Associ<strong>at</strong>ed with the proposed Stage 2 residential str<strong>at</strong>egy, Council has engaged a traffic c<strong>on</strong>sultant<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> undertake modeling <str<strong>on</strong>g>of</str<strong>on</strong>g> the entire St Ives area based <strong>on</strong> the likely future development. This study<br />

will examine a num<str<strong>on</strong>g>be</str<strong>on</strong>g>r <str<strong>on</strong>g>of</str<strong>on</strong>g> opti<strong>on</strong>s <str<strong>on</strong>g>to</str<strong>on</strong>g> improve traffic flow through the area given the existing traffic<br />

issues and likely future demands. This study is <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> c<strong>on</strong>cluded by early June <strong>2005</strong>.<br />

If access in<str<strong>on</strong>g>to</str<strong>on</strong>g> and out <str<strong>on</strong>g>of</str<strong>on</strong>g> the area bounded by Memorial Avenue, Link and M<strong>on</strong>a Vale Roads is <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

<str<strong>on</strong>g>be</str<strong>on</strong>g> provided through a new intersecti<strong>on</strong> <strong>at</strong> Stanley Street, Council would then need <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>sider how<br />

this access road could <str<strong>on</strong>g>be</str<strong>on</strong>g> cre<strong>at</strong>ed. At present there are a num<str<strong>on</strong>g>be</str<strong>on</strong>g>r <str<strong>on</strong>g>of</str<strong>on</strong>g> different property ownerships<br />

affected by this proposal and it is possible th<strong>at</strong> the cre<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the new road would need <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

obtained through property acquisiti<strong>on</strong>. It is likely th<strong>at</strong> Council would need <str<strong>on</strong>g>to</str<strong>on</strong>g> fund this acquisiti<strong>on</strong><br />

and therefore require significant funding for this purpose. Altern<strong>at</strong>ively, an amended Secti<strong>on</strong> 94<br />

plan may need <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> prepared but the time c<strong>on</strong>straints associ<strong>at</strong>ed with this opti<strong>on</strong> would need <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

c<strong>on</strong>sidered.<br />

At this stage, properties are owned by a num<str<strong>on</strong>g>be</str<strong>on</strong>g>r <str<strong>on</strong>g>of</str<strong>on</strong>g> different owners but negoti<strong>at</strong>i<strong>on</strong>s are c<strong>on</strong>tinuing<br />

<str<strong>on</strong>g>be</str<strong>on</strong>g>tween various parties. Meri<str<strong>on</strong>g>to</str<strong>on</strong>g>n Apartments Pty Ltd has since lodged a development applic<strong>at</strong>i<strong>on</strong><br />

for a porti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the site th<strong>at</strong> uses M<strong>on</strong>a Vale Road for access <str<strong>on</strong>g>to</str<strong>on</strong>g> the site and Memorial Avenue for<br />

both access and egress <str<strong>on</strong>g>of</str<strong>on</strong>g> the site. This development applic<strong>at</strong>i<strong>on</strong> will <str<strong>on</strong>g>be</str<strong>on</strong>g> assessed in accordance with<br />

the current st<strong>at</strong>u<str<strong>on</strong>g>to</str<strong>on</strong>g>ry planning c<strong>on</strong>trols and policy c<strong>on</strong>trols set out in DCP No. 55.<br />

Attached, as Attachment B, is a copy <str<strong>on</strong>g>of</str<strong>on</strong>g> legal advice obtained by Council <strong>on</strong> the processes <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

acquisiti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> land for this purpose. This m<strong>at</strong>ter was discussed <strong>at</strong> Council’s Planning Committee<br />

<str<strong>on</strong>g>meeting</str<strong>on</strong>g> in March <strong>2005</strong>.<br />

Given th<strong>at</strong> Council is so<strong>on</strong> required <str<strong>on</strong>g>to</str<strong>on</strong>g> prepare a new LEP for the St Ives village centre and a traffic<br />

c<strong>on</strong>sultant has <str<strong>on</strong>g>be</str<strong>on</strong>g>en engaged <str<strong>on</strong>g>to</str<strong>on</strong>g> undertake traffic modeling <str<strong>on</strong>g>of</str<strong>on</strong>g> the area, it is c<strong>on</strong>sidered th<strong>at</strong> access<br />

and egress from the site should not <str<strong>on</strong>g>be</str<strong>on</strong>g> c<strong>on</strong>sidered in isol<strong>at</strong>i<strong>on</strong>. It is c<strong>on</strong>sidered appropri<strong>at</strong>e <str<strong>on</strong>g>to</str<strong>on</strong>g> await<br />

the outcome <str<strong>on</strong>g>of</str<strong>on</strong>g> the traffic study <str<strong>on</strong>g>to</str<strong>on</strong>g> determine the preferred traffic arrangements for the village centre<br />

which will also include likely traffic gener<strong>at</strong>i<strong>on</strong> from this area.<br />

CONSULTATION<br />

C<strong>on</strong>sult<strong>at</strong>i<strong>on</strong> <strong>on</strong> this m<strong>at</strong>ter was undertaken as part <str<strong>on</strong>g>of</str<strong>on</strong>g> the exhibiti<strong>on</strong> process associ<strong>at</strong>ed with<br />

Development C<strong>on</strong>trol Plan No. 55.<br />

FINANCIAL CONSIDERATIONS<br />

The financial c<strong>on</strong>sider<strong>at</strong>i<strong>on</strong>s would need <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> further examined depending <strong>on</strong> Council’s preferred<br />

opti<strong>on</strong> for access and egress <str<strong>on</strong>g>to</str<strong>on</strong>g> the site. However, this may now <str<strong>on</strong>g>be</str<strong>on</strong>g> irrelevant given th<strong>at</strong> Council has<br />

received a development applic<strong>at</strong>i<strong>on</strong> for a large porti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the “St Ives triangle” and traffic analysis<br />

will now need <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> c<strong>on</strong>sidered as part <str<strong>on</strong>g>of</str<strong>on</strong>g> the assessment process for this development.<br />
