The Designated Chair of <strong>WEND</strong> <strong>Committee</strong> (Capt. Roger PARSONS, (USA-NOAA) opened the<br />

meeting, welcoming participants and observers. He noted that there were more in attendance than<br />

was originally expected, and that this was a good indication regarding the importance furthering the<br />

goals and objectives of <strong>WEND</strong>. In particular, the Chair pointed out that as mandatory ECDIS<br />

carriage becomes more likely, there are increasing concerns expressed by the Shipping Community<br />

about:<br />

- World-wide ENC coverage at appropriate scale<br />

- Simple and unencumbered distribution system<br />

- A reasonable licensing and pricing policy.<br />

The <strong>WEND</strong> Secretary (Michel HUET, IHB) reviewed the List of Documents (see Annex B), noting<br />

that several new documents had recently been received.<br />

2. Approval of Officers and Agenda<br />

1. IHB to inform Member States that Capt. Roger PARSONS (USA-NOAA) and<br />

Vice Chairman of the <strong>WEND</strong> <strong>Committee</strong>, respectively.<br />

The Agenda was approved (see Annex D) with the following minor adjustments:<br />

Australia (Capt. Robert WARD) suggested that a presentation by ICCL (Doc. <strong>WEND</strong>9-8B) be made<br />

on the first day, right after the lunch break. UK (Dr. Peter WRIGHT) also suggested a modification in<br />

the order of presentations for Item 4 “Reports by the <strong>WEND</strong> Task Group”, as follows: <strong>WEND</strong>9-INF1,<br />

3.1 Minutes to 8 th <strong>WEND</strong> (Doc. <strong>WEND</strong>9-<strong>3A</strong>) were accepted without change.<br />

3.2 Actions Items from 8 th <strong>WEND</strong><br />

The Secretary and RAdm Kenneth BARBOR (IHB) briefly reviewed the status of the Action Items<br />

resulting from the 8 th <strong>WEND</strong> <strong>Meeting</strong> (Doc. <strong>WEND</strong>9-3B). It was noted that all actions had been<br />

completed or were ongoing.<br />

France (Ingénieur général Michel LE GOUIC) provided some additional comments regarding <strong>IHO</strong><br />

Publication S-64 (ECDIS Test Data Sets) and ECDIS type-approval (Doc. <strong>WEND</strong>8-INF5). This<br />

matter has been referred to CHRIS, and will also be brought to the attention of IMO and IEC.<br />

Germany (Mr. Horst HECHT) made specific mention that this matter needs to be addressed by IEC<br />

TC80 for the next edition of IEC 61174 (ECDIS: Methods of Testing and Required Test Results).<br />

Australia (Capt. Rod NAIRN) suggested that the title of <strong>IHO</strong> information paper “Importance of Being<br />

ECDIS” (Doc. <strong>WEND</strong>9-3E) be slightly altered. IHB will make this change.<br />

The Chair emphasized the importance of the ENC Assistance Questionnaire, and the need for ENC<br />

assistance (Doc. <strong>WEND</strong>-3G). UK (WRIGHT) mentioned that UK has an assistance program for ENC<br />

production. New Zealand (Mr. John Spittal) pointed out that there are still MS that have difficulty<br />

producing paper charts. IHB (BARBOR) also noted that many MS are interested in a Quality<br />

Management System.<br />

Doc. <strong>WEND</strong>9-3D “Guidelines for the Submission of Reports and Proposals for Consideration by<br />

<strong>WEND</strong>” was approved by the meeting.<br />

ACTIONS:<br />

2. France to contact IEC TC80 regarding recommended changes to ECDIS typeapproval<br />

4.1 <strong>WEND</strong> Task Group Activities<br />

TG Chair (Mr. Horst HECHT, Germany) explained that the main thrust of the TG is to listen to the<br />

requirements of shipping. As such, he suggested that Docs. <strong>WEND</strong>9-INF1, INF2 and INF4 be<br />

addressed first.<br />

4.1.1 RIN (Mr. William SANDFORD, UK) introduced a Discussion Paper on some proposed actions<br />

to improve arrangements to obtain ENCs (Doc. <strong>WEND</strong>9-INF1). TG Chair (HECHT) mentioned that<br />

the “no-cost for ENC” is a widely held opinion of many users. ICCL (Mr. George ARTS) expressed<br />

some concern about the possibility of creating a World Centre for ENCs. TG Chair (HECHT)<br />

responded that this had been considered over 10 years ago, and that the <strong>WEND</strong> RENC was felt – at<br />

that time - to be the best approach. IHB (BARBOR) felt that these types of opinions, as expressed by<br />

