Drug-Free Workplace Policy<br />

Definitions<br />

Employees covered. (Select one of <strong>the</strong> following).<br />

All officials and employees.<br />

All officials and employees in public safety and those responsible for operating<br />

automotive equipment on public roads.<br />

All officials and employees in public safety and those responsible for operating any<br />

equipment which may result in major accidents impacting on lives and bodily harm.<br />

All employees and officials working in programs under specified federal funding criteria,<br />

are subject to <strong>the</strong>ir additional requirements.<br />

Medical review officer. This is a licensed physician, knowledgeable in <strong>the</strong> substance<br />

abuse field, who interprets and evaluates confirmed positive in relation <strong>the</strong> employee's history.<br />

Illegal drug. This is a controlled substance, a drug that cannot be obtained legally, has been<br />

obtained illegally, or is used o<strong>the</strong>r than as prescribed. Although a controlled substance has a<br />

broader definition, this policy applies specifically to <strong>the</strong> following.<br />

● amphetamines ● cocaine<br />

● marijuana ● opiates<br />

● phencyclidine<br />

Medical review officer. This is a licensed physician, knowledgeable in <strong>the</strong> substance<br />

abuse field, who interprets and evaluates confirmed positive in relation <strong>the</strong> employee's history.<br />

Negligent hiring. The legal principle referring to an employer’s failure to take all<br />

necessary steps to properly evaluate applicants for positions. This concept becomes<br />

operational if, following employment, an employee who has prior adverse history takes related<br />

action while working resulting in a loss to ano<strong>the</strong>r individual.<br />

Positive result. The evaluation of a drug test which shows that <strong>the</strong> testee used an illegal<br />

drug. ________________________ will always conduct a second test to verify or overturn <strong>the</strong><br />

positive result before taking any fur<strong>the</strong>r action.<br />

Prescription drug. A drug prescribed by a physician and taken consistent with that<br />

prescription.<br />

Safety sensitive jobs. Jobs which enforce drug laws, which require carrying firearms and<br />

which operate automotive and o<strong>the</strong>r equipment which can cause serious bodily harm.<br />

safety sensitive jobs are listed in <strong>the</strong> Appendix.<br />

Substance abuse. An applicant's or employee's use of an illegal drug.<br />

Testing. Any legal, medically sound procedure to detect <strong>the</strong> existence of an illegal drug in an<br />

applicant or employee.<br />

Under <strong>the</strong> influence. The existence of an illegal drug at a level of at least 0.1 % in <strong>the</strong> body<br />

weight of an applicant or employee.<br />
