2.1 Name of the work – Painting of fencing & fitment of door interlock of SP & SSP in Danapur
division. Tender should be submitted in sealed cover addressed to Sr. Divl. Elect. Engineer
(TRD) / E.C Rly. / Danapur. Subscribed with Painting of fencing & fitment of door
interlock of SP & SSP in Danapur division.
And delivered in the sealed tender box location in the office of Sr.Divl. Elect. Engineer
(TR-D) / E.C Rly, Danapur from dtd- 19.12.2005 to 02.01.2006 (except Saturday, Sunday &
Holiday) between 12:00 hrs. to 15:00 hrs. & on 03.01.2006 between 10:00 hrs. to 12:00 hrs.
and shall be opened on 03.01.2006 by 13:00 hrs.
2.2 Any information relating to the tender or clarification connection herewith may be obtained
from the office of the Sr. Divl. Elect. Engineer (TR-D) / E.C Rly., Danapur any working
day during office hrs.
2.3 If any tenderer desires prior to inspect the site as covered by the tender. He
may do so at his own cont by arrangement with the Sr. Divl. Elect. Engineer
(TR- D)/E.C Rly, Danapur.
2.4 The stations locations of work to be executed covered by the tender has been shown in
the appendix C which also shown the different items of the work with quantity being
mentioned against each.
2.5 Final acceptance of the tender shall rest with Sr. Divl. Elect. Engineer (TRD) /E.C. Rly.
/Danapur who reserves the right to accept or reject the tender or part there of without
assigning any reason there of and does not bend himself to accept the lowest offer.
GENERAL CONDITIONS
3.1 The tender papers are not transferable.
3.2 No tender will be considered unless accompanied by
(a) Documents on proof of deposit of the sum of specified in Para 4. As earnest money.
(b) Income tax clearance certificate in original or a only shown affidavit counter signed by the
income Tax officers concerned that the tenderer has not been accessed in any income tax, he
being a new one.
© Full particulars of contractor ‘s license and the class if license by him as also the name and
class of license held by his supervisor.
(d)Appendix ‘D’ the schedule of work showing there in the rates against each item as provided
there in duly signed.
4.1 Mode of depositing earnest Money.
Earnest money shall be deposited in cash or in any of the following forms.
(a)In cash on which no interest will occur to be deposited with the Divl. Cashier E.C. Rly,
Danapur or Chief Cashier, E.C Rly. HJP.
(b) Deposit receipt, pay orders, demand drafts in f/o FA & CAO/E.C.Rly.,HJP
(c) No cheque will be accepted even if it is guaranteed by the Bank.
4.2 No interest will be occurred on the earnest money. The earnest money will be refunded to be
one successful tendered on application. In the case of the successful tenderer the earnest the
even of the failure on the part of the tender to observe and comply with the foregoing stipulations.
money will be adjusted towards security deposit at the discretion of the contractor or will be
returned on payment of the security deposit for fulfillment of the contract.

4.3 Request for transfer of earnest money and or security deposit of any work even if the same is free
on all obligation will no be accepted for the purpose of earnest money. The tender will be similarly
rejected unless requisite earnest money is paid full.
5.Amount of earnest money to be deposited.
The earnest money that the tender is required to deposit along with is tender amounts to Rs. 2920/-.
Only as security deposit for due deference of the stipulation in keep the offer open for a period of
90 days for the date of opening of the tender it being understand that the tender documents have
been sold to the tenders and the tender being permitted of tender in consideration of the stipulation
of his part that after subletting the tender the there of in a manner not acceptable to the Sr. Divl.
Elect. Engineer(TRD)/EC.Rly., Danapur and is liable to be forfeited be the Rly. in the even of the
failure on the part of the tender to observe and comply with the fore going stipulations.
6.1Security Deposit.
On receipt of the acceptance of the tender from the Railway the successful tenderer will be required
to furnish the Rly. security deposit to the extant of 10 (Ten) deposited as money to be deposited by
the successful tendered within 7 (seven) days from the date of issue of the acceptance letter failing
which the earnest money will be forfeited by the Rly. Admen.
( C) The balance amount of the security deposit will be recovered from the successful contract in
equal installments from the account bills.
6.2 The Security amount should be deposited in any of the following manner :
(a) In cash on which no interest will be paid.
(b)Govt. securities at 5% below the market value.
