2007 Category 1: Kenya Africa Kenya 2007 Category 1 Winner Performance Contracts Steering Committee Secretariat, Kenya Description Emphasising results over process compliance by introducing a performance-based contracting system in the public sector. Summary In Kenya, an extensive system of performance-based contracting has been put in place to ensure a style of public sector management that emphasizes results over process compliance fostering greater responsiveness and accountability of the civil service. The Problem Since independence, the performance of the Kenyan civil service has been deteriorating. This state of affairs resulted largely from a system of management in the public sector, which emphasized compliance with processes rather than results. Performance contracts were thus implemented to reverse this trend. Problems inhibiting the performance of government agencies are generally similar to those found in other countries and have been identified as follows: excessive control system, multiplicity of principals, frequent political interference, poor management, and outright mismanagement. Over time, the government has implemented different strategies to address these challenges. These strategies included: structural adjustment, privatization, commercialization, contracting out new budgeting and planning systems. Even with these strategies being implemented, performance of the civil service did not improve. Government subsequently changed course, and in the Economic Recovery Strategy (ERS) plan it was decided that performance contracting process be adopted as a management tool of public resources. The Solution In 2004, a set of pilot projects in sixteen state-owned enterprises was launched to implement a performance based contracting system in the public sector. A Performance Contract is an agreement between the government and a public agency, which establishes general goals for the agency, sets targets for measuring performance and provides incentives for achieving these targets. Kenya has implemented one of the most extensive systems of Performance Contracts (PCs). The scope, speed and mag- 285
