HIGHLIGHTS OF ACCOMPLISHMENTS<br />
Section 401 (Modification of Duty)<br />
Public hearings were conducted on petitions for tariff modification initiated by<br />
the government during the year. The findings <strong>and</strong> recommendations of the<br />
<strong>Commission</strong> on said petitions were submitted to the National Economic <strong>and</strong><br />
Development Authority (NEDA) for consideration of the <strong>Tariff</strong> <strong>and</strong> Related Matters<br />
(TRM) Technical <strong>and</strong> Cabinet Committees.<br />
For the period covered, the <strong>Commission</strong> conducted two (2) public hearings<br />
covering various articles, to wit:<br />

26 January 2011 (Petition for the extension of the zero rate of duty on<br />
capital equipment, spare parts <strong>and</strong> accessories under EO 528 <strong>and</strong> the<br />
inclusion of Chapter 86 in the product coverage thereof); <strong>and</strong><br />
6 December 2011 (Implementation of the 2012 version of the ASEAN<br />
Harmonized <strong>Tariff</strong> Nomenclature [AHTN] to form part of Section 104 of the<br />
<strong>Tariff</strong> <strong>and</strong> Customs Code).<br />

Section 402 (Promotion of Foreign Trade)<br />
Public consultations were conducted regarding the <strong>Philippine</strong>s’ regional tariff<br />
commitments under the ASEAN-China Free Trade Agreement (ACFTA) <strong>and</strong> the<br />
ASEAN-Korea Free Trade Agreement (AKFTA).<br />
For the period covered, the President issued two (2) <strong>Commission</strong>-drafted<br />
implementing Executive Orders (EOs):<br />
EO No. 25 (signed 10 February 2011)<br />
<br />
Modifying the rates of duty on certain imported articles as provided for<br />
under the <strong>Tariff</strong> <strong>and</strong> Customs Code of 1978 (Presidential Decree No.<br />
1464), as amended, in order to implement the commitments in the<br />
Agreement on Trade in Goods under the Framework Agreement on<br />
Comprehensive Economic Cooperation between the Association of<br />
Southeast Asian Nations (ASEAN) <strong>and</strong> the Republic of India.<br />
EO No. 52 (signed 5 August 2011)<br />
<br />
Temporary waiver of the reciprocal tariff treatment on certain articles to<br />
implement the agreement between the Republic of the <strong>Philippine</strong>s <strong>and</strong> the<br />
Republic of Korea on the compensatory measure in relation to the delayed<br />
implementation of <strong>Philippine</strong> tariff concessions under the Framework<br />
Agreement on Comprehensive Economic Cooperation among the<br />
Governments of the member countries of ASEAN <strong>and</strong> the Republic of<br />
Korea.

Republic Act 8800 (Safeguard Meas<strong>ures</strong> Act of 2000)<br />
On the monitoring of adjustment plans for the steel angle bar industry, the<br />
<strong>Commission</strong> submitted its monitoring report to the Department of Trade <strong>and</strong> Industry<br />
(DTI) Secretary on 24 May 2011 finding that the domestic steel angle bar industry has<br />
complied substantially with its commitments as stated in its adjustment plans.<br />
On the petition for extension of safeguard measure against imports of steel<br />
angle bars, the <strong>Commission</strong>, on 4 November 2011, submitted its Formal Investigation<br />
Report to the DTI recommending the extension of the imposition of safeguard<br />
measure for another three (3) years in the amount of P4,300/MT for the first year of<br />
implementation.<br />
Section 1313-a (<strong>Tariff</strong> Commodity Classification)<br />
Two hundred sixty-seven (267) tariff commodity classification rulings were<br />
issued during the year.<br />
Section 506 (Assistance to the President <strong>and</strong> Congress of the <strong>Philippine</strong>s)<br />
The <strong>Commission</strong> provided technical assistance to the Senate <strong>and</strong> the House of<br />
Representatives by way of submission of comments/recommendations concerning<br />
proposed bills involving tariff <strong>and</strong> trade-related matters.<br />
HS/AHTN Implementation<br />
In connection with the Harmonized System / ASEAN Harmonized <strong>Tariff</strong><br />
Nomenclature (HS/AHTN) 2007 implementation, the <strong>Commission</strong> undertook the<br />
following activities, among others:<br />
As the lead agency for the <strong>Philippine</strong>s, attended the 6 th , 7 th <strong>and</strong> 8 th<br />
Meetings of the AHTN Task Force held in Brunei, Manila <strong>and</strong> Myanmar,<br />
respectively;<br />