6.3The total security deposit will be retained by the Rly. Admn. For a period of one year from
the date of completion of work without any interest being accrued there on.
6.4The Rly. Admn. Shall be entitled to deduct from the security deposit the requisite amount for
any loss or damaged from the contractor, which the Rly. Admn. May be put to for any reason of
any act for default recoverable by the Railway from the contractor or call upon the contractor to
maintain deposit at its original limit by manning further deposit, In the event of contractor failing
to make maintain a security deposit in the manner afore said and money lodged with the tender
by him will be liable to be forfeited and then Railway shall be entitled to cancel the acceptance of
the tender . No cheque will be accepted for security deposit even if it is guaranteed by the Bank.
7. Terms of payment of Bill.
(a)20% of total contractual value on completion of more than 24% of total contracted work
in Ist. on A/C bill (b)Further 40% of contractual value on completion of more than 48% of
contracted work in IInd. on A/C bill (c) 70% of contractual value on completion of more than
84% of contracted work in IIIrd. on A/C bill (d) Balance payment will be made on completion
of 100% contracted work in final A/C bill on successful completion at the work.
Execution of Agreement :-
8.1 The successful tenderer shall have to start the work within 7 days .
8.2 The successful tenderer shall have to sign on agreement for work tendered by the
Administration within 14 days from the date of issue the acceptance letter failing which his
E/money will be forfeited.
Commencement of the work :
9.1The success tenderer shall have to start the work within 7 days from the date of execution
of the agreement.
Completion time :

10.1 The work shall have to be completed within 30 days from the date of execution of the
agreement failing which the Rly. Admn. will be entitled to recover from the contractor the
penalty according to the terms laid down in para 12.1 of this tender.
Extension of time
11.1 In the event of failure on the part of the contractor to completes the work within the Time
as specified in Para 10.1 above on any group as accepted by the Rly, admn. As
reasonable and on approach by the contractor in such circumstances for extension of
time. Rly. Administration mat. Aloe additional time to the extension as would be
considered reasonable by the Rly. Admn. Such consideration being in the absolute
discretion of the Rly. Administration and for which the contract shall not be entitled to
any compensation what so ever.
12.1 Penalty for delay incompletion .
If the contractor fails in the due performance of the contract within the time fixed
by the contract and any authorized extension there of the Rly, Admn. Is entitled to
recover from the contractor a sum of half percent of the price of that portion of the
contract non completed by the date, for each and every week or part of a week taken
extra by the contractor to complete the work provided the Rly. Admn. Has suffered loss
due to the aforesaid failure on the part of the contractor. The amount of damages
recovered shall in no case exceed 10% of the value of the contract. Alternatively at the
opinion of the Sr. Divl. Elect. Engineer (TRD) E.C. Rly., Danapur the pled by the Rly.
Admn. Itself and any loss or damaged which the Rly. Administration may insure by
reason of such failure on the part of the contractor shall be made good by him or on the
like extension of contractor.
Acceptance of tender and the condition in connection therewith :-
13.1 The tenderer shall hold the offer open till such date as specified in the tender. It
isunderstood that the tender documents have been said to the tenderers and the tenderer in
/ are being remitted to tender in consideration of the stipulation on his/their part that after
submitting his/their tender, he /they will not resale from his/their offer or modify the
terms and conditions there of in a manner not acceptable to the Sr. Divl. Electrical
Engineer (TRD) E. Rly, DANAPUR should the tenderer fail to observe or comply with
the foregoing stipulation, the amount deposited as security for the due performance of the
above stipulation shall be forfeited to the Railway, If the tender is accepted the amount of
earnest money will be held as security deposit for the due and faithful fulfillment of the
contractor. The earnest money will be refunded to successful tenderer but the Rly. Shall
not be responsible for any loss or the stipulation to keep the offer, open for the period
specified in the tender documents or to the earnest money while in the possession not be
payable to pay interest there of.
13.2 It shall not be obligatory on said authority to accept the lowest tender and no tender
tenderers shall demand any explanation for the cause or rejection of his/their tender.
13.3 If the tender is deliberately give any information his /their tender or creates
circumstances for the acceptance of his /their tender. Railway reserve the rights to
reject such tender at any stage.
13.4 If a tenderer expires after the submission of the tender or after the acceptance of his
tender ,the Rly shall deem such tender as cancelled . If a partner or a firm expirees
after the submission of their tender or after the acceptance of the tender the Rly shall
deem such tender as cancelled.

