Article VIII. <strong>Church</strong> Property and Titles<br />
5. In the very rare cases when a congregation chooses to<br />
violate the trust, it becomes the responsibility of the<br />
Conference Executive Council as defender of last resort to<br />
preserve the church facilities for succeeding generations of<br />
International Pentecostal Holiness children and<br />
grandchildren in the faith.<br />
6. A Transfer Member <strong>Church</strong> may retain full control of any<br />
real property the church acquired before becoming an<br />
<strong>IPHC</strong> Transfer Member <strong>Church</strong>. Any real property acquired<br />
after becoming an <strong>IPHC</strong> Transfer Member <strong>Church</strong> shall be<br />
subject to the provisions of this Article regarding real<br />
property that apply to Planted Member <strong>Church</strong>es unless an<br />
exception to those provisions is granted in writing by the<br />
Conference Executive Council.<br />
7. The board of trustees or board of directors or Local <strong>Church</strong><br />
Administrative Council, if incorporated, holding title to local<br />
church property shall be elected by the church<br />
congregation and shall serve until removed and their<br />
successors elected. If a conveyance, gift, or devise shall<br />
have been made directly to the local church without<br />
reference to trustees, the board of trustees shall have the<br />
same authority as if they were named in the deed or<br />
devise. Any local church shall be strongly discouraged<br />
from receiving any deed to property by will or any other<br />
means which is encumbered by a reversion clause.<br />
8. Notwithstanding any provision above set out, when<br />
property owned by a local church, whether incorporated or<br />
not, shall cease to be used for religious purposes in<br />
accordance with the faith of the church and provisions of<br />
the International Pentecostal Holiness <strong>Church</strong> <strong>Manual</strong>, title<br />
to such property shall vest in the Conference where<br />
membership is held. The Conference Executive Council<br />
shall determine that such use has ceased and the date<br />
when it ceased, which date shall be the date title vested in<br />
the Conference. The Conference Executive Council shall<br />
record such findings in its minutes, and such minutes shall<br />
be conclusive proof of such vesting of title in the<br />
Conference on that date. The Conference Executive<br />
Council may institute proceedings in any appropriate court<br />
