I. SECTION 401 – MODIFICATION OF DUTY (FLEXIBLE CLAUSE)
Section 401 of the Tariff and Customs Code of the Philippines (TCCP)
empowers the Commission to conduct public hearings on individual requests and
motu proprio petitions for tariff modification.
Under this provision, the petitioner is required to accomplish Tariff Commission
Form No. 3 (Information for Tariff Adjustment) which is available at the Commission.
Aside from the Commission’s invitations to interested parties, notices of public
hearings are published in two (2) newspapers of general circulation. During the
hearing, concerned parties are given the opportunity to make oral presentations and
to present evidence in support of their positions. The Commission’s investigative
process also involves plant visits which include, among others, the ocular inspection
of plant facilities, production process and the verification of the accuracy and
authenticity of some or all the data and information submitted in support of the
positions of the parties.
The Commission’s report of findings and recommendations are submitted to
the National Economic and Development Authority (NEDA) within thirty (30) days after
the termination of the public hearing. This is deliberated upon by the Tariff and
Related Matters (TRM) Technical and Cabinet Committees. Upon final approval by
the NEDA Board, the Commission prepares the necessary implementing Executive
Order (EO) for signature of the President.
Directors Zenaida C. Lacar (right) and
Artemio D. Bernardino (left) with the
Commission’s technical staff during the
Section 401 public hearing regarding
implementation of the 2012 version of the
ASEAN Harmonized Tariff Nomenclature
(AHTN) to form part of Section 104 of the
Tariff and Customs Code (6 December
2011).

Report submitted to NEDA.
The 2010 Comprehensive Tariff Review (CTR 2010) was the most recent tariff
review conducted by the Commission to set in place the new MFN tariff structure from
2011-2015 on all products under Chapters 1-97 of the Tariff and Customs Code of the
Philippines (TCCP). The said review was undertaken to provide predictability and
transparency to businesses and create opportunities for growth and greater
employment.
The Commission chaired the TRM-Technical Working Group (TWG) review of
the latest 5-year tariff schedule, together with the Board of Investment and the
Department of Agriculture (Vice-Chairs); NEDA (TWG Secretariat); Bureau of
Page 8
B. During the year, the Commission drafted three (3) Executive Orders signed by the
President:
EO No. 21 (signed 14 January 2011)

Reducing the rate of import duty on milling (food) wheat to zero under
Section 104 of Presidential Decree No. 1464, otherwise known as the
Tariff and Customs Code of 1978, as amended, as provided for under
Section 3 of Executive Order No. 863, Series of 2010.
EO No. 22 (signed 14 January 2011)

Reducing the rates of import duty on cement and cement clinker to zero
under Section 104 of Presidential Decree No. 1464, otherwise known as
the Tariff and Customs Code of 1978, as amended, as provided for under
Section 3 of Executive Order No. 862, Series of 2010.
EO No. 61 (signed 17 October 2011)

Modifying the nomenclature and the rates of import duty on various
products under Section 104 of the Tariff and Customs Code of 1978
(Presidential Decree No. 1464), as amended.
Notably, EO 21 and EO 22 which implemented the zero rate of duty on food
(milling) wheat and cement and cement clinker were the only EOs issued in 2011
relative to MFN rates prior to the issuance of EO 61 (published on 15 December 2011
in Malaya). As stated in Section 5 of EO 61, this “shall take effect thirty (30) days
following its complete publication in a newspaper of general circulation.”
EO 61 which prescribed the latest 5-year tariff structure did not become
effective as scheduled. The 2010 Most-Favored-Nation (MFN) rates remained
applicable for calendar year 2011.

