In support <str<strong>on</strong>g>of</str<strong>on</strong>g> the applic<strong>at</strong>i<strong>on</strong>, the Applicant has submitted a “Report <str<strong>on</strong>g>to</str<strong>on</strong>g> Mr Camer<strong>on</strong> Nels<strong>on</strong> <strong>on</strong><br />

Geotechnical Investig<strong>at</strong>i<strong>on</strong> for Proposed Residential Development <strong>at</strong> 1 <str<strong>on</strong>g>to</str<strong>on</strong>g> 5 Lynbarra avenue and<br />

12 Porters Lane, St Ives NSW” (project 18895VBrpt, d<strong>at</strong>ed 21 st Oc<str<strong>on</strong>g>to</str<strong>on</strong>g><str<strong>on</strong>g>be</str<strong>on</strong>g>r 2004) prepared by Jeffery<br />

and K<strong>at</strong>auskas C<strong>on</strong>sulting Engineers.<br />

The sub-surface geotechnical investig<strong>at</strong>i<strong>on</strong>s (4 boreholes) and subsequent report <strong>on</strong> the findings<br />

are c<strong>on</strong>sidered appropri<strong>at</strong>e for the scale <str<strong>on</strong>g>of</str<strong>on</strong>g> development <strong>on</strong> this site. Further, the report c<strong>on</strong>tains<br />

pertinent inform<strong>at</strong>i<strong>on</strong> and recommend<strong>at</strong>i<strong>on</strong>s <strong>on</strong> appropri<strong>at</strong>e excav<strong>at</strong>i<strong>on</strong> and c<strong>on</strong>structi<strong>on</strong><br />

techniques. Attenti<strong>on</strong> is paid <str<strong>on</strong>g>to</str<strong>on</strong>g> protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the adjacent property and infrastructure both during<br />

and after c<strong>on</strong>structi<strong>on</strong>.<br />

Council development assessment engineers are guided by the findings and recommend<strong>at</strong>i<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

expert geotechnical report submitted with the development applic<strong>at</strong>i<strong>on</strong>. Based <strong>on</strong> the above<br />

geotechnical report for this site, I am s<strong>at</strong>isfied th<strong>at</strong> the geotechnical aspects <str<strong>on</strong>g>of</str<strong>on</strong>g> this DA can <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

addressed through suitable c<strong>on</strong>diti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>sent. These c<strong>on</strong>diti<strong>on</strong>s will require geotechnical<br />

m<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>ring, excav<strong>at</strong>i<strong>on</strong>, c<strong>on</strong>structi<strong>on</strong> and further pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al geotechnical input as specified in the<br />

submitted geotechnical report. Dilapid<strong>at</strong>i<strong>on</strong> reports are <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> provided <strong>on</strong> adjoining buildings<br />

within the z<strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> influence (C<strong>on</strong>diti<strong>on</strong> No.106).<br />

Recommend<strong>at</strong>i<strong>on</strong><br />

Based <strong>on</strong> the formal assessment, Council’s Development Engineer has determined th<strong>at</strong> the proposal<br />

is s<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry for development approval, subject <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s.”<br />

Heritage<br />

Council’s Heritage Advisor, Mr Paul Dignam, has commented <strong>on</strong> the proposal as follows:<br />

The 4 allotments are not heritage listed nor in a c<strong>on</strong>serv<strong>at</strong>i<strong>on</strong> area.<br />

It is near <str<strong>on</strong>g>to</str<strong>on</strong>g> a heritage item, namely 9 Porters Lane, <str<strong>on</strong>g>be</str<strong>on</strong>g>ing the former headmasters cottage.<br />

The heritage item <strong>at</strong> 9 Porters Lane is <strong>on</strong> a b<strong>at</strong>tle axe lot. The subject site is somewh<strong>at</strong> removed<br />

from the heritage item. There would <str<strong>on</strong>g>be</str<strong>on</strong>g> no adverse heritage impacts <strong>on</strong> 9 Porters Lane from the<br />

prosed development.<br />

The former headmaster’s cottage is <strong>on</strong> the corner <str<strong>on</strong>g>of</str<strong>on</strong>g> Porters Lane and Rosedale Road. The<br />

building faces Rosedale Road, having a sec<strong>on</strong>dary fr<strong>on</strong>tage <str<strong>on</strong>g>to</str<strong>on</strong>g> Porters Lane. The site is a<br />

reas<strong>on</strong>able distance from the subject site and do not <str<strong>on</strong>g>be</str<strong>on</strong>g>lieve there would <str<strong>on</strong>g>be</str<strong>on</strong>g> any adverse impacts <strong>on</strong><br />

it from the proposed development.<br />

All existing buildings <strong>on</strong> the site are rel<strong>at</strong>ively modest brick houses d<strong>at</strong>ing <str<strong>on</strong>g>to</str<strong>on</strong>g> the early 1960’s. The<br />

houses are similar <str<strong>on</strong>g>to</str<strong>on</strong>g> many other than <str<strong>on</strong>g>be</str<strong>on</strong>g>ing represent<strong>at</strong>ive <str<strong>on</strong>g>of</str<strong>on</strong>g> th<strong>at</strong> period. There is no objecti<strong>on</strong><br />

from the heritage advisor for demoliti<strong>on</strong>, but recommend th<strong>at</strong> recording <str<strong>on</strong>g>be</str<strong>on</strong>g> undertaken <str<strong>on</strong>g>be</str<strong>on</strong>g>fore<br />

demoliti<strong>on</strong> (C<strong>on</strong>diti<strong>on</strong> No. 34).<br />
