Article VI. Trials and Appeals<br />

3) No minister who has withdrawn under charges,<br />

without making a full confession of guilt, shall be<br />

reinstated without a full investigation in the case.<br />

e. Any minister whose credentials have been revoked and<br />

who has been incarcerated by civil authority is required<br />

to give six (6) months of proven conduct after he has<br />

been released from that incarceration before applying<br />

for reinstatement.<br />

f. All disciplinary actions and restorations on the<br />

Conference and General levels shall be at the<br />

discretion of the council to which the defendant is<br />

amenable.<br />

2. Legal Counsel<br />

Hearings and/or trials in the International Pentecostal<br />

Holiness <strong>Church</strong> are ecclesiastical and not civil in nature.<br />

Matters involving church membership should be judged by<br />

the guidelines of the Holy Scriptures. Legal counsel shall<br />

not be permitted in ecclesiastical trials.<br />

3. Witnesses<br />

a. The counsel for the defendant and the selected<br />

spokesman may call witnesses as deemed necessary.<br />

Questioning of witnesses shall be conducted in a<br />

Christlike manner.<br />

b. A list of all witnesses and copies of all proposed trial<br />

exhibits must be presented to the chairman of the<br />

Judiciary Committee, selected spokesman, and<br />

defendant one week prior to trial.<br />

c. Additional witnesses may be called if new evidence<br />

arises.<br />

d. All witnesses shall be persons of reliable integrity, except<br />

a person allegedly directly involved in immoral conduct.<br />

An affidavit from any person directly involved in immoral<br />

conduct shall be considered as evidence only when the<br />

defendant does not appear and contest the charges.<br />