6% - MFN rates at 20% and above 5% - MFN rates at 20% and above
The tariff structure for pre-CTR 2010 and EO 61 ranged from 0% to 65%.
While the 2010 MFN rates of duty remained applicable in 2011, the issuance of
EO 61 resulted to slight changes in the percentage distribution of MFN rates of duty
between pre-CTR 2010 and CTR 2010, as follows:

EO 61 MFN rates at 0% to 5% levels increased by 1% from 60% to 61% as
a result of reduction in the rates of duty on certain motor vehicle parts and
components with higher tariff rates;
At 7% to 15% levels, percentage distribution remained stable at 34%
despite tariff changes within the same tariff band; and

EO 61 MFN rates at 20% and above range decreased by 1% from 6% to
5% as a result of the merging of tariff lines at lower rates of duty on certain
motor vehicle parts and components, and the reduction of rates of duty on
other residual products of the chemical and allied industries, among others.
Parties in attendance during the Section 401 public hearing regarding implementation of the 2012 version of
the ASEAN Harmonized Tariff Nomenclature (AHTN) to form part of Section 104 of the Tariff and Customs
Code (6 December 2011).

2014 to 2015 11.98 2.29 5.75 6.70
The overall average applied MFN tariff in 2011-2013 declined by about 4.42%
from the 2010 level. This resulted from the reduction/elimination of rates of duty
under EO 61 on certain not locally produced manufacturing inputs and on certain tariff
lines merged/unified which include transdermal therapeutic system patches for the
treatment of cancer or heart diseases; antisera/other blood fractions and modified
immunological products; polymers; refined petroleum products; packaging products,
waste from chemical or allied industries; new pneumatic tyres; and parts and
accessories of pumps/compressors.
The phased-down reduction in the MFN rates of duty under EO 61 on
seventeen (17) tariff lines (i.e., glass/iron and steel waste and scrap products) in 2014
-2015 registered a negligible cut in the average applied MFN tariff from 2011-2013
level.
SECTION 402 – PROMOTION OF FOREIGN TRADE
In order to expand the foreign market for Philippine products, the Commission
is mandated to conduct public consultations with interested parties before the
Philippines (1) enters into any trade agreement with any foreign government or
instrumentality thereof; and (2) modifies import duties (including any necessary
change in classification) and other import restrictions, as are required or appropriate
to carry out and promote foreign trade.

Annual Report 2011
Page 12
Interested parties may petition the Commission for tariff modification under
Section 402 while submitting the required duly accomplished Tariff Commission Form
Concerned parties are invited to these consultations of which schedules and
product coverage are published in two (2) leading newspapers of general circulation.
As in Section 401 hearings, the Commission affords each interested party
reasonable opportunity to express his views during the public consultation. In order to
verify the positions/evidences presented, plant visits are likewise conducted by the
Commission. Findings and recommendations are submitted to NEDA which then
schedules these for deliberation by the TRM Technical and Cabinet Committees.
Final approval is granted by the NEDA Board after which the Commission prepares
the draft implementing EO.
purposes of granting tariff concessions or preferential treatment.
The Commission was occupied in the area of ROO during the year. It actively
participated in the drafting of the country’s positions, proposals and counter-proposals
regarding issues in the ASEAN-CEPT conversion to the product-specific rules based
on tariff shift, adoption of self-certification and ROO agreements with different
dialogue partners.
An active member of the Philippine delegation, the Commission participated in
the various negotiation sessions, attended inter-agency meetings and provided
comments and recommendations related to the ROOs of the various FTAs such as
SECTION 1313-a - TARIFF COMMODITY CLASSIFICATION
The ASEAN Harmonized Tariff Nomenclature (AHTN) Tariff and Customs
Code of the Philippines (TCCP) classifies articles imported into the Philippines.
However, when the proper tariff classification of a commodity being imported or
intended to be imported cannot be ascertained, the interested party may file with the
Tariff Commission a request for a commodity classification ruling pursuant to Section
1313-a of the Code.
The applicant is required to submit in triplicate a notarized and duly
accomplished TC Form 1 (Request for Tariff Classification Ruling). Likewise, he is
required to submit a sample or samples of the product (if available), technical
brochures/catalogues indicating its specifications, its material or chemical composition
and other relevant information.