ICCL, being communicated to <strong>IHO</strong> are beneficial.<br />

4.1.2 Reference was made to a letter to IHB from Mr. Gert BÜTTGENBACH (ChartWorld) regarding<br />

difficulty to obtain ENCs from some MS (Doc. <strong>WEND</strong>9-INF2). India (RAdm B.R. RAO) mentioned<br />

that India is working to enter into an agreement on ENC distribution with IC-ENC. Italy (LCdr.<br />

Massimiliano NANNINI) indicated that C-Map is not the only means to obtain ENCs for Italian waters.<br />

Norway (Mr. Frode KLEPSVIK) confirmed that Primar Stranvanger distributes Italian ENCs. Italy<br />

(NANNINI) also stated that <strong>IHO</strong> should not interfere with MS dealing with private companies. USA -<br />

NGA (RAdm Chris ANDREASEN) mentioned that exclusive rights agreements do not further <strong>IHO</strong><br />

goals, and that the system must be open. UK (WRIGHT) supported this position. CIRM (Mr. Tor<br />

SVANES, Norway) responded that India and Italy do not have exclusive agreements for ENC<br />

distribution. There are agreements for SENC formats. At present, these countries do not have a<br />

mechanism to distribute ENC data. He mentioned that C-Map is against exclusive agreements. ICCL<br />

(ARTS) commented that, from his chart agent perspective, he experiences frustration in dealing with<br />

some <strong>IHO</strong> Member States that do not respond to requests for ENC data that have been produced, but<br />

are unobtainable. New Zealand (SPITTAL) believed that this discussion is at the heart of what <strong>WEND</strong><br />

is supposed to accomplish. UK (WRIGHT) stressed that it is important for <strong>WEND</strong> to consider various<br />

ways ENCs can be delivered to users.<br />

4.1.3 IHB (BARBOR) briefly summarized the information paper received from the UK Department<br />

of Transport dealing with “Marine eNavigation” (Doc. <strong>WEND</strong>9-INF4). The main issues for <strong>IHO</strong> are<br />

lack of global coverage and availability of ENCs from a user perspective.<br />

4.1.4 Singapore (Mr. Parry OEI) and UK (Mr. Bob MOSS) summarized the findings of the so-called<br />

HAILWOOD Report “Barriers to the adoption of ECDIS” [<strong>WEND</strong>9-4E (pdf) and <strong>WEND</strong>9-4E (ppt)].<br />

This report is based on a survey and interviews with selected mariners and ship operators regarding<br />

the implementation and progress of ECDIS. The principal findings were:<br />

• Electronic charting is viewed positively;<br />

• It has potential to significantly improve safety and efficiency;<br />

• There is much confusion over the regulations;<br />

• The distinction between ECDIS and ECS is blurred;<br />

• ECDIS does not rate as highly on quality as it should;<br />

• Users attach high importance to accuracy and quality;<br />

• Users see a direct link between operational efficiency and safety;<br />

• Global ENC coverage essential; and<br />

• Pricing is a concern.<br />

The report includes recommendations that the international hydrographic community should:<br />

• Review / improve “quality” of ENC;<br />

• Take the lead in providing clearer guidance on regulations particularly the distinction between<br />

ECDIS and ECS;<br />

• Promote “Safety through Efficiency”;<br />

• Promote awareness of human factors: fatigue, overload etc; and<br />

• Clarify pricing, licensing etc.<br />

To a query from USA-NOAA (Ms. Meg DANLEY) asking how many questionnaires were sent out and<br />

received, UK (MOSS) indicated that 25 companies responded, but the response rate for seafarers was<br />

very low (only 5%). On request from RIN (SANFORD), it was clarified that Capt. Paul HAILWOOD<br />

was not interviewed. France (LE GOUIC) commented that there is apparently some confusion about<br />

two matters, in particular:<br />

• That there would exist official and un-official ENC data;<br />

• That ECDIS would be only superior to ECS in terms of accuracy and authenticity.<br />

Australia (WARD) commented:<br />

• The low response rate from Mariners is not unexpected in the circumstances;<br />

• ECDIS training is currently piecemeal and sporadic.<br />

Norway (KLEPSVIK) commented that until ECDIS is mandatory (i.e. becomes a SOLAS carriage<br />

requirement), familiarity with ECDIS and training of mariners will continue to be very low.<br />

