PUBLIC ACCESS TO RECORDS<br />

Act 100 of 2002, <strong>the</strong> Open Records Law, provides that all <strong>municipal</strong>ities must meet<br />

certain time limits when responding to requests for access to records. To safeguard <strong>the</strong><br />

<strong>municipal</strong> <strong>secretary</strong> from violating <strong>the</strong> provisions of Act 100, an Open Records Policy should be<br />

adopted by <strong>the</strong> governing body, establishing a procedure for citizen requests, as well as an appeal<br />

process in cases where information is denied.<br />

A sample Open Records Policy and Records Request Form are provided on <strong>the</strong> following<br />

pages. Additional information on Act 100 can be obtained from Municipal Associations, <strong>the</strong><br />

Local Government Commission, <strong>the</strong> Governor’s Center for Local Government Services, or <strong>the</strong><br />

<strong>municipal</strong>ity’s Solicitor.<br />
