong>ting the site which collects<br />

s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er run<str<strong>on</strong>g>of</str<strong>on</strong>g>f from Suakin, Bridge and West Streets. An overland flow route is designed <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

c<strong>on</strong>vey the flow in accordance with DCP47 requirements, with the provisi<strong>on</strong>al hazard r<strong>at</strong>ing<br />

although high, dose not pose risk <str<strong>on</strong>g>to</str<strong>on</strong>g> the public given the flowp<strong>at</strong>h inaccessibility. Flows are<br />

c<strong>on</strong>trolled through the site by the use <str<strong>on</strong>g>of</str<strong>on</strong>g> dwarf mas<strong>on</strong>ry walls and are c<strong>on</strong>sidered s<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry.<br />

To support the elev<strong>at</strong>ed access ramps in<str<strong>on</strong>g>to</str<strong>on</strong>g> the building, several bored piers adjoin the easement, but<br />

are not c<strong>on</strong>sidered <str<strong>on</strong>g>to</str<strong>on</strong>g> pose any future risk <str<strong>on</strong>g>of</str<strong>on</strong>g> loading in the z<strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> influence for the pipe with the<br />

piers <str<strong>on</strong>g>be</str<strong>on</strong>g>ing founded <strong>on</strong> n<strong>at</strong>urally occurring sands<str<strong>on</strong>g>to</str<strong>on</strong>g>ne.<br />

It is c<strong>on</strong>sidered <str<strong>on</strong>g>of</str<strong>on</strong>g> mutual <str<strong>on</strong>g>be</str<strong>on</strong>g>nefit, th<strong>at</strong> extinguishment and cre<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a new easement <str<strong>on</strong>g>be</str<strong>on</strong>g> pursuant<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> Secti<strong>on</strong> 88B <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>veyancing Act 1919 and address, a 2.2 metre wide and variable easement<br />

over the 1200mm diameter pipeline and pits, <str<strong>on</strong>g>be</str<strong>on</strong>g>nefit for discharge <str<strong>on</strong>g>of</str<strong>on</strong>g> priv<strong>at</strong>e s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er in<str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />

pipeline, Restricti<strong>on</strong> <strong>on</strong> Use for the overland flow p<strong>at</strong>h including terms in the easement <str<strong>on</strong>g>to</str<strong>on</strong>g> place<br />

maintenance cost arising from the adjacent structure <strong>on</strong><str<strong>on</strong>g>to</str<strong>on</strong>g> the property owner. All necessary<br />

document<strong>at</strong>i<strong>on</strong> must <str<strong>on</strong>g>be</str<strong>on</strong>g> carried out prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> Occup<strong>at</strong>i<strong>on</strong> Certific<strong>at</strong>e.<br />

It is impractical in this instance <str<strong>on</strong>g>to</str<strong>on</strong>g> restrict the area over the pipeline from heavy c<strong>on</strong>structi<strong>on</strong><br />

machinery during c<strong>on</strong>structi<strong>on</strong>. Following completi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the building, the applicant should<br />

undertake an inspecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the pipeline by CCTV with a copy supplied <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>council</str<strong>on</strong>g> for verific<strong>at</strong>i<strong>on</strong><br />

prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> Occup<strong>at</strong>i<strong>on</strong> Certific<strong>at</strong>e.<br />

If approval is given, the reloc<strong>at</strong>i<strong>on</strong> works and removal <str<strong>on</strong>g>of</str<strong>on</strong>g> the existing pipeline must <str<strong>on</strong>g>be</str<strong>on</strong>g> completed<br />

prior <str<strong>on</strong>g>to</str<strong>on</strong>g> commencement <str<strong>on</strong>g>of</str<strong>on</strong>g> the building.<br />
