(N.D. <strong>Iowa</strong> 2009). On December 8, 2009, the defendants filed a notice <strong>of</strong> interlocutory<br />

appeal to the Eighth Circuit Court <strong>of</strong> Appeals. In their appeal, the defendants sought<br />

reversal <strong>of</strong> my decision to deny defendants’ Motion For Summary Judgment based upon<br />

<strong>Koehler</strong>’s claims for qualified immunity; Monell liability; and reversal <strong>of</strong> my order<br />

bifurcating the Monell and respondeat superior claims from the individual claims against<br />

<strong>Koehler</strong>. On August 18, 2010, the United States Court <strong>of</strong> Appeals for the Eighth Circuit<br />

affirmed my decision denying qualified immunity to <strong>Koehler</strong>. The rest <strong>of</strong> the defendants’<br />

appeal was dismissed for lack <strong>of</strong> jurisdiction. See <strong>Shannon</strong> v. <strong>Koehler</strong>, 616 F.3d 855, 866<br />

(8th Cir. 2010).<br />

On August 25, 2009, <strong>Shannon</strong> filed his First Motion In Limine To Bar Reference<br />

To Certain Facts Not Known At The Time Of Plaintiff’s Arrest (Plaintiff’s First Motion<br />

in Limine); Brief In Support Of Plaintiff’s First Motion In Limine; and Affidavit Of W.<br />

Ken Katsaris. (docket no. 30.) On September 11, 2009, the defendants filed their<br />

Resistance To Plaintiff’s First Motion In Limine, Oral Argument Requested; Defendants’<br />

Memorandum Of Law In Support Of Resistance To Plaintiff’s First Motion In Limine; and<br />

Exhibits 1-6. (docket no. 36.) On September 18, 2009, <strong>Shannon</strong> filed his Reply Brief<br />

Regarding Plaintiff’s First Motion In Limine. (docket no. 39.)<br />

On August 23, 2010, after the delay <strong>of</strong> an appeal, I filed an Order allowing the<br />

parties to supplement their limine filings. (docket no. 73.) <strong>Shannon</strong> complied with this<br />

Order by filing Plaintiff’s Supplement To First Motion In Limine (Plaintiff’s Supplement)<br />

on September 7, 2010. (docket no. 78.) On September 14, 2010, the defendants filed a<br />

Resistance To Plaintiff’s Supplement, Oral Argument Requested, And Memorandum Of<br />

Law In Resistance To Plaintiff’s Supplement. (docket no. 82.)<br />