13.5. The earnest money including the amount taken as security deposit for the due
performance of the stipulation to keep the offer open till the date specified in the
tender will be refunded to the unsuccessful tenderer within a reasonable time. The
earnest money deposited by the successful tenderer will be retained towards the
security deposit for the due and faith full fulfillment of the contract but shall be
forfeited if the contractor fails to execute the agreement bond within 14 days of
notification of the acceptance of his/their or commence the work within 7 days
after receipt or orders to that effect.
13.6. Non-compliance with any of the stipulations and consideration herein above is
liable to result of the tender being rejected.
13.7 The authority for the acceptance as the tender will rest with the Sr. Divl. Elect.
Engineer(TRD)., E.C. Rly., Danapur who does not bind himself to accept the
lowest or any other tender does not be under take to assign reasons for declining
to consider any particular tenders.
13.8 The tenderer shall keep the offer open for a minimum period of 90 days from the
date of opening of the tender, within which period the tenderer can not with draw
his offer subject to the period being expanded further if regaled by mutual
agreement from time to time. Any contravention of the above condition will make
the tender lien for forfeitures of the security deposit.
2.1.1 Should a tenderer or contractor on the list of approved contractors have a relative/s
or in the case of a firm or company or contractors on or notes of its share holders or
a relative/s of the share holders supplied in gazette capacity in the Elect. Engineer
Dep’t. of the. Rly. Danapur the authority inviting. tender shall be informs of the fact
at the time of submission of tender, failing which the tender may be disqualified or
if such accordance with the provision in clause 6 of the general condition of
contract.
2.1.2 Should tenderer be a retired Engineer of the Gazetted, rank or any other Gazetted
officer working before retirement. Whether in the executive are administrative
capacity of whether holding a responsible por or not in the elect. Deptt. of any of the
Rly. Owned and Administrated by the president of India for the time being or should
a tenderer being partners firm have as one of its partners a retired Engineer or a
retired Gazetted officer as aforesaid or should a tenderer being as in corporate
company have any such retired Engineer or retired officer as one of its Directors or
retired Gazetted officer as aforesaid the full information as to the date of refinement
of which Engineer of Gazetted officer from the said service and in cases where
Engineer of office had not retired from govt. Service at least two years prior to the
date sublimation of the tender as to whether permission for taken such contract or if
the contractor be partner or director, the case may be or to make employment under
the contractor has been ob taken by the tenderer or the Engineer of the contractor the
case may be from the president of India or any officer authorized by in this behalf,
shall be clearly stated in writing at the time of submission of tender. The under effect
that no such retired Engineer or retired Gazetted officer is so associated with the
tenderer as the case may be shall be rejected.
13.11 All materials for this work are to be supplied by the contract for all the items other
than those specific.

13.12 The final acceptance of the tenderers shall rest with the Sr. Divl. Elect. Engineer
(TR-D) , E.C. Rly., Danapur or his representative who reserved the fight to accept or
reject any tender of part there of without assigning any reason there of and does not bind
himself to accept the lowest tender only.
14.1 Arbitration :
(a) Matters in question of dispute or difference to be arbitration upon shall be referred
for decision to
(i) A sole Arbitrator who shall be the Chief Elect. Engineer / E.C.Rly.,HJP or a person
nominated by him in that behalf in cases where the claim in question is below Rs.
50000/- and in cases where the issued involved are not of a complained nature .The Chief
Elect. Engineer shall be the self judge to decide whether or not the issued involved are of
a complicated nature.
(ii) The arbitrators, who shall be Gazetted Rly. Officers of equal status to be appointed in
the manner laid down in subpara-
(b) Below for all claims of Rs. 50000/- and above, and for the issues involved are of a
complicated nature. The Chief Elect. Engineer shall be the sold judge to decide whether
the issue are of a complicated nature of not. In the event of the two arbitrators being
divided in their opinions the matter under dispute will be referred to on spire to be
applied in the matter laid down in sub Para (b) for his decision.
(a) For the purpose of F-pointing two arbitrators as referred to in sub-para (a), (ii)
above, the Sly. Will send a panel of more than three named of officers of the appropriate
status of one or more departments of the Rly. To the contractors who will beaked to
suggest a panel of three names out of the list so sent by the Rly. The Chief Elect.