The Chair felt that there are really no major surprises in this report. <strong>WEND</strong> TG (HECHT) summarized<br />

that this report points out the need for cooperation by all <strong>IHO</strong> MS as it relates to ENC production,<br />

distribution and use by mariners. This needs to be a key function of <strong>WEND</strong>.<br />

4.1.5 UK (WRIGHT) gave a presentation “The Way forward” [<strong>WEND</strong>9-4D (pdf) and <strong>WEND</strong>9-4D<br />

(ppt)] that dealt with various issues addressed in the following documents:<br />

• Purpose of <strong>WEND</strong> (Doc. <strong>WEND</strong>9-4B);<br />

• Review of <strong>WEND</strong> Principles (Doc. <strong>WEND</strong>9-4C); and<br />

• Proposed new wording for <strong>WEND</strong> Objective and Principles (Doc. <strong>WEND</strong>9-4G).<br />

The presentation included recommendations that the <strong>WEND</strong> committee:<br />

• Endorses and implements the proposed revision to the <strong>WEND</strong> Objective and Principles (See<br />

Para. 4.2);<br />

• Encourages MS to work towards uniform carriage requirements for ECDIS across the world<br />

that will promote the shift from paper-based to digital navigation; and<br />

• Encourages MS to undertake a proactive programme of user education relating to ENC and<br />

ECDIS.<br />

4.1.6 <strong>WEND</strong> TG (HECHT) gave a presentation “Report of the <strong>WEND</strong> Task Group” [<strong>WEND</strong>9-4A<br />

(ppt)] that reviewed the formation, work and recommendations of this Task Group. He said that the<br />

<strong>WEND</strong> TG supported the revised <strong>WEND</strong> principles as proposed by UK (Doc. <strong>WEND</strong>9-4G; see Para.<br />

4.2.2).<br />

The Chair commented that there are three main issues involved: capacity, resources and<br />

commitments. He added that these would be discussed in more details during the remainder of the<br />

meeting.<br />

4.2 Recommended Changes to the purpose and principles of <strong>WEND</strong><br />

4.2.1 Purpose of <strong>WEND</strong> (Doc. <strong>WEND</strong>9-4B)<br />

<strong>WEND</strong> TG (HECHT) reviewed the basis for a recommended Purpose of <strong>WEND</strong>. The following<br />

wording was agreed:<br />

“The purpose of <strong>WEND</strong> is to ensure a world-wide consistent level of high-quality, updated<br />

official ENCs through integrated services that support chart carriage requirements of SOLAS<br />

Chapter V, and the requirements of the IMO Performance Standards for ECDIS.”<br />

It was agreed that this text would form the introductory section of the revised <strong>WEND</strong> Principles.<br />

4.2.2 <strong>WEND</strong> Principles (Doc. <strong>WEND</strong>9-4G)<br />

UK (WRIGHT) reviewed the scope of the recommended changes.<br />

Australia (WARD) felt that the impact of these recommended changes on other organizations must be<br />

considered (e.g. to IMO and shipowners). Norway (KLEPSVIK) cited two concerns:<br />

1) Whatever is put into these principles must be in accordance with <strong>IHO</strong> objectives. For instance,<br />

Para. 2.3, where MS would commit to having ENCs available by a certain date, may go beyond<br />

the objectives / bounds of <strong>IHO</strong>, and may require <strong>IHO</strong> MS to do things they cannot accomplish or<br />

provide.<br />

2) We need to be consistent in terms of what are the responsibilities of <strong>IHO</strong> (advisory) and IMO<br />

(regulatory).<br />

<strong>WEND</strong> TG (HECHT) responded that IMO is expected to mandate the use of ECDIS. IHB (BARBOR)<br />

believed that <strong>IHO</strong> is committed to provide ENCs but it cannot “ensure” that this will occur by a given<br />

date.<br />

ICCL (ARTS) stated that <strong>IHO</strong> must be committed to producing ENCs that are required for mandatory<br />

carriage of ECDIS. Norway (KLEPSVIK) agreed that there will be tremendous pressure on <strong>IHO</strong> if<br />

IMO makes ECDIS mandatory. However, quite likely <strong>IHO</strong> MS would be reluctant to commit at this<br />

time. Perhaps it would be prudent to wait until IMO adopts mandatory ECDIS carriage requirements.<br />

