BACKGROUND: Section 402 ong>ofong> the Local Government Act (1993) requires Council’s ong>toong> produce an Annual Management Plan which identifies its principal activities and objectives for the next four years. Section 405 ong>ofong> the Local Government Act (1993) requires the Draft Management Plan ong>toong> ong>beong> placed on public exhibition for a period ong>ofong> twenty eight days which allows for community feedback. COMMENTS: Council has identified seven principal activities and a numong>beong>r ong>ofong> objectives have ong>beong>en formulated for each principal activity. Linked ong>toong> these objectives are a numong>beong>r ong>ofong> outcomes and performance indicaong>toong>rs that clearly identify how objectives will ong>beong> achieved and how performance in achieving these objectives will ong>beong> measured over the term ong>ofong> the plan. RECOMMENDATION: That Council adopt the Draft Management Plan, incorporating the Budget, Special Rate Variation and Fees and Charges for 2005/2006 for the purpose ong>ofong> public exhibition. BACKGROUND • Section 402 ong>ofong> the Local Government Act (1993) (LGA) requires Councils ong>toong> produce an annual Management Plan which outlines its principal activities for a period ong>ofong> four years. • Sections 403 and 404 ong>ofong> the LGA set out the statuong>toong>ry contents ong>ofong> a Council’s Management Plan. • Section 405 ong>ofong> the LGA requires the Draft Management Plan ong>toong> ong>beong> placed on public exhibition for a period ong>ofong> twenty eight days, that suitable public notice ong>beong> given and that submissions on the Management Plan are welcomed from the community. • Section 406 ong>ofong> the LGA stipulates that a Council’s Management Plan must ong>beong> adopted prior ong>toong> the end ong>ofong> each financial year. On 14 Decemong>beong>r 2004 Council resolved: “A. That Council support the development ong>ofong> a draft application for variation ong>toong> rates commencing 2005/06 for the purpose ong>ofong> funding a range ong>ofong> environmental initiatives B. That the submission ong>beong> incorporated within the development ong>ofong> the draft Management Plan and budget for 2005/06 C. That as part ong>ofong> the submission community consultation ong>beong> undertaken ong>toong> determine support and direction ong>ofong> the program D. That a further report ong>beong> presented back ong>toong> Council for its consideration on the details, support, direction and community consultative mechanisms ong>ofong> the program in February 2006.” The application ong>toong> prepare a special rate variation as supported by Council in Decemong>beong>r is subject ong>toong> the approval ong>ofong> the Minster pursuant ong>toong> section 508(2) ong>ofong> the LGA. To assist ong>councilong>s in the preparation ong>ofong> their submission for a rate variation, the Department ong>ofong> Local Government has set guidelines as ong>toong> the requirements (refer ong>toong> Department ong>ofong> Local Government Circular Numong>beong>r 05/06 dated 04/03/05). Three key aspects ong>ofong> the guidelines relevant ong>toong> this report state: The Council must include within its draft management plan a statement ong>ofong> its intention ong>toong> apply for a special variation and reasons for the increase. Public notification ong>ofong> the draft management plan inviting submissions (section 405) must also include a clear indication ong>ofong> the ong>councilong>’s intention ong>toong> seek a special variation and the level ong>ofong> the variation sought as a percentage increase ong>ofong> general income.