Prepared the draft AHTN 2012 text to incorporate <strong>Philippine</strong> requirements<br />
beyond the 8 th digit Code;<br />
Conducted a line-by-line review of Section 104 (Rates of Import Duty) of<br />
the <strong>Tariff</strong> <strong>and</strong> Customs Code in drafting the Executive Order on the 2010<br />
Comprehensive <strong>Tariff</strong> Review; <strong>and</strong>

Participated, as resource speakers, in DTI-sponsored Regional Advocacy<br />
on Doing Business in FTA (DBFTA I, II <strong>and</strong> III).<br />
Competition Policy<br />
As an active advocate of <strong>competition</strong> <strong>polic</strong>y, the <strong>Commission</strong> prepared letters/<br />
replies to the ASEAN Secretariat regarding, among others:<br />

Agreement (IA) indicator 5, of the ASEAN-Deutsche Gesellschaft fuer<br />

Inputs to the draft <strong>competition</strong> bills pending deliberation at the House of<br />
Representatives, as member of the Technical Working Group (TWG); <strong>and</strong><br />

Competition in PJEPA.<br />
As <strong>Philippine</strong> representative to the ASEAN Experts Group on Competition, the<br />
<strong>Commission</strong> participated in, among others:<br />

Organizational Reforms on Competition Authorities – Case Studies from<br />

I. SECTION 401 – MODIFICATION OF DUTY (FLEXIBLE CLAUSE)<br />
Section 401 of the <strong>Tariff</strong> <strong>and</strong> Customs Code of the <strong>Philippine</strong>s (TCCP)<br />
empowers the <strong>Commission</strong> to conduct public hearings on individual requests <strong>and</strong><br />
motu proprio petitions for tariff modification.<br />
Under this provision, the petitioner is required to accomplish <strong>Tariff</strong> <strong>Commission</strong><br />
Form No. 3 (Information for <strong>Tariff</strong> Adjustment) which is available at the <strong>Commission</strong>.<br />
Aside from the <strong>Commission</strong>’s invitations to interested parties, notices of public<br />
hearings are published in two (2) newspapers of general circulation. During the<br />
hearing, concerned parties are given the opportunity to make oral presentations <strong>and</strong><br />
to present evidence in support of their positions. The <strong>Commission</strong>’s investigative<br />
process also involves plant visits which include, among others, the ocular inspection<br />
of plant facilities, production process <strong>and</strong> the verification of the accuracy <strong>and</strong><br />
authenticity of some or all the data <strong>and</strong> information submitted in support of the<br />
positions of the parties.<br />
The <strong>Commission</strong>’s report of findings <strong>and</strong> recommendations are submitted to<br />
the National Economic <strong>and</strong> Development Authority (NEDA) within thirty (30) days after<br />
the termination of the public hearing. This is deliberated upon by the <strong>Tariff</strong> <strong>and</strong><br />
Related Matters (TRM) Technical <strong>and</strong> Cabinet Committees. Upon final approval by<br />
the NEDA Board, the <strong>Commission</strong> prepares the necessary implementing Executive<br />
Order (EO) for signature of the President.<br />

The 2010 Comprehensive <strong>Tariff</strong> Review (CTR 2010) was the most recent tariff<br />
review conducted by the <strong>Commission</strong> to set in place the new MFN tariff structure from<br />
2011-2015 on all products under Chapters 1-97 of the <strong>Tariff</strong> <strong>and</strong> Customs Code of the<br />
<strong>Philippine</strong>s (TCCP). The said review was undertaken to provide predictability <strong>and</strong><br />
transparency to businesses <strong>and</strong> create opportunities for growth <strong>and</strong> greater<br />
employment.<br />
The <strong>Commission</strong> chaired the TRM-Technical Working Group (TWG) review of<br />
the latest 5-year tariff schedule, together with the Board of Investment <strong>and</strong> the<br />
Department of Agriculture (Vice-Chairs); NEDA (TWG Secretariat); Bureau of<br />
International Trade Relations - Department of Trade <strong>and</strong> Industry; Bureau of Customs;<br />
Department of Environment <strong>and</strong> Natural Resources; Department of Foreign Affairs;<br />
Department of Finance; Department of Transportation <strong>and</strong> Communication; Bangko<br />
Sentral ng Pilipinas; Office of the President; Department of Labor <strong>and</strong> Employment;<br />
<strong>and</strong> Department of Agrarian Reform.