USA-NGA (ANDREASEN) shared these views.<br />

<strong>WEND</strong> TG (HECHT) believed that the followings are two key issues:<br />

1) “Commitment” on getting ENC production started (including exploring any alternatives); and<br />

2) Sanctioning the use of other types of data in national waters.<br />

Norway (KLEPSVIK) believed that the two main issues are:<br />

1) What is the purpose / task of <strong>WEND</strong>? and<br />

2) How can one use ECDIS if ENC coverage has not been achieved?<br />

UK (WRIGHT) felt that, at a minimum, <strong>WEND</strong> should issue a statement to <strong>IHO</strong> MS on the need to<br />

accelerate the production of ENCs. Australia (WARD) felt that a revision of the <strong>WEND</strong> Principles was<br />

necessary, now. <strong>WEND</strong> TG (HECHT) agreed with Australia, but suggested to keep at least the<br />

substance of the recommended changes to <strong>WEND</strong> Principles. It is evident that ENC production and<br />

distribution has taken longer than expected. Revised <strong>WEND</strong> Principles are needed in order to refocus<br />

efforts and accomplish what <strong>IHO</strong> said was needed for ECDIS.<br />

Norway (KLEPSVIK) also made the point that there is a direct link between <strong>IHO</strong> and IMO on ECDIS<br />

matters (e.g. reference in the IMO PS for ECDIS to <strong>IHO</strong> data and display standards). He added that<br />

IMO NAV51 (June 2005) and NAV52 (2006) would be dealing with ECDIS issues. Most likely, it<br />

will not be until 2008-2010 before ECDIS becomes mandatory.<br />

France (LE GOUIC) believed that the matter of what constitutes “official data” in the case of a<br />

substitute solution (para. 2.3.b of the revised <strong>WEND</strong> Principles refers) is also important. Australia<br />

(NAIRN) suggested that para 2.11 on legal liability be re-worded (e.g. exposure to – not acceptance of<br />

- legal liability).<br />

On suggestion by the Chair, the <strong>WEND</strong> TG met on the evening of Day 1 and addressed all the above<br />

concerns. On Day 2, <strong>WEND</strong> TG (HECHT) and UK (WRIGHT) presented the resulting new draft of the<br />

<strong>WEND</strong> Principles, which was viewed and discussed by the meeting. Further amendments were made<br />

and the agreed revised <strong>WEND</strong> Principles can be found in Annex E.<br />

ACTIONS:<br />

5. IHB to seek MS’ approval of the revised <strong>WEND</strong> Principles, as contained in<br />

Annex E.<br />

6. MS to work with the existing two RENCS.<br />

5. Review of activities of other <strong>IHO</strong> committees dealing with ECDIS, pertinent to <strong>WEND</strong><br />

Docs: <strong>WEND</strong>9-5A Status of Electronic Charting Issues before IMO (IHB)<br />

IHB (Capt. Steve SHIPMAN) provided a summary of <strong>IHO</strong> participation with IMO since the last<br />

<strong>WEND</strong> meeting in March 2004 (Doc. <strong>WEND</strong>9-5A).<br />

6. Report on Status: ECDIS and ENC standards/specifications<br />

Docs: <strong>WEND</strong>9-6A Status of <strong>IHO</strong> Publications on ECDIS (IHB)<br />

<strong>WEND</strong>9-6B S-57 Edition 4.0 Information Paper (TSMAD)<br />

6.1 IHB (HUET) provided a description of the status of all <strong>IHO</strong> ECDIS-related publications, as of<br />

March 2005. The main changes are highlighted in green in Doc. <strong>WEND</strong>9-6A (doc).<br />

Norway asked two questions regarding future <strong>IHO</strong> S-57 Ed. 4:<br />

1. When will it become in force?<br />

2. How will <strong>IHO</strong> act when new versions of <strong>IHO</strong> standards are adopted?<br />

IHB (BARBOR) responded that the current <strong>IHO</strong> S-57 is so closely tied to ENCs, that it is often<br />

assumed that any change to would impact ENCs. This will not be the case for S-57 Ed. 4. Australia<br />

(WARD, also Chair of CHRIS) made it clear, that no changes to the current ENC Product<br />

Specification are planned within a future Edition 4. What will occur to the current <strong>IHO</strong> S-57 Ed.3.1<br />