Page 23
Annual Report 2011
The Commission is invited as a resource body to the Bureau of Customs
Valuation and Classification Review Committee (VCRC) which meets as often as
necessary to resolve issues involving valuation and tariff classification.
During the period covered, the Commission received two hundred ninety (290)
requests for tariff classification, and issued two hundred sixty-seven (267)
classification rulings.
ASEAN Harmonized Tariff Nomenclature (AHTN) and the World Customs
Organization (WCO) Harmonized System (HS) Nomenclature
The Harmonized Commodity Description and Coding System (also known as
the HS) is a multi-purpose international product nomenclature used by more than 200
countries as a basis for uniform classification and coding of merchandise for purposes
of customs tariff collection and for gathering international trade statistics. After the
implementation of the HS in 1988, major reviews were undertaken which resulted in
the 1996, 2002 and 2007 versions. The major revision entered into force on 01
January 2007. The Philippines implemented these amendments in January 2008 in
accordance with the Resolution of the NEDA Board in its meeting on 18 September
2007. The latest revision will enter into force on 01January 2012.
The ASEAN Member States adopted the Protocol Governing the
Implementation of the ASEAN Harmonized Tariff Nomenclature (the AHTN Protocol)
to harmonize the tariff nomenclature based on the HS among member countries. The
AHTN adopted the HS up to the six-digit commodity classification codes and used the
eight-digit commodity classification code for the ASEAN requirements. To reflect its
required national tariff lines not included in the ASEAN nomenclature, the Philippines
added an alpha numeric code after the 8-digit code.
In view of the amendments made by WCO to the HS which will enter into force
on 01 January 2012, an AHTN Task Force was created by ASEAN to review the
AHTN 2007/1.
The Commission, as the lead agency for the Philippines, attended the 6 th , 7 th
and 8 th Meetings of the AHTN Task Force held in Brunei, Manila and Myanmar,
respectively. The completed work of the Task Force was endorsed by the ASEAN
Customs Director General.

introduced by Senator Manuel
“Lito” Lapid.
The Commission supports the various bills
creating a separate office for the Philippine
Trade Representative, inasmuch as the
same is needed by the country in order for
us to have a permanent chief trade negotiator
who will coordinate all trade-related policies
of the Philippines as well as take care
of our own country’s economic agenda in
various international trade undertakings.
The consolidated bill should provide for
thorough and meaningful consultations as
provided under Section 402 of the Tariff and
Customs Code of the Philippine s, as
amended, with all relevant and key stakeholders,
prior to the conduct of any multilateral,
regional and bilateral trade negotiations
in order to craft negotiating strategies
and country positions, and consultation
again thereafter, as a form of a feedback
mechanism/post evaluation for the government
to gauge the effectiveness of its negotiating
strategies.

The Commission supports the establishment
of a central government agency that
would take charge, prioritize, strengthen
and promote the Philippine Design Industry.
It believes in the innate genius of the
Filipino in terms of producing world class
designs which the Philippines in turn could
strongly support as one of its new “export
winners,” as well as in the potentials of the
Philippine design as an industry. It is
about time that a law be enacted specific
to that purpose.
The Commission supports the avowed
aims and guiding principles of the two (2)
Senate Bills. SB 2142 reflects the common
desire of the Senate to rationalize,
simplify and prioritize fiscal and non-fiscal
incentives to deserving industries. SB
2379 aims to make our investments code
more up-to-date and responsive to the
Philippines’ goal to attract more foreign
investments needed for our economic
growth.
The Commission supports the various bills
creating a separate office for the Philippine
Trade Representative, inasmuch as the
same is needed by the country in order for
us to have a permanent chief trade negotiator
who will coordinate all trade-related
policies of the Philippines as well as take
care of our own country’s economic
agenda in various international trade undertakings.

House Bill No. 3760 (“Customs and Tariff
Representatives Rufus Rodriguez and
Reynaldo Umali.
The Commission supports the common
desire of the House of Representatives to
rationalize, simplify, prioritize and
strengthen the powers and functions of the
existing Philippine Coconut Authority and
by so doing, revitalize the Philippine coconut
industry in general which has been
long considered as one of the Philippines’
identified “export winners,” and help our
coconut farmers, in particular.
Observations/Comments:
1. Sequencing of Provisions
The provisions on tariffs should precede
the provisions on customs implementation.
This would be a logical sequencing in the
sense that it follows the normal procedure
of setting the policy on tariffs first, followed
by implementation of said tariff policy.
2. Under Section 408 (b) of the CTMA, the
following provision be adopted:
b. Motion for Reconsideration – Any applicant
party who is aggrieved by, or is not
satisfied with the result of any ruling the
applicant party may have filed before the
Tariff Commission pursuant to this Section,
may file a verified Motion for Reconsideration
within thirty (30) days from receipt
of such ruling based on the sole

