PART 6: ISSUE E – LEGAL AND ARBITRATION COSTS<br />
(01) Introduction<br />
6.1. The Parties made submissions on <strong>the</strong> legal and arbitration costs incurred to date in<br />
<strong>the</strong>ir respective written submissions on costs of 10 June 2011 and <strong>the</strong>ir reply submissions<br />
on costs of 24 June 2011.<br />
6.2. In summary, <strong>the</strong> Claimant claims legal costs US$ 4,338,744; and <strong>the</strong> Respondent<br />
claims legal costs US$ 4,057,719.96, toge<strong>the</strong>r with arbitration costs of approximately<br />
US$ 250,000. These claims are denied in full by <strong>the</strong> Respondent and <strong>the</strong><br />
Claimant respectively.<br />
6.3. This issue as to costs arises <strong>under</strong> ICSID Arbitration Rule 28(1) and CAFTA Article<br />
10.20.4 & 10.20.6 (cited in <strong>the</strong> Annex to Part 1 above). It also arises <strong>under</strong> Paragraph<br />
266(3) of <strong>the</strong> Tribunal‟s Decision of 2 August 2010, whereby <strong>the</strong> Tribunal reserved<br />
its powers to order costs <strong>under</strong> CAFTA Article 10.20.6 until <strong>the</strong> final stage of <strong>the</strong>se<br />
arbitration proceedings.<br />
6.4. Given <strong>the</strong> conduct of this arbitration to date and <strong>the</strong> Parties‟ respective allegations of<br />
misconduct made against each o<strong>the</strong>r, toge<strong>the</strong>r with <strong>the</strong> significant sums involved in<br />
this costs issue before <strong>the</strong>se proceedings have even reached <strong>the</strong> actual merits of <strong>the</strong><br />
Parties‟ dispute, <strong>the</strong> Tribunal considers it appropriate to set out <strong>the</strong> Parties‟ respective<br />
submissions on costs at some length in this Decision.<br />
(02) The Claimant’s Claim<br />
6.5. In summary, 201 <strong>the</strong> Claimant requests <strong>the</strong> Tribunal to order <strong>the</strong> Respondent to bear<br />
all <strong>the</strong> costs of <strong>the</strong>se arbitration proceedings to date.<br />