ENC Product Specification after the publication of Edition 4 will be discussed at the next CHRIS<br />

meeting (September 2005 in Rostock). In conjunction with CHRIS, there will also be an “ECDIS<br />

Stakeholders Forum” where this matter will be discussed in detail.<br />

7.1 The Chair introduced the Compendium of Reports of Regional Hydrographic Commissions<br />

(Doc. <strong>WEND</strong>9-7A) and asked RHC representatives to comment on their respective sections as<br />

necessary. Some additional information was provided on RHCs not included in Doc. <strong>WEND</strong>9-7A, i.e.<br />

New Zealand (SPITTAL) and Australia (NAIRN) for SWPHC, and USA-NOAA (DANLEY) for<br />

USCHC.<br />

7.2 Norway (KLEPSVIK) introduced the Primar-Stravanger status report (Doc. <strong>WEND</strong>9-7B).<br />

ICCL (ARTS) noted the lack of ENC availability from P-S for North America (USA and Canada).<br />

7.3 IC-ENC (Mr. Graham SAUNDERCOCK) introduced the IC-ENC status report [Doc. <strong>WEND</strong>9-<br />

7C (pdf) and <strong>WEND</strong>9-7C (ppt)]. Australia (WARD) provided additional details regarding Australia’s<br />

recent involvement as a satellite RENC (“Icicle”) of IC-ENC.<br />

7.4 Italy (NANNINI) introduced the Virtual RENC for Mediterranean and Black Seas status report<br />

(Doc. <strong>WEND</strong>9-7D).<br />

7.5 USA-NOAA (DANLEY) introduced the status report of the MACHC Electronic Chart<br />

Working Group (ECWG) [Docs. <strong>WEND</strong>9-7E (pdf) and <strong>WEND</strong>9-7E (ppt)].<br />

7.6 Doc. <strong>WEND</strong>9-7F “Facts on Carriage Requirements”, jointly produced by Primar-Stavanger<br />

and IC-ENC, was accepted as provided.<br />

7.7 China (Mr. NG Kwok-Chu, HK) gave a presentation on the production of ENCs in the South<br />

China Sea [Docs. <strong>WEND</strong>9-7G (pdf) and <strong>WEND</strong>9-7G (ppt)]. This has resulted in the availability on<br />

Internet of four small-scale ENC cells covering the entire SCS at no cost.<br />

There were several questions in regard to these four ENC cells being available “free of charge” via the<br />

Internet (e.g., liability, interim versus long-term pricing, suitability for ECDIS, no security scheme,<br />

integrity, distribution by RENCs, consistency of service, updating, etc.). On the issue of cost, it was<br />

mentioned that decision has still to be made on whether these ENCs would be available at no cost<br />

forever.<br />

8. Relationship with Industry<br />

Docs: <strong>WEND</strong>9-8A INGOs’ accreditation to <strong>IHO</strong> (IHB)<br />

<strong>WEND</strong>9-8B Increasing use/sales of Official ENC’s: Proposed Pay-per-Use<br />

model (Marine Press of Canada)<br />

8.1 ICCL (ARTS) gave a presentation (Doc. <strong>WEND</strong>9-8B) on a proposal for “Pay-per-Use” model<br />

for ENC production and distribution.<br />

Japan (Mr. Hideo NISHIDA, JHA) mentioned that Japan had recently lowered the price level for ENCs<br />

substantially, that they were looking to change the current ENC pricing system, and that they would<br />

evaluate the proposed pay-per-use model. Australia (WARD) was interested in more details on how<br />

vessels would be tracked in terms of what ENCs were used. ICCL (ARTS) responded that how this is<br />

done by Marine Press of Canada can be provided to HOs on an individual basis. New Zealand<br />

(SPITTAL) commented that this model may result in HOs obtaining less revenues than direct sale ENC<br />

data. ICCL (ARTS) responded that the model is based on data use, not how much data has been<br />

produced. Norway (KLEPSVIK) felt that the current price of ENC data is not excessive, but was<br />

interested in discussing this pay-per-use model in more detail on an individual HO basis, and in<br />

simplifying ENC pricing and service. He added that cost-recovery is not a requirement for Primar-<br />

Stavanger. ICCL (Capt. Paul BEGGS) gave an analogy of a person wishing to rent a car for a day<br />

versus being told that he must pay for the car for a whole year (even though it would be used just for<br />

one day!). France (LE GOUIC) pointed out that pricing and use of ENCs is very complex, and that<br />

simple solutions are not always possible. Germany (HECHT) stated that it is difficult to discuss all<br />

details of a customer-orientated service. He felt that it is the responsibility of governments to produce<br />

the data, while the role of VARs is to provide the necessary pricing and distribution service to users.<br />

