Captain America rises from dead<br />

Captain America is rising from the grave.<br />

The Marvel Comics superhero returns for the five-part series<br />

“Captain America Reborn,” beginning July 1.<br />

But Marvel w<strong>on</strong>’t disclose how he rises from the dead. Executive<br />

Editor Tom Brevoort teases that the character has been “<strong>on</strong><br />

a V<strong>on</strong>negut-esque metaphysical journey,” including some soulsearching<br />

about his place in the world.<br />

A&E cancels Swayze drama, ‘The Beast’<br />

“The Beast,” a police drama that starred the ailing<br />

Patrick Swayze, will not return for a sec<strong>on</strong>d<br />

seas<strong>on</strong>, A&E announced M<strong>on</strong>day.<br />

The series, which premiered in January, starred<br />

Swayze as Charles Barker, a rogue undercover<br />

FBI agent teamed up with rookie Ellis Dove, Travis<br />

Fimmel. The series was filmed <strong>on</strong> locati<strong>on</strong> in<br />

Chicago.<br />

Reviews for the series were mixed and its audience<br />

averaged 1.3 milli<strong>on</strong> viewers through the Swayze<br />

Patrick<br />

13 episodes, which c<strong>on</strong>cluded their run in April.<br />

But Swayze was unstinting in a rough-and-tumble performance<br />

that he maintained while battling pancreatic cancer. His<br />

illness had no discernible effect <strong>on</strong> his gritty portrayal.<br />

A&E President Bob DeBitetto called the performance “an inspirati<strong>on</strong><br />

to us all.”<br />

DeBitetto said the series “has truly been a labor of love for every<strong>on</strong>e,”<br />

but added that “after careful deliberati<strong>on</strong> we have reluctantly<br />

decided not to attempt a sec<strong>on</strong>d seas<strong>on</strong>.”<br />

Alba w<strong>on</strong>’t face vandalism charges<br />

Police have decided against pursuing a criminal vandalism<br />

case against Jessica Alba over some posters that were plastered<br />

around downtown Oklahoma City.<br />

Police Sgt. Gary Knight said n<strong>on</strong>e of the owners of property <strong>on</strong><br />

which the posters were placed wanted to press charges against<br />

Alba, who has apologized.<br />

Police never interviewed the 28-year-old co-star of the “Fantastic<br />

Four” movies, “Sin City and “Good Luck Chuck.” She is in<br />

Oklahoma City shooting a movie, “The Killer Inside Me.”<br />

Letterman’s apology for the<br />

joke about her daughter.<br />

The Alaska governor, in a<br />

statement issued today, said<br />

the apology was accepted “<strong>on</strong><br />

behalf of all young women,<br />

like my daughters, who hope<br />

men who ‘joke’ about public<br />

displays of sexual exploitati<strong>on</strong><br />

of girls will so<strong>on</strong> evolve.”<br />

On his CBS’ “Late Show”<br />

M<strong>on</strong>day night, Letterman<br />

said his joke about <strong>on</strong>e of Palin’s<br />

daughters being “knocked<br />

up” by Alex Rodriguez can’t<br />

be defended.<br />

He said the joke referred to<br />

18-year-old Bristol Palin, not<br />

her 14-year-old sister, Willow.<br />

But Letterman said it’s his<br />

resp<strong>on</strong>sibility that people<br />

believed that he intended<br />

to target Willow, who had<br />

attended a New York Yankees<br />

game with her mother.<br />

us to secure an American’s<br />

Although Bristol, an unwed<br />

mother, was the target of his<br />

joke, Letterman didn’t name<br />

her when it was originally<br />

made <strong>on</strong> June 8.<br />

It was “a coarse joke,” “a bad<br />

joke,” Letterman told viewers.<br />

“But I never thought it was<br />

(about) anybody other than<br />

the older daughter, and before<br />

the show, I checked to make<br />

sure, in fact, that she is of legal<br />

age, 18.”<br />

“The joke, really, in and of<br />

itself, can’t be defended,” he<br />

declared.<br />

Oh, boy! Moms sue, say sex tests wr<strong>on</strong>g<br />

Six New York City mothers are suing the maker of a baby sex<br />

test that touted its product as “infallibly accurate,” saying the test<br />

results they received were wr<strong>on</strong>g.<br />

In papers filed in Manhattan Supreme Court, the women claim<br />

they received incorrect results from the $275 Baby Gender Mentor<br />

test by Acu-Gen Biolab Inc., of Lowell, Mass.<br />

The suit claims the test maker advertised its product as the<br />

“gold standard for prenatal gender detecti<strong>on</strong>.”<br />

The company’s Web site says the test can determine a baby’s<br />

sex as early as five to eight weeks’ gestati<strong>on</strong>.<br />

Lawyer Barry Gainey said the lawsuit charges the product’s<br />

makers and marketers with negligence and fraud, and seeks unspecified<br />

damages.<br />
