PURPOSE OF REPORT
To place Council's 2005-2009 Draft Management Plan, incorporating the Budget, Special Rate
Variation and Fees and Charges for 2005/2006 on public exhibition.
BACKGROUND
• Section 402 <strong>of</strong> the Local Government Act (1993) (LGA) requires Councils <strong>to</strong> produce an
annual Management Plan which outlines its principal activities for a period <strong>of</strong> four years.
• Sections 403 and 404 <strong>of</strong> the LGA set out the statu<strong>to</strong>ry contents <strong>of</strong> a Council’s Management
Plan.
• Section 405 <strong>of</strong> the LGA requires the Draft Management Plan <strong>to</strong> <strong>be</strong> placed on public
exhibition for a period <strong>of</strong> twenty eight days, that suitable public notice <strong>be</strong> given and that
submissions on the Management Plan are welcomed from the community.
• Section 406 <strong>of</strong> the LGA stipulates that a Council’s Management Plan must <strong>be</strong> adopted prior <strong>to</strong>
the end <strong>of</strong> each financial year.
On 14 Decem<strong>be</strong>r 2004 Council resolved:
“A.
That Council support the development <strong>of</strong> a draft application for variation <strong>to</strong> rates
commencing 2005/06 for the purpose <strong>of</strong> funding a range <strong>of</strong> environmental initiatives
B. That the submission <strong>be</strong> incorporated within the development <strong>of</strong> the draft
Management Plan and budget for 2005/06
C. That as part <strong>of</strong> the submission community consultation <strong>be</strong> undertaken <strong>to</strong> determine
support and direction <strong>of</strong> the program
D. That a further report <strong>be</strong> presented back <strong>to</strong> Council for its consideration on the
details, support, direction and community consultative mechanisms <strong>of</strong> the program in
February 2006.”
The application <strong>to</strong> prepare a special rate variation as supported by Council in Decem<strong>be</strong>r is subject <strong>to</strong>
the approval <strong>of</strong> the Minster pursuant <strong>to</strong> section 508(2) <strong>of</strong> the LGA. To assist <strong>council</strong>s in the
preparation <strong>of</strong> their submission for a rate variation, the Department <strong>of</strong> Local Government has set
guidelines as <strong>to</strong> the requirements (refer <strong>to</strong> Department <strong>of</strong> Local Government Circular Num<strong>be</strong>r 05/06
dated 04/03/05). Three key aspects <strong>of</strong> the guidelines relevant <strong>to</strong> this report state:
The Council must include within its draft management plan a statement <strong>of</strong> its intention <strong>to</strong> apply for
a special variation and reasons for the increase.
Public notification <strong>of</strong> the draft management plan inviting submissions (section 405) must also
include a clear indication <strong>of</strong> the <strong>council</strong>’s intention <strong>to</strong> seek a special variation and the level <strong>of</strong> the
variation sought as a percentage increase <strong>of</strong> general income.