Engineer will appoint on Arbitrators out of this panel of the contractors and then appoint
second arbitrator of equal status as the Rly’s nominee either from the panel or from
outsider the panel ensuring that the one of the two arbitrators shall nominate an umpire to
whom case will be referred in the event of any difference between the two arbitrators.
(b) The arbitrator or arbitrators of the impure shall have power to call for such
evidence by ray of office wits or otherwise as the arbitrator or arbitrators or empire shall
think proper, and it shall be the duty of the parties here to do cause to be done all such
theses may be necessary to enable the arbitrators or umpire to make the award without
any delay.
(a) It will be no objection that the person appointed as arbitrator/arbitrators, Umpire
are Govt. servant they have expressed view on all or any of the matters in dispute.
15.1. Railway Passes.
No Railway passes or concession tickets for men and materials of the contractor will be
granted by the Rly. Administration.
16.1. Samples.
The articles to be supplied in execution of the work shall be strictly in accordance with
specification/Drawing which shall be submitted by the successful tenderer along with his
tender and approved by the Sr. Div. Elect. Engineer (TRD)/ Danapur failure in
submission of samples or any item there of along with tender will disqualify the tender
consideration.
17.1. Price
The tenderer shall quote the price in the appendix ‘D’ enclosed herewith the rates being
expressed both in words and figures price against each item should be split to show the

delivery of all materials F.O.L. and the taxes and specified in the Para –4.4.
18.1. Inspection and Provisional acceptance.
The articles which are to be supplied and executed as per specification will be inspected
by the Sr.Divl. Elect. Engineer (TRD)/EC.Rly. Danapur or by his authorized
representatives at every stage of payment as prescribed in Para of the tender, The Rly.
Admn. Reserved the right for acceptance and rejection of the work, thus inspected
without assigning any reason.
19.1. Deviation from Tender :
Deviation from tender papers will not normally be agreed to should the tenderer be
unable for good and sufficient reason to comply entirely with the tender papers be shall
indicate the deviations desired by him such deviation if may shall be kept down to the
absolute minimum and the reasons for deviations, shall be indicated. The Rly. Admn.
Reserved the rights to cancel the tender if any deviation is not acceptable to it and if the
tenderer is un-willing to withdraw the deviation or modify the same in a manner
acceptable to the Rly. The tenderer in all such cases shall indicate clearly the special
condition or amendment desired by him to the relevant item of the tender papers.
Contractor :
20.1. The contractor shall arrangement his own cost all tools. Plants facilities necessary
for reconditioning and testing the equipments.
Default and delay :
21.1. The contractor shall executed the work with the due diligence and expeditious
keeping to approved time schedule, should be refuses or neglects to comply with any
reasonable orders given to him wiring by the Sr. DEE(TRD) E. Rly., Danapur or his
authorized representative in connection with the work lapse assignably behind the time
schedule representative in connection with the work lapse, persistently being the
schedule due to his negligence. The Rly. Administration shall be at liberty to give days
notice in wiring tender contract requiring his to make good the neglect or contravention
completed of and should the contractor fail to comply with the requisitions in the notice
within 7 days, Administration to take the work in art out of the contractors hand without
any further reference and get the work or any part there of the case may be, completed to
any other rights or to Railway Administration
Loss unstained as
22.1. In the vent of any loss to the Rly. Admn. On account of execution and or
completion of the work or any part thereof by the agencies over than the contractor in
terms of above clause the contractor shall be liable to impure the lost the Rly. admn. The
reimbursement in full or in part as the case may be shall be mains as the option of the
Rly. Administration of or any of the following soured:
(i) any amount due and payable to the contractor by the Rly. on any account what so
above.
(ii)The contractors security deposit in the hands of the admn. As per as available and 3 rd
any other assets, what so ever of the contractor.
23.1. The work is to be taken upon the places at the various stations as mentioned in
appendix ‘C’.

23.2 Programmed for taking up the work at various stations will be decided by the Sr.
Divl. Elect. Engineer (TRD) E.C. Rly., Danapur and communicated to the contractor
from time to time.
Special instructions for quotation of rate as in App. ‘c’
24.1. All prices shall be written in English and expressed both in figures and works
corrections, if any should clearly be attested. Rates arrested or over written will not be
accepted.