Australia (NAIRN) felt that this approach would not be mutually exclusive of other schemes /<br />

arrangements. ICCL (ARTS) agreed that ships could choose which model to use. USA-NGA<br />

(ANDREASEN) commented that based on his experience, cost-recovery by HOs is not very large.<br />

While this pay-per-use model is of interest, this matter of pricing and use is quite complex.<br />

The meeting took note of the interesting proposed pricing system, and suggested that it should be<br />

discussed further with HOs and RENCs.<br />

8.2 IHB (BARBOR) introduced the “Accreditation to the <strong>IHO</strong> of Non-Governmental International<br />

Organizations” (Doc. <strong>WEND</strong>9-8A), as proposed by the <strong>IHO</strong> SPWG to the 3 rd EIHC. On request by<br />

Australia (NAIRN), it was clarified that the correct acronym for such organizations would probably be<br />

INGO, i.e. for International Non-Governmental Organization.<br />

9. Other ECS Data, Equipment and Standards<br />

Docs: <strong>WEND</strong>9-9A Report on ECS Database and Equipment Stds .(IHB)<br />

IHB (HUET) introduced this paper (Doc. <strong>WEND</strong>9-9A) provided by NECSA (Mr. Mort ROGOFF,<br />

President). In particular, he mentioned that an ECS database standard was published by ISO as ISO<br />

19379 in September 2003 and that IEC is developing an ECS standard, based on a RTCM<br />

Performance Standard for ECS, planned for publication in 2006.<br />

The Chair explained the intent of NOAA regarding the establishment of a Quality Assurance Program<br />

for the commercial distribution of NOAA chart products and services. He mentioned that a standard<br />

for certification of ECS databases has been established, and that NECSA is invited to apply. He noted<br />

that there are differences in interpretation between NOAA and NECSA regarding a Proposed Rule<br />

that has been published in the U.S. Federal Register. The Final Rule has yet to be made. He stated<br />

that the main issue is whether products produced to a standard, which are certified, will meet carriage<br />

requirements.<br />

Australia (WARD) stated that in his opinion this matter was not covered by the <strong>WEND</strong> TORs and as<br />

such its inclusion in the agenda was questionable. The Chair agreed.<br />

10. Other Business<br />

10.1 Coral reef issues<br />

Doc: <strong>WEND</strong>9-INF3 Coral Reef – Electronic Chart Initiative: Protecting Corals, Saving<br />

Ships (L. ALEXANDER, USA-UNH and K.L. RIES, USA-NOAA)<br />

Univ. of NH (ALEXANDER) gave of a very brief overview of a project to convert existing coral reef<br />

habitat information into Marine Information Objects (MIOs) for use as supplemental information<br />

layer on ENCs (Doc. <strong>WEND</strong>9-INF3). This is needed to in order to show Particularly Sensitive Sea<br />

Areas (PSSAs) as mandated by IMO.<br />

11. Summary of Action Items identified during meeting<br />

11.1 The Chair commented on what he felt was the most important accomplishment of this<br />

meeting: <strong>WEND</strong>’s role in encouraging the production and distribution of ENCs, particularly for the<br />

mandatory use of ECDIS. He felt it was important to reassess “How to keep making progress and<br />

forward momentum?”<br />

<strong>WEND</strong> TG (HECHT) believed that the idea developed at <strong>WEND</strong>/7 to work between <strong>WEND</strong> meetings<br />

was helpful. Also, the role of Regional Hydrographic Commissions has become more important. The<br />

establishment of “satellite” RENCs seems to be a good development. As such, it would be desirable<br />

to have the <strong>WEND</strong> TG continuing its work to stimulate further progress. The Chair agreed, and felt<br />

that it was appropriate for the <strong>WEND</strong> TG to continue. This view was unanimously supported by the<br />

meeting.<br />

ACTION:<br />

7. <strong>WEND</strong> TG to continue its work to stimulate cooperation within RHCs and<br />

monitor ENC development (e.g. small-scale ENC schemes).<br />

ICCL (ARTS and BEGGS) stated that they were glad to have participated in the meeting, and felt that it<br />

is very important to share knowledge and cooperate in order to meet the needs of the user.<br />

