Ordinary Meeting <strong>of</strong> Council - 26 April 2005 7 / 4 Item 7 DA1572/03 12 April 2005 Whilst the integrity <strong>of</strong> the pipeline should <strong>be</strong> protected by restricting the area over the pipeline from heavy construction machinery during construction <strong>of</strong> the building, it is impractical in this instance. Following completion <strong>of</strong> the building, it would <strong>be</strong> prudent <strong>to</strong> undertake an inspection <strong>of</strong> the pipeline by CCTV with a copy supplied <strong>to</strong> <strong>council</strong> for verification prior <strong>to</strong> issue <strong>of</strong> Occupation Certificate. If approval is given, the relocation works and removal <strong>of</strong> the existing pipeline must <strong>be</strong> completed prior <strong>to</strong> commencement <strong>of</strong> the building. Registration <strong>of</strong> the necessary documentation for the extinguishment and creation and associated restrictions must <strong>be</strong> carried out prior <strong>to</strong> issue <strong>of</strong> Occupation Certificate. Approval for works on public road The conditions outline requirements with regard <strong>to</strong> any portion <strong>of</strong> the pipeline relocation within the road reserve. As works associated with the relocated s<strong>to</strong>rmwater drainage pipeline are contained on site, approval from Council for works on a public road is not applicable, nor is erosion control requirement and traffic management requirements. Submission <strong>of</strong> the Environmental Management Plan The conditions also require submission <strong>of</strong> an Environmental Management Plan (EMP) for excavation, removal and disposal <strong>of</strong> fill from the site, noting that the EMP is <strong>to</strong> <strong>be</strong> approved by Council prior <strong>to</strong> the operation <strong>of</strong> the consent. Approval <strong>of</strong> the EMP is obtained from Development and Regula<strong>to</strong>ry section rather than by a resolution <strong>of</strong> the Council. In terms <strong>of</strong> the process, the matter is usually referred <strong>to</strong> the Environmental Planning & Projects Officer for assessment and comment. CONSULTATION Technical Services has consulted with the engineering consultant in relation <strong>to</strong> relocation and access <strong>of</strong> the s<strong>to</strong>rmwater pipeline. FINANCIAL CONSIDERATIONS All costs associated with construction, survey and legal matters for the relocation are <strong>to</strong> <strong>be</strong> borne by the applicant, Reece Pty Ltd <strong>be</strong>nefiting from this work. CONSULTATION WITH OTHER COUNCIL DEPARTMENTS Technical Services has consulted with the Engineering Assessment Unit in Development and Regula<strong>to</strong>ry in matters relating <strong>to</strong> the location <strong>of</strong> pipework and flooding over the subject property. Ordinary Meeting <strong>of</strong> Council - 26 April 2005 7 / 5 Item 7 DA1572/03 12 April 2005 SUMMARY Reece Pty Ltd submitted a DA No.1572/03 for a two s<strong>to</strong>rey commercial development and associated car parking at 8 West Street, Pymble that was approved by Commissioner Hussey in the Land and Environment Court on 14 Oc<strong>to</strong><strong>be</strong>r 2004, with four deferred commencement provisions: Revised s<strong>to</strong>rmwater plans and details, drawings C1-C7 Revision A, dated 16 February 2005, as well as structural drawings S1-S18, Revision A dated 18 Novem<strong>be</strong>r 2004, prepared by Appleyard Forrest Consulting Engineers Pty Ltd was submitted. Overall, the design was found <strong>to</strong> <strong>be</strong> in accordance with DCP 47 requirements and is considered satisfac<strong>to</strong>ry. By virtue <strong>of</strong> the requirement <strong>to</strong> locate the building <strong>to</strong> the western boundary situated over the current drainage system comprising a 1050mm diameter pipeline and easement, substantial infrastructure is required for the relocation. Works involve an installation <strong>of</strong> an upsized pipe line <strong>to</strong> 1200mm diameter, provision <strong>of</strong> bolt pit lids <strong>to</strong> prevent surcharging due <strong>to</strong> a pressured pipeline, <strong>be</strong>nching in pits, as well as provision <strong>of</strong> removal slab panel <strong>to</strong> allow continued access for maintenance. The redundant 1050mm pipeline within No.8 is <strong>to</strong> <strong>be</strong> removed and the trench backfilled. The property is vulnerable <strong>to</strong> overflows from a sag drainage pit fronting the site which collects s<strong>to</strong>rmwater run<strong>of</strong>f from Suakin, Bridge and West Streets. An overland flow route is designed <strong>to</strong> convey the flow in accordance with DCP47 requirements, with the provisional hazard rating although high, dose not pose risk <strong>to</strong> the public given the flowpath inaccessibility. Flows are controlled through the site by the use <strong>of</strong> dwarf masonry walls and are considered satisfac<strong>to</strong>ry. To support the elevated access ramps in<strong>to</strong> the building, several bored piers adjoin the easement, but are not considered <strong>to</strong> pose any future risk <strong>of</strong> loading in the zone <strong>of</strong> influence for the pipe with the piers <strong>be</strong>ing founded on naturally occurring sands<strong>to</strong>ne. It is considered <strong>of</strong> mutual <strong>be</strong>nefit, that extinguishment and creation <strong>of</strong> a new easement <strong>be</strong> pursuant <strong>to</strong> Section 88B <strong>of</strong> the Conveyancing Act 1919 and address, a 2.2 metre wide and variable easement over the 1200mm diameter pipeline and pits, <strong>be</strong>nefit for discharge <strong>of</strong> private s<strong>to</strong>rmwater in<strong>to</strong> the pipeline, Restriction on Use for the overland flow path including terms in the easement <strong>to</strong> place maintenance cost arising from the adjacent structure on<strong>to</strong> the property owner.