24.2. The rates to be quoted must be incisive of all taxes vex. Provisional Tax surcharge
and other taxes etc.
25.1 Variation of quantity:-
The tenderers should note that the approximate quantity indicated in the schedule of
works likely to vary by 25% on the same rate quoted by the tenderer and the next 15%
increase in value beyond 25% of the agreemental value , the rate will be reduced to 2%
incremental value and the next 10% increase in the value , the rate will be further reduced by
2% in further incremental value of the agreement.
Test Certificates.
Test certificates in the prescribed Performa should be jointly countersigned by the
contractor and the installation with the bills.
The sheets will be nearly Resin and books in 100 sheets to be prepared in triplicate on
will be retained by the installation in charge and 3 rd copy to be submitted to the Sr. Divl.
Elect. Engineer (TRD), E. Rly., Danapur.
Earth pipe puts will be serially timbered and the test results should be recorded in board
revised and % copies one to be retained by the contractor there fore the installation in
charge and 3 rd copy to the Sr. Dill. Elect. Engineer(TR-D). E.C Rly., Danapur.
Terms and conditions :
1. The executed work will be jointly checked by the Electrical supervisor and
representative of the contractor. The copy of the test report should accompany with the
bill.
2.After completion of the work firm is to undertake guarantee for one year from the date
of completion and guarantee certificate should accompany the bill.
3. 2% Income Tax will be deducted from the bill.
4. 12% S/C on I/Tax will be deducted.
5. 4% BST or VAT will be deducted on the total value of the work.
6.Security deposited should be kept till work is completed and inspection is done by Rly.
Authorities.
7.. Released materials should be returned the concerning supervisor and a copy of the
receipt challan should accompany the bill.
8. Indemnity Bond should be submitted during on account payment or in case of
repairing of any type of electrical equipment required to repair out side the premises of
Rly .
9. The copy of challan /receipt of manufactures/ Dealers should accompany with the bill
duly countersigned by the contractor and concerned installation in charge after
comparing with the original.
10 .Manufacturer test report should accompany with the bill where in it is applicable.

( C) The balance amount of the security deposit will be recovered from the successful contract in
equal installments from the account bills.
6.2 The Security amount should be deposited in any of the following manner :
(a) In cash on which no interest will be paid.
(b)Govt. securities at 5% below the market value.
6.3The total security deposit will be retained by the Rly. Admn. For a period of one year from
the date of completion of work without any interest being accrued there on.
6.4The Rly. Admn. Shall be entitled to deduct from the security deposit the requisite amount for
any loss or damaged from the contractor, which the Rly. Admn. May be put to for any reason of
any act for default recoverable by the Railway from the contractor or call upon the contractor to
maintain deposit at its original limit by manning further deposit, In the event of contractor failing
to make maintain a security deposit in the manner afore said and money lodged with the tender
by him will be liable to be forfeited and then Railway shall be entitled to cancel the acceptance of
the tender . No cheque will be accepted for security deposit even if it is guaranteed by the Bank.
7. Terms of payment of Bill.
(a)20% of total contractual value on completion of more than 24% of total contracted work
in Ist. on A/C bill (b)Further 40% of contractual value on completion of more than 48% of
contracted work in IInd. on A/C bill (c) 70% of contractual value on completion of more than
84% of contracted work in IIIrd. on A/C bill (d) Balance payment will be made on completion
of 100% contracted work in final A/C bill on successful completion at the work.
Execution of Agreement :-
8.1 The successful tenderer shall have to start the work within 7 days .
8.2 The successful tenderer shall have to sign on agreement for work tendered by the
Administration within 14 days from the date of issue the acceptance letter failing which his
E/money will be forfeited.
Commencement of the work :
9.1The success tenderer shall have to start the work within 7 days from the date of execution
of the agreement.

Completion time :
10.1 The work shall have to be completed within 60 days from the date of execution of the
agreement failing which the Rly. Admn. will be entitled to recover from the contractor the
penalty according to the terms laid down in para 12.1 of this tender.
Extension of time
11.2 In the event of failure on the part of the contractor to completes the work within the Time
as specified in Para 10.1 above on any group as accepted by the Rly, admn. As reasonable and
on approach by the contractor in such circumstances for extension of time. Rly. Administration
mat. Aloe additional time to the extension as would be considered reasonable by the Rly.