Notably, EO 21 <strong>and</strong> EO 22 which implemented the zero rate of duty on food<br />
(milling) wheat <strong>and</strong> cement <strong>and</strong> cement clinker were the only EOs issued in 2011<br />
relative to MFN rates prior to the issuance of EO 61 (published on 15 December 2011<br />
in Malaya). As stated in Section 5 of EO 61, this “shall take effect thirty (30) days<br />
following its complete publication in a newspaper of general circulation.”<br />
EO 61 which prescribed the latest 5-year tariff structure did not become<br />
effective as scheduled. The 2010 Most-Favored-Nation (MFN) rates remained<br />
applicable for calendar year 2011.

The completion of the review of the CTR 2010 resulted in the issuance of EO<br />
61 where overall AHTN tariff lines (Chapters 1-97) were reduced from 8,990 in 2010<br />
to 8,643 in 2011-2015 or an approximately 4% cut in the number of the AHTN tariff<br />
lines in 2010.

The tariff structure for pre-CTR 2010 <strong>and</strong> EO 61 ranged from 0% to 65%.<br />
While the 2010 MFN rates of duty remained applicable in 2011, the issuance of<br />
EO 61 resulted to slight changes in the percentage distribution of MFN rates of duty<br />
between pre-CTR 2010 <strong>and</strong> CTR 2010, as follows:<br />
<br />
EO 61 MFN rates at 0% to 5% levels increased by 1% from 60% to 61% as<br />
a result of reduction in the rates of duty on certain motor vehicle parts <strong>and</strong><br />
components with higher tariff rates;<br />
At 7% to 15% levels, percentage distribution remained stable at 34%<br />
despite tariff changes within the same tariff b<strong>and</strong>; <strong>and</strong><br />
<br />
EO 61 MFN rates at 20% <strong>and</strong> above range decreased by 1% from 6% to<br />
5% as a result of the merging of tariff lines at lower rates of duty on certain<br />
motor vehicle parts <strong>and</strong> components, <strong>and</strong> the reduction of rates of duty on<br />
other residual products of the chemical <strong>and</strong> allied industries, among others.<br />

The overall average applied MFN tariff in 2011-2013 declined by about 4.42%<br />
from the 2010 level. This resulted from the reduction/elimination of rates of duty<br />
under EO 61 on certain not locally produced manufacturing inputs <strong>and</strong> on certain tariff<br />
lines merged/unified which include transdermal therapeutic system patches for the<br />
treatment of cancer or heart diseases; antisera/other blood fractions <strong>and</strong> modified<br />
immunological products; polymers; refined petroleum products; packaging products,<br />
waste from chemical or allied industries; new pneumatic tyres; <strong>and</strong> parts <strong>and</strong><br />
accessories of pumps/compressors.<br />
The phased-down reduction in the MFN rates of duty under EO 61 on<br />
seventeen (17) tariff lines (i.e., glass/iron <strong>and</strong> steel waste <strong>and</strong> scrap products) in 2014<br />
-2015 registered a negligible cut in the average applied MFN tariff from 2011-2013<br />
level.<br />
II.<br />
SECTION 402 – PROMOTION OF FOREIGN TRADE<br />
In order to exp<strong>and</strong> the foreign market for <strong>Philippine</strong> products, the <strong>Commission</strong><br />
is m<strong>and</strong>ated to conduct public consultations with interested parties before the<br />
<strong>Philippine</strong>s (1) enters into any trade agreement with any foreign government or<br />
instrumentality thereof; <strong>and</strong> (2) modifies import duties (including any necessary<br />
change in classification) <strong>and</strong> other import restrictions, as are required or appropriate<br />
to carry out <strong>and</strong> promote foreign trade.