The Secretary and Rapporteur summarized the actions agreed by <strong>WEND</strong>/9, as below.<br />

1. IHB to inform Member States that Capt. Roger PARSONS (USA-NOAA) and Capt. Abri<br />

KAMPFER (South Africa) have been confirmed as Chairman and Vice Chairman of the<br />

<strong>WEND</strong> <strong>Committee</strong>, respectively.<br />

2. France to contact IEC TC80 regarding recommended changes to ECDIS type-approval<br />

testing.<br />

3. IHB to post on the <strong>IHO</strong> website the “Guidelines for the Submission of Reports and Proposals<br />

for Consideration by <strong>WEND</strong>”, as contained in Doc. <strong>WEND</strong>9-3D.<br />

4. MS to seek / provide ENC production assistance and Quality Management System<br />

implementation.<br />

5. IHB to seek MS’ approval of the revised <strong>WEND</strong> Principles, as contained in Annex E.<br />

6. MS to work with the existing two RENCS.<br />

7. <strong>WEND</strong> TG to continue its work to stimulate cooperation within RHCs and monitor ENC<br />

development (e.g. small-scale ENC schemes).<br />

12. Date and place of next meeting<br />

IHB (BARBOR) offered the IHB to host the 10 th <strong>WEND</strong> <strong>Meeting</strong> in <strong>April</strong> 2006, unless other MS wish<br />

to offer to host the next meeting in the meantime.<br />

PRINCIPLES OF THE WORLDWIDE ELECTRONIC NAVIGATIONAL<br />

CHART DATABASE (<strong>WEND</strong>)<br />

The purpose of <strong>WEND</strong> is to ensure a world-wide consistent level of high-quality, updated official<br />

ENCs through integrated services that support chart carriage requirements of SOLAS Chapter V, and<br />

the requirements of the IMO Performance Standards for ECDIS.<br />

1. Service Provision<br />

1.1 Member States will strive to ensure that, mariners, anywhere in the world, can obtain fully<br />

updated ENCs for all shipping routes and ports across the world.<br />

1.2 Member States will strive to ensure that their ENC data are available to users through<br />

integrated services 1 , each accessible to any ECDIS user (i.e., providing data in S-57 form), in<br />

addition to any national distribution or system-specific SENC delivery.<br />

1.3 Member States are encouraged to distribute their ENCs through a RENC 2 in order to share in<br />

common experience and reduce expenditure, and to ensure the greatest possible<br />

standardization, consistency, reliability and availability of ENCs.<br />

1.4 Member States should strive for harmonization between RENCs in respect of data standards<br />

and service practices in order to ensure the provision of integrated ENC services to users. (2.6)<br />

1.5 Methods to be adopted should ensure that data bear a stamp or seal of approval of the issuing<br />

HO. (5.2)<br />

1.6 When an encryption mechanism is employed to protect data, a failure of contractual obligations<br />

by the user should not result in a complete termination of the service. This is to assure that the<br />

safety of the vessel is not compromised. (5.4)<br />

1.7 In order to promote the use of ENCs in ECDIS, Member States are to strive for the greatest<br />

possible user-friendliness of their services, and facilitate integrated services to the mariner.<br />

(5.5)<br />

2. Rights and Responsibilities<br />

2.1 SOLAS Chapter V, Regulation 9, requires Contracting Governments to ensure that<br />

hydrographic data are available in a suitable manner in order to satisfy the needs of safe<br />

navigation. Once the carriage of ECDIS becomes mandatory, there will be a consequential<br />

requirement to ensure that such data, as agreed by IMO, are available in a form suitable for use<br />

in ECDIS.<br />

2.2 It is expected that Member States, for waters of national jurisdiction, will have mature supply<br />

systems for ENCs and their subsequent updating in place by the earliest date for mandatory<br />

carriage of ECDIS. (1.1)<br />

1 Integrated services are a variety of end-user services where each service is selling all its ENC data, regardless of source,<br />

to the end user within a single service proposition embracing format, data protection scheme and updating mechanism,<br />

packaged in a single exchange set.<br />

2 RENCs are organisational entities where <strong>IHO</strong> members have established co-operation amongst each other to guarantee a<br />

world-wide consistent level of high quality data, and for bringing about co-ordinated services with official ENCs and<br />

updates to them.<br />

2.3 By the dates established by IMO (currently expected to be 1 July 2008 for High Speed Craft<br />

routes, and by 1 July 2010 for other routes), Member States will strive to either:<br />