Admn. Such consideration being in the absolute discretion of the Rly. Administration and for
which the contract shall not be entitled to any compensation what so ever.
12.1 Penalty for delay incompletion .
If the contractor fails in the due performance of the contract within the time fixed by the
contract and any authorized extension there of the Rly, Admn. Is entitled to recover from the
contractor a sum of half percent of the price of that portion of the contract non completed by
the date, for each and every week or part of a week taken extra by the contractor to complete
the work provided the Rly. Admn. Has suffered loss due to the aforesaid failure on the part of
the contractor. The amount of damages recovered shall in no case exceed 10% of the value of
the contract. Alternatively at the opinion of the Sr. Divl. Elect. Engineer (TRD) E.C. Rly.,
Danapur the pled by the Rly. Admn. Itself and any loss or damaged which the Rly.
Administration may insure by reason of such failure on the part of the contractor shall be made
good by him or on the like extension of contractor.
Acceptance of tender and the condition in connection therewith :-
13.1 The tenderer shall hold the offer open till such date as specified in the tender. It
isunderstood that the tender documents have been said to the tenderers and the tenderer in / are
being remitted to tender in consideration of the stipulation on his/their part that after submitting
his/their tender, he /they will not resale from his/their offer or modify the terms and conditions
there of in a manner not acceptable to the Sr. Divl. Electrical Engineer (TRD) E. Rly,
DANAPUR should the tenderer fail to observe or comply with the foregoing stipulation, the
amount deposited as security for the due performance of the above stipulation shall be forfeited
to the Railway, If the tender is accepted the amount of earnest money will be held as security
deposit for the due and faithful fulfillment of the contractor. The earnest money will be
refunded to successful tenderer but the Rly. Shall not be responsible for any loss or the
stipulation to keep the offer, open for the period specified in the tender documents or to the
earnest money while in the possession not be payable to pay interest there of.
13.2 It shall not be obligatory on said authority to accept the lowest tender and no tender
tenderers shall demand any explanation for the cause or rejection of his/their tender.
13.3 If the tender is deliberately give any information his /their tender or creates circumstances
for the acceptance of his /their tender. Railway reserve the rights to reject such tender at any
stage.
13.4 If a tenderer expires after the submission of the tender or after the acceptance of his
tender ,the Rly shall deem such tender as cancelled . If a partner or a firm expirees after the
submission of their tender or after the acceptance of the tender the Rly shall deem such tender
as cancelled.
13.5. The earnest money including the amount taken as security deposit for the due
performance of the stipulation to keep the offer open till the date specified in the tender will be

efunded to the unsuccessful tenderer within a reasonable time. The earnest money deposited
by the successful tenderer will be retained towards the security deposit for the due and faith
full fulfillment of the contract but shall be forfeited if the contractor fails to execute the
agreement bond within 14 days of notification of the acceptance of his/their or commence the
work within 7 days after receipt or orders to that effect.
13.6. Non-compliance with any of the stipulations and consideration herein above is
liable to result of the tender being rejected.
13.7 The authority for the acceptance as the tender will rest with the Sr. Divl. Elect.
Engineer(TRD)., E.C. Rly., Danapur who does not bind himself to accept the lowest or any
other tender does not be under take to assign reasons for declining to consider any particular
tenders.
13.8 The tenderer shall keep the offer open for a minimum period of 90 days from the
date of opening of the tender, within which period the tenderer can not with draw his offer
subject to the period being expanded further if regaled by mutual agreement from time to
time. Any contravention of the above condition will make the tender lien for forfeitures of
the security deposit.
2.1.3 Should a tenderer or contractor on the list of approved contractors have a
relative/s or in the case of a firm or company or contractors on or notes of its share holders or
a relative/s of the share holders supplied in gazette capacity in the Elect. Engineer Dep’t. of
the. Rly. Danapur the authority inviting. tender shall be informs of the fact at the time of
submission of tender, failing which the tender may be disqualified or if such accordance with
the provision in clause 6 of the general condition of contract.
