<strong>ISTH</strong> <strong>2009</strong> Rules and Regulations<br />

Industry Guidelines<br />

<strong>ISTH</strong> reminds exhibitors and their agents or designees of their<br />

responsibility to be aware of and to abide by the <strong>ISTH</strong> Code of Conduct<br />

and all guidelines and codes regarding the relationship between the<br />

pharmaceutical and medical device/equipment industry and healthcare<br />

professionals, including:<br />

Accreditation Council for Continuing Medical Education (ACCME)<br />

Standards for Commercial Support<br />

Advanced Medical Technology Association (AdvaMed) Code of<br />

Ethics for Interactions with Healthcare Professionals<br />

American Medical Association (AMA) Opinion 8.061 Gifts to<br />

Physicians from Industry<br />

Office of Inspector General (OIG) Compliance Program Guidance<br />

for Pharmaceutical Manufacturers<br />

Pharmaceutical Research and Manufacturers of America (PhRMA)<br />

Code on Interaction with Healthcare Professionals<br />

Americans with Disabilities Act<br />

Each exhibitor shall be responsible for compliance with the Americans<br />

with Disabilities Act with regard to its booth space, including, but not<br />

limited to, wheelchair access provisions. Exhibitors shall indemnify, hold<br />

harmless, and defend the <strong>ISTH</strong> and MCI and their officers, directors,<br />

agents, members and employees from and against any claims, liabilities,<br />

losses, damages and expenses, including attorney's fees and expenses,<br />

resulting from or arising out of the exhibitors' failure or allegations of<br />

exhibitors' failure to comply with the provisions of the ADA.<br />

Cancellation of Exhibition<br />

It is mutually agreed that in the event of total or partial cancellation of the<br />

Congress due to fire, strike, natural disaster (either threatened or actual),<br />

government regulations or causes which would prevent its scheduled<br />

opening or continuance, this agreement will be terminated immediately,<br />

and the <strong>ISTH</strong> shall determine an equitable basis for the refund of a<br />

portion of the exhibit fees, after due consideration of expenditures and<br />

commitments already made. Under no circumstances is the <strong>ISTH</strong><br />

responsible for any exhibitor's expenses (such as travel, lodging, or<br />

exhibit shipping), or any other incidental or consequential damages.<br />

Third Party Companies<br />

MCI as well as <strong>ISTH</strong> will communicate exclusively with clearly identified<br />

third party companies officially mandated by participating exhibitors and<br />

sponsors. Queries received from third party companies (i.e.<br />

communication and press agencies) which do not clearly indicate which<br />

company they are representing will not be answered.<br />