Interested parties may petition the <strong>Commission</strong> for tariff modification under<br />

Concerned parties are invited to these consultations of which schedules <strong>and</strong><br />
product coverage are published in two (2) leading newspapers of general circulation.<br />
As in Section 401 hearings, the <strong>Commission</strong> affords each interested party<br />
reasonable opportunity to express his views during the public consultation. In order to<br />
verify the positions/evidences presented, plant visits are likewise conducted by the<br />
<strong>Commission</strong>. Findings <strong>and</strong> recommendations are submitted to NEDA which then<br />
schedules these for deliberation by the TRM Technical <strong>and</strong> Cabinet Committees.<br />

Rules of Origin (ROO)<br />
Rules of Origin refers to the “set of criteria used to determine the country of<br />
origin of a good in international trade.” An important component of every Free Trade<br />
Agreement (FTA), Rules of Origin (ROO) determines the origin of the products for<br />
purposes of granting tariff concessions or preferential treatment.<br />
The <strong>Commission</strong> was occupied in the area of ROO during the year. It actively<br />
participated in the drafting of the country’s positions, proposals <strong>and</strong> counter-proposals<br />
regarding issues in the ASEAN-CEPT conversion to the product-specific rules based<br />
on tariff shift, adoption of self-certification <strong>and</strong> ROO agreements with different<br />
dialogue partners.<br />
An active member of the <strong>Philippine</strong> delegation, the <strong>Commission</strong> participated in<br />
the various negotiation sessions, attended inter-agency meetings <strong>and</strong> provided<br />
comments <strong>and</strong> recommendations related to the ROOs of the various FTAs such as<br />
the ASEAN-Australia <strong>and</strong> New Zeal<strong>and</strong> FTA (AANZFTA), the ASEAN-Japan<br />
Comprehensive Economic Partnership (AJCEP) <strong>and</strong> the ASEAN-India FTA. It also<br />
attended several meetings of the ASEAN Task Force on ROO.

TRADE REMEDY MEASURES<br />
Republic Act (R.A.) 8800 (Safeguard Measure Act)<br />
The Act provides for general safeguard meas<strong>ures</strong> to relieve domestic industries<br />
suffering from serious injury or threat thereof as a result of increased importation.<br />
Monitoring of the Adjustment Plans of the Steel Angle Bar Industry<br />
Rule 16 (Monitoring of the Domestic Industry) of the Implementing Rules <strong>and</strong><br />
Regulations of R.A. 8800 provides:<br />
Rule16.1<br />
So long as any action taken under Rule 13 remains in effect, the<br />
<strong>Commission</strong> shall monitor developments with respect to the<br />
domestic industry, including the progress <strong>and</strong> specific efforts<br />
made by workers <strong>and</strong> firms in the domestic industry to make a<br />
positive adjustment to import <strong>competition</strong>.<br />

Rule 16.1.a If the initial application of action taken under Rule 13 exceeds<br />
three (3) years, the <strong>Commission</strong> shall submit to the Secretary a<br />
report on the results of the monitoring, not later than the date<br />
which is the midpoint of the initial period, <strong>and</strong> of each such<br />
extension, during which the action is in effect.<br />
Rule 16.1.b. The <strong>Commission</strong>, in the preparation of each monitoring report,<br />
shall conduct a hearing at which interested parties, including the<br />
Department of Labor <strong>and</strong> Employment (DOLE), shall be given<br />
reasonable opportunity to be present, to present evidence, <strong>and</strong> to<br />
be heard.<br />
The <strong>Commission</strong> submitted its monitoring report to the DTI Secretary on 24<br />
May 2011 finding that the domestic steel angle bar industry has complied substantially<br />
with its commitments as stated in its adjustment plan.<br />
Petition for Extension of Safeguard Measure Against Steel Angle Bars Imports<br />
The <strong>Commission</strong>, on 04 November 2011, submitted its Formal Investigation<br />
Report to the DTI recommending the extension of the imposition of safeguard<br />
measure for another three (3) years in the amount of P4,300/MT for the first year of<br />
implementation.<br />
IV.<br />
SECTION 1313-a - TARIFF COMMODITY CLASSIFICATION<br />
The ASEAN Harmonized <strong>Tariff</strong> Nomenclature (AHTN) <strong>Tariff</strong> <strong>and</strong> Customs<br />
Code of the <strong>Philippine</strong>s (TCCP) classifies articles imported into the <strong>Philippine</strong>s.<br />
However, when the proper tariff classification of a commodity being imported or<br />
intended to be imported cannot be ascertained, the interested party may file with the<br />
<strong>Tariff</strong> <strong>Commission</strong> a request for a commodity classification ruling pursuant to Section<br />
1313-a of the Code.<br />
The applicant is required to submit in triplicate a notarized <strong>and</strong> duly<br />
accomplished TC Form 1 (Request for <strong>Tariff</strong> Classification Ruling). Likewise, he is<br />
required to submit a sample or samples of the product (if available), technical<br />
broch<strong>ures</strong>/catalogues indicating its specifications, its material or chemical composition<br />
<strong>and</strong> other relevant information.