2.1.4 Should tenderer be a retired Engineer of the Gazetted, rank or any other Gazetted
officer working before retirement. Whether in the executive are administrative capacity of
whether holding a responsible por or not in the elect. Deptt. of any of the Rly. Owned and
Administrated by the president of India for the time being or should a tenderer being partners
firm have as one of its partners a retired Engineer or a retired Gazetted officer as aforesaid or
should a tenderer being as in corporate company have any such retired Engineer or retired
officer as one of its Directors or retired Gazetted officer as aforesaid the full information as
to the date of refinement of which Engineer of Gazetted officer from the said service and in
cases where Engineer of office had not retired from govt. Service at least two years prior to
the date sublimation of the tender as to whether permission for taken such contract or if the
contractor be partner or director, the case may be or to make employment under the
contractor has been ob taken by the tenderer or the Engineer of the contractor the case may
be from the president of India or any officer authorized by in this behalf, shall be clearly
stated in writing at the time of submission of tender. The under effect that no such retired
Engineer or retired Gazetted officer is so associated with the tenderer as the case may be
shall be rejected.
13.11 All materials for this work are to be supplied by the contract for all the items other than
those specific.
13.12 The final acceptance of the tenderers shall rest with the Sr. Divl. Elect. Engineer (TR-
D) , E.C. Rly., Danapur or his representative who reserved the fight to accept or reject any
tender of part there of without assigning any reason there of and does not bind himself to
accept the lowest tender only.
14.2 Arbitration :

(a) Matters in question of dispute or difference to be arbitration upon shall be referred
for decision to
(i) A sole Arbitrator who shall be the Chief Elect. Engineer / E.C.Rly.,HJP or a person
nominated by him in that behalf in cases where the claim in question is below Rs.
50000/- and in cases where the issued involved are not of a complained nature .The Chief
Elect. Engineer shall be the self judge to decide whether or not the issued involved are of
a complicated nature.
(ii) The arbitrators, who shall be Gazetted Rly. Officers of equal status to be appointed in
the manner laid down in subpara-
(b) Below for all claims of Rs. 50000/- and above, and for the issues involved are of a
complicated nature. The Chief Elect. Engineer shall be the sold judge to decide whether
the issue are of a complicated nature of not. In the event of the two arbitrators being
divided in their opinions the matter under dispute will be referred to on spire to be
applied in the matter laid down in sub Para (b) for his decision.
(c) For the purpose of F-pointing two arbitrators as referred to in sub-para (a), (ii)
above, the Sly. Will send a panel of more than three named of officers of the appropriate
status of one or more departments of the Rly. To the contractors who will beaked to
suggest a panel of three names out of the list so sent by the Rly. The Chief Elect.
Engineer will appoint on Arbitrators out of this panel of the contractors and then appoint
second arbitrator of equal status as the Rly’s nominee either from the panel or from
outsider the panel ensuring that the one of the two arbitrators shall nominate an umpire to
whom case will be referred in the event of any difference between the two arbitrators.
(d) The arbitrator or arbitrators of the impure shall have power to call for such
evidence by ray of office wits or otherwise as the arbitrator or arbitrators or empire shall
think proper, and it shall be the duty of the parties here to do cause to be done all such
theses may be necessary to enable the arbitrators or umpire to make the award without
any delay.
(b) It will be no objection that the person appointed as arbitrator/arbitrators, Umpire
are Govt. servant they have expressed view on all or any of the matters in dispute.
15.1. Railway Passes.
No Railway passes or concession tickets for men and materials of the contractor will be
granted by the Rly. Administration.
16.1. Samples.
The articles to be supplied in execution of the work shall be strictly in accordance with
specification/Drawing which shall be submitted by the successful tenderer along with his
tender and approved by the Sr. Div. Elect. Engineer (TRD)/ Danapur failure in
submission of samples or any item there of along with tender will disqualify the tender
consideration.
17.1. Price
The tenderer shall quote the price in the appendix ‘D’ enclosed herewith the rates being
expressed both in words and figures price against each item should be split to show the
break up in respect of labour and store, The rates should be inclusive of supply and
delivery of all materials F.O.L. and the taxes and specified in the Para –4.4.
18.1. Inspection and Provisional acceptance.
The articles which are to be supplied and executed as per specification will be inspected
by the Sr.Divl. Elect. Engineer (TRD)/EC.Rly. Danapur or by his authorized

epresentatives at every stage of payment as prescribed in Para of the tender, The Rly.
Admn. Reserved the right for acceptance and rejection of the work, thus inspected
without assigning any reason.
19.1. Deviation from Tender :
Deviation from tender papers will not normally be agreed to should the tenderer be
unable for good and sufficient reason to comply entirely with the tender papers be shall
indicate the deviations desired by him such deviation if may shall be kept down to the
absolute minimum and the reasons for deviations, shall be indicated. The Rly. Admn.