Provide the necessary ENC coverage, or<br />

Agree with other States to produce the necessary ENC coverage on their behalf.<br />

<strong>IHO</strong> will address overall coverage on a regional basis through Regional Hydrographic<br />

Commissions.<br />

2.4 The INT chart system is a useful basis for initial area selection for producing ENCs. (1.5)<br />

2.5 Member States are encouraged to work together on data capture and data management. (2.4)<br />

2.6 Responsibilities for providing digital data outside areas of national jurisdictions must be<br />

established (see guidance in Annex). (1.4)<br />

2.7 Technically and economically effective solutions for updating are to be established conforming<br />

to the relevant <strong>IHO</strong> standards. The updating of ENCs should be at least as frequent as that<br />

provided by the nation for correction of paper charting. (6.1)<br />

2.8 The Member State responsible for originating the data is also responsible for its validation in<br />

terms of content, conformance to standards and consistency across cell boundaries. (1.2)<br />

2.9 A Member State responsible for any subsequent integration of a country’s data into a wider<br />

service is responsible for validating the results of that integration. (1.3)<br />

2.10 National HOs providing source data are responsible for advising the issuing HO of update<br />

information in a timely manner. (6.2)<br />

2.11 Member States should work together to ensure data integrity, and to safeguard national<br />

copyright in ENC data to protect the mariner from falsified products, and to ensure traceability.<br />

(5.3)<br />

2.12 In producing ENCs, Member States are to take due account of the rights of the owners of<br />

source data and if paper chart coverage has been published by another Member State, the rights<br />

of that State.<br />

2.13 Member States should recognize their potential exposure to legal liability for ENCs. (1.6)<br />

3. Standards and Quality Management<br />

3.1 A Quality Management System should be considered to assure high quality of ENC services.<br />

When implemented, this should be certified by a relevant body as conforming to a suitable<br />

recognised standard; typically this will be ISO 9001:2000. (4.1)<br />

3.2 There must be conformance with all relevant <strong>IHO</strong> and IMO standards. (4.2)<br />

4. Assistance and Training<br />

4.1 Member States’ HOs are strongly recommended to provide, upon request, training and advice<br />

to HOs that require it to develop their own national ENC provision. (8.1)<br />

ENC duplication should be avoided. A single ENC producing country should exist in any<br />

given area.<br />

A country is normally the ENC producing country for waters within its national jurisdiction.<br />

Responsibility for the production of ENC can be delegated in whole or in part by a country to<br />

another country, which then becomes the producing country in the considered area.<br />

When the limits of waters of national jurisdiction between two neighbouring countries are not<br />

established, or it is more convenient to establish boundaries other than established national<br />

boundaries, producing countries are to define the boundaries for ENC production within a<br />

technical arrangement. These limits would be for cartographic convenience only and shall<br />

not be construed as having any significance or status regarding political or other jurisdictional<br />

boundaries.<br />

In international waters, the INT chart producer nation shall be assumed to be the producer of<br />

the corresponding ENC. Where the offshore limits of waters under national jurisdiction have<br />

not yet been established, clause ‘d’ should apply.<br />

In areas where the paper INT charts overlap, neighbouring producer nations should agree a<br />

common limit of ENC production in the overlapping areas. Cartographic boundaries should<br />

be as simple as possible; for example: a succession of straight segments and turning points<br />

corresponding to such things as meridians, parallels, or chart limits. Where different producer<br />

nations are responsible for INT coverage of the same area at different scales, those nations<br />

should agree on a suitable set of boundaries so as to provide the user with the most coherent<br />

service possible.<br />

In areas of national jurisdiction for which there is no recognised ENC producer nation, the<br />

Regional Hydrographic Commission (or similar body) should determine the ENC producer<br />

nation. ENCs produced under such arrangements should be offered for transfer to the<br />

Coastal State in the event that the Coastal State subsequently develops the capacity to<br />

maintain the ENCs. Such transfer should respect the moral rights of the Coastal State and the<br />

commercial rights of the producer nation.<br />

When the production limits are the official limits for national jurisdiction waters, commercial<br />

rights shall belong to the ENC producing country.<br />

When the production limits are cartographic boundaries as opposed to national boundaries,<br />

the commercial rights shall normally belong to the ENC producing country but may possibly<br />

be encumbered by the payment of royalties to the relevant country through a technical<br />

arrangement (see clause d).<br />
