<strong>FORM</strong> <strong>OF</strong> <strong>NO</strong> <strong>OBJECTION</strong><br />

This Letter of No Objection is not a regulatory permit and does not authorize the implementation of any project without<br />

documented approval from all appropriate regulatory authorities.<br />

Applicant's Request: Approval to drill a two (2) inch diameter domestic water well, install a sewer treatment plant,<br />

construct a driveway, place a twenty eight (28) ft. by eighty (80) ft. campsite, install an electric service pole, and<br />

construct a twenty five (25) ft. by thirty (30) ft. steel building on a concrete slab, with footings, adjacent to the West<br />

Atchafalaya Basin Protection Levee near Charenton, LA. This activity was previously requested by Brian Stansbury on<br />

December 19, 2006. The Department of Transportation and Development approved the original request in a Letter of No<br />

Objection sent to the Atchafalaya Basin Levee District dated December 28, 2006 [letter no. 38020]. The United States<br />

Army Corps of Engineers approved the original request in a letter sent to the Atchafalaya Basin Levee District dated<br />

March 20, 2007. Mr. Stansbury sold the property to the Thibodauxs on August 22, 2007. The West Atchafalaya Basin<br />

Protection Levee located adjacent to this proposed activity was under the jurisdiction of the Atchafalaya Basin Levee<br />

District at the time of the original request. Act 259 of the 2007 Louisina Legislature transferred the levees in St. Mary<br />

Parish to the newly created St. Mary Levee District.<br />

Project Location: All work will take place on the protected side of the West Atchafalaya Basin Protection Levee near<br />

levee station 4586+60, at 24259 Charenton Levee Road, Charenton, LA in section 9 of T13S-R9E St. Mary Parish.<br />

The above referenced request has been examined by Billy Wall , Operations Supervisor, and no objection is<br />

proffered for this request, provided:<br />

This Letter of No Objection is only for stated work within or adjacent to the Levee District right-of-way, and<br />

must be accomplished in accordance with the details set forth in the applicant's request and the conditions<br />

contained herein. Any changes to the limits or scope of the proposed work must be submitted for additional<br />

review. The Levee District must be contacted in writing prior to commencement and at the end of activities.<br />

The applicant is responsible for obtaining and providing copies of any permits or lease agreements necessary<br />

from the U.S. Army Corps of Engineers, the State Land Office, DOTD, the Parish Government, Coastal<br />

Management Division, and/or any other applicable agencies, as well as documented approval from the area<br />

landowner(s) prior to the initiation of the work. The applicant is responsible for adhering to the provisions of<br />

any existing permits. The proposed work must not restrict the Levee District's maintenance operations, or<br />

any potential flood fight activities at the levee, nor shall it obstruct or impede drainage, or create areas of<br />

standing water on the levee batture. The applicant must employ and maintain suitable erosion protection<br />

measures at the project site to the satisfaction of the Levee Board. The applicant or owner must immediately<br />

notify the Levee Board of any seepage or sand boils that occur during high water conditions. All materials<br />

associated with the proposed work must be removed from the area upon completion of the project and the<br />

area must be returned to its original state of existence or better. Any damage done to the levee, floodwall or<br />

other flood control structure, revetment, or surrounding project area, resulting from the proposed work must

be repaired or replaced by the applicant. Finally, should any change in the location of the existing levee,<br />

river, floodwall, drainage canal, waterway, or generally prevailing conditions in the vicinity, or should any<br />

changes in the area be required in the future, in the public interest, the applicant at his own expense shall<br />

make such changes in the project as necessary.<br />

That precaution is taken to ensure that no construction material, demolition material, or debris falls into the<br />

waterway or near the bank of the waterway during construction or demolition activities.<br />

That no campsite construction activities are performed when the Mississippi River attains or exceeds + 1<strong>1.</strong>0<br />

ft. NGVD, at the Carrollton gage at New Orleans, without prior documented approval to the contrary from the<br />

U.S. Army Corps of Engineers-New Orleans District.<br />

That no equipment, vehicles, or materials of any kind are parked or stored on the levee or on its slopes.<br />

That the installation of the well, or any associated drilling activities, is performed by a drilling contractor<br />

licensed to drill in Louisiana under R.S. 38:3098.<br />

That the water well is properly constructed and subsequently abandoned in strict accordance with the State of<br />

Louisiana Water Well Rule, Regulations and Standards (November 1985)<br />

That in accordance with Louisiana R.S. 38:225, no deep well is installed within 250 feet of the levee toe.<br />

That one or more check-valves are strategically incorporated into the well design in such a fashion as to<br />

prohibit the intrusion of surface water into the well during periods of inundation at the well site, or in the event<br />

the well site was to suffer catastrophic damage or destruction from floating debris as a result of its location<br />

within the floodplain.<br />

That prior to affixing the pump and any associated fixtures, a wellhead protection casing is placed over and<br />

surrounding the well casing. The protective casing must be buried no less than four feet below ground, and<br />

extend no less than two feet above ground. A two-inch diameter well should incorporate a six-inch diameter<br />

protective casing, and a four-inch diameter well should incorporate a ten-inch diameter protective casing. Any<br />

well diameter in excess of four inches should incorporate a protective casing of sufficient size to<br />

accommodate a three-inch annular space surrounding the interior well casing stem. Finally, the annular<br />

space between the well casing and the wellhead protective casing must be entirely sealed with appropriate<br />

cement-bentonite grout, and in such a manner as to prohibit voids in the annular seal.<br />

That for any pump which is to be installed directly atop the wellhead, that the pump must be securely fastened<br />

to the protective casing surrounding the well casing via a metal plate and bolts. The installation must prevent<br />

the intrusion of surface water or floodwater into the well at all times.<br />

That should installation of any submersible pump be intended for the well, the wellhead shall be made<br />

sufficiently watertight with a sanitary seal, such that the integrity of the well is maintained and no surface<br />

water is allowed to intrude into the well during any potential inundation of the well site within the floodplain.<br />

That should there be any potential for "free-flowing" conditions at any proposed wellsite(s), a positive cutoff<br />

device must be included in the well(s) design.<br />

That the applicant contact the Department of Transportation & Development Office and obtain any permits<br />

that may be required for any operations, work or construction occurring within or adjacent to U.S. or Louisiana

Highway Right-of-Way. The applicant must adhere to any DOTD District Office requirements imposed for<br />

vehicle ramp intersection with the Louisiana Highway right-of-way, as well as for traffic control and safety<br />