Reserved the rights to cancel the tender if any deviation is not acceptable to it and if the
tenderer is un-willing to withdraw the deviation or modify the same in a manner
acceptable to the Rly. The tenderer in all such cases shall indicate clearly the special
condition or amendment desired by him to the relevant item of the tender papers.
Contractor :
20.1. The contractor shall arrangement his own cost all tools. Plants facilities necessary
for reconditioning and testing the equipments.
Default and delay :
21.1. The contractor shall executed the work with the due diligence and expeditious
keeping to approved time schedule, should be refuses or neglects to comply with any
reasonable orders given to him wiring by the Sr. DEE(TRD) E. Rly., Danapur or his
authorized representative in connection with the work lapse assignably behind the time
schedule representative in connection with the work lapse, persistently being the
schedule due to his negligence. The Rly. Administration shall be at liberty to give days
notice in wiring tender contract requiring his to make good the neglect or contravention
completed of and should the contractor fail to comply with the requisitions in the notice
within 7 days, Administration to take the work in art out of the contractors hand without
any further reference and get the work or any part there of the case may be, completed to
any other rights or to Railway Administration
Loss unstained as
22.1. In the vent of any loss to the Rly. Admn. On account of execution and or
completion of the work or any part thereof by the agencies over than the contractor in
terms of above clause the contractor shall be liable to impure the lost the Rly. admn. The
reimbursement in full or in part as the case may be shall be mains as the option of the
Rly. Administration of or any of the following soured:
(i) any amount due and payable to the contractor by the Rly. on any account what so
above.
(ii)The contractors security deposit in the hands of the admn. As per as available and 3 rd
any other assets, what so ever of the contractor.
23.1. The work is to be taken upon the places at the various stations as mentioned in
appendix ‘C’.
23.2 Programmed for taking up the work at various stations will be decided by the Sr.
Divl. Elect. Engineer (TRD) E.C. Rly., Danapur and communicated to the contractor
from time to time.
Special instructions for quotation of rate as in App. ‘c’
24.1. All prices shall be written in English and expressed both in figures and works
corrections, if any should clearly be attested. Rates arrested or over written will not be
accepted.

24.2. The rates to be quoted must be incisive of all taxes vex. Provisional Tax surcharge
and other taxes etc.
25.1 Variation of quantity:-
The tenderers should note that the approximate quantity indicated in the schedule of
works likely to vary by 25% on the same rate quoted by the tenderer and the next 15%
increase in value beyond 25% of the agreemental value , the rate will be reduced to 2%
incremental value and the next 10% increase in the value , the rate will be further reduced by
2% in further incremental value of the agreement.
Test Certificates.
Test certificates in the prescribed Performa should be jointly countersigned by the
contractor and the installation with the bills.
The sheets will be nearly Resin and books in 100 sheets to be prepared in triplicate on
will be retained by the installation in charge and 3 rd copy to be submitted to the Sr. Divl.
Elect. Engineer (TRD), E. Rly., Danapur.
Earth pipe puts will be serially timbered and the test results should be recorded in board
revised and % copies one to be retained by the contractor there fore the installation in
charge and 3 rd copy to the Sr. Dill. Elect. Engineer(TR-D). E.C Rly., Danapur.
Terms and conditions :
1. The executed work will be jointly checked by the Electrical supervisor and
representative of the contractor. The copy of the test report should accompany with the
bill.
2.After completion of the work firm is to undertake guarantee for one year from the date
of completion and guarantee certificate should accompany the bill.
3. 2% Income Tax will be deducted from the bill.
4. 12% S/C on I/Tax will be deducted.
5. 4% BST or VAT will be deducted on the total value of the work.
6.Security deposited should be kept till work is completed and inspection is done by Rly.
Authorities.
7. Released materials should be returned the concerning supervisor and a copy of the
receipt challan should accompany the bill.
8. Indemnity Bond should be submitted during on account payment or in case of
repairing of any type of electrical equipment required to repair out side the premises of
Rly .
9. The copy of challan /receipt of manufactures/ Dealers should accompany with the bill
duly countersigned by the contractor and concerned installation in charge after
comparing with the original.
10 .Manufacturer test report should accompany with the bill where in it is applicable.