The <strong>Commission</strong> is invited as a resource body to the Bureau of Customs<br />
Valuation <strong>and</strong> Classification Review Committee (VCRC) which meets as often as<br />
necessary to resolve issues involving valuation <strong>and</strong> tariff classification.<br />
During the period covered, the <strong>Commission</strong> received two hundred ninety (290)<br />
requests for tariff classification, <strong>and</strong> issued two hundred sixty-seven (267)<br />
classification rulings.<br />
ASEAN Harmonized <strong>Tariff</strong> Nomenclature (AHTN) <strong>and</strong> the World Customs<br />
Organization (WCO) Harmonized System (HS) Nomenclature<br />
The Harmonized Commodity Description <strong>and</strong> Coding System (also known as<br />
the HS) is a multi-purpose international product nomenclature used by more than 200<br />
countries as a basis for uniform classification <strong>and</strong> coding of merch<strong>and</strong>ise for purposes<br />
of customs tariff collection <strong>and</strong> for gathering international trade statistics. After the<br />
implementation of the HS in 1988, major reviews were undertaken which resulted in<br />
the 1996, 2002 <strong>and</strong> 2007 versions. The major revision entered into force on 01<br />
January 2007. The <strong>Philippine</strong>s implemented these amendments in January 2008 in<br />
accordance with the Resolution of the NEDA Board in its meeting on 18 September<br />
2007. The latest revision will enter into force on 01January 2012.<br />
The ASEAN Member States adopted the Protocol Governing the<br />
Implementation of the ASEAN Harmonized <strong>Tariff</strong> Nomenclature (the AHTN Protocol)<br />
to harmonize the tariff nomenclature based on the HS among member countries. The<br />
AHTN adopted the HS up to the six-digit commodity classification codes <strong>and</strong> used the<br />
eight-digit commodity classification code for the ASEAN requirements. To reflect its<br />
required national tariff lines not included in the ASEAN nomenclature, the <strong>Philippine</strong>s<br />
added an alpha numeric code after the 8-digit code.<br />
In view of the amendments made by WCO to the HS which will enter into force<br />
on 01 January 2012, an AHTN Task Force was created by ASEAN to review the<br />
AHTN 2007/1.<br />
The <strong>Commission</strong>, as the lead agency for the <strong>Philippine</strong>s, attended the 6 th , 7 th<br />
<strong>and</strong> 8 th Meetings of the AHTN Task Force held in Brunei, Manila <strong>and</strong> Myanmar,<br />
respectively. The completed work of the Task Force was endorsed by the ASEAN<br />
Customs Director General.

as implemented in Customs Administrative<br />

of a new Sec. 2503-A exempting the<br />
importer from surcharge when the tariff<br />
classification relied on an official government<br />

The <strong>Philippine</strong>s has already eliminated<br />
tariffs of about 99% of the total tariff lines<br />
in compliance with the agreement under<br />
the Common Effective Preferential <strong>Tariff</strong><br />
(CEPT) Scheme of the ASEAN Free Trade<br />
Area (CEPT-AFTA), now ASEAN Trade in<br />
Goods Agreement (ATIGA).<br />
Sensitive agricultural products are imposed<br />
a preferential rate of 5% except rice<br />
<strong>and</strong> sugar which are currently levied at<br />
40% <strong>and</strong> 38%, respectively <strong>and</strong> will eventually<br />
be reduced to 35% <strong>and</strong> 5% by 2015.<br />