3. Section 1711. Tariff Nomenclature and
Rates of Import Duty
“The provisions of Section 104 of P.D.
1464, otherwise known as the Tariff
and Customs Code of 1978, as
amended, specifically providing for the
4. The Commission proposes that Section
1712 of the CTMA be worded, thus:
“Section 1712. TARIFF NOMENCLA-
TURE AND THE RATES OF EXPORT
DUTY.
that this new Section defines the
coverage of “agricultural products.”

2. Sec. 1313. Information furnished on
Classification and Value
The Commission is opposed to the inclusion
in some bills of the proposal made
requiring the Commission “ to notify the
concerned/ affected industry” in cases of
request for issuance of tariff classification
rulings.
The office believes that it is highly inappropriate
since tariff classification pursuant to
this Section is a governmental function not
subject to private or vested interest intrusion.
Confidential documents, samples
and data submitted by an importer to the
Commission pursuant to a valid request
for issuance of tariff classification ruling
are meant to be safeguarded by the Commission.
At any rate, enough safeguards
and provisions for transparency are in
place such as automatically providing
copies of issued tariff classification rulings
to the Bureau of Customs and Department
of Finance. Of the differing provisions to
amend Section 1313a, the Commission
favors the HB 3055 version.

3. Sec. 2503. Undervaluation, Misclassification
and Misdeclaration in Entry
On the issue of misclassification in import
entry, the Commission recommends that
the definition of “misclassification” be
based on Section 2503 of the Tariff and
Customs Code of the Philippines (TCCP),
as implemented in Customs Administrative
Order (CAO) 10-93, dated November 16,
1993.
Further, the Commission supports the addition
of a new Sec. 2503-A exempting the
importer from surcharge when the tariff
classification relied on an official government
ruling or information.
The Philippines has already eliminated
tariffs of about 99% of the total tariff lines
in compliance with the agreement under
the Common Effective Preferential Tariff
(CEPT) Scheme of the ASEAN Free Trade
Area (CEPT-AFTA), now ASEAN Trade in
Goods Agreement (ATIGA).
Sensitive agricultural products are imposed
a preferential rate of 5% except rice
and sugar which are currently levied at
40% and 38%, respectively and will eventually
be reduced to 35% and 5% by 2015.
Executive Orders 892 and 894 were issued
to implement the tariff reduction
schedule on sugar and rice products
through the invocation of the Protocol to
Provide Special Consideration for Rice
and Sugar under the ATIGA.

Comments/Recommendation/
Inputs of the Commission
The Commission, under its express mandate
as a means of promoting foreign
trade under Section 402 of the Tariff and
Customs Code of the Philippines, as
amended, and before any trade agreement
is concluded by the Philippines with
any foreign government or instrumentality
thereof, conducts wide ranging public consultations
that involved various stakeholders
in the domestic industry wherein
they are given the chance to adequately
ventilate their views and comments.
The Commission believes that with the
launch, establishment and adoption by the
Philippines, led by the Department of
Trade and Industry, of the “ONE COUN-
TRY, ONE VOICE: INSTITUTIONALIZING
STAKEHOLDER PARTICIPATION TO-
WARDS A UNIFIED TRADE STRATEGY,”
consultations with various stakeholders
will be further enhanced. The One Country,
One Voice Program is a unified strategy
approach wherein the whole foundation
beneath trade policy is made up of a
host of domestic policies, with particular
focus on local industry and small and medium
enterprises competitiveness. It is of
note that the program will call for a far
ranging actions on domestic industry consultations,
with emphasis on transparency
and stakeholders’ feedbacks, thus, addressing
and correcting any perceived non
-transparency and lack of stakeholders’
participation in the trade policy formulation
process.
