and <strong>the</strong> Tribunal <strong>the</strong>refore rejects <strong>the</strong> Respondent‟s case on <strong>the</strong> Abuse of<br />

Process issue.<br />

2.111. This determination, toge<strong>the</strong>r with <strong>the</strong> Tribunal‟s determination of <strong>the</strong> Denial of<br />

Benefits issue later in Part 4 of this Decision, renders it unnecessary for <strong>the</strong> Tribunal<br />

to address o<strong>the</strong>r factors raised by <strong>the</strong> Parties in regard to <strong>the</strong> Abuse of Process issue.<br />

It should not be assumed from its silence here that, if relevant, <strong>the</strong> Tribunal was<br />

minded to decide any of <strong>the</strong>se fur<strong>the</strong>r factors one way or ano<strong>the</strong>r. However, <strong>the</strong> Tribunal<br />

considers that <strong>the</strong> Abuse of Process issue does not apply to <strong>the</strong> Claimant‟s<br />

claims <strong>under</strong> <strong>the</strong> Investment Law which are not made <strong>under</strong> CAFTA and made with<br />

an independent right to invoke ICSID Arbitration.<br />
