trust funds <strong>and</strong>' property for the time being representing the said<br />

sum <strong>of</strong> £100,000 to be held by them UPON trust to pay the income <strong>of</strong><br />

the said trust funds <strong>and</strong> property to my wife during her life <strong>and</strong><br />

so that during any coverture the same shall be for her separate use<br />

without power <strong>of</strong> anticipation AND after the death <strong>of</strong> my wife my<br />

Trustees shall st<strong>and</strong> possessed <strong>of</strong> the said trust premises to be transferred<br />

to them as aforesaid in the event <strong>of</strong> my not leaving any issue<br />

who shall attain the age <strong>of</strong> 21 years in trust for " The Master Fellows<br />

" <strong>and</strong> Scholars <strong>of</strong> the College <strong>of</strong> the Holy <strong>and</strong> Undivided Trinity<br />

" within the Town <strong>and</strong> University <strong>of</strong> Cambridge <strong>of</strong> King Henry the<br />

" Eighth's Foundation" (hereinafter called Trinity College) absolutely.<br />

3. I BEQUEATH to my said wife all my furniture <strong>and</strong> effects horses<br />

carriages motor cars yacht <strong>and</strong> jewellery which at the time <strong>of</strong> my<br />

death shall be in or about or belonging to or appropriated or<br />

ordered for any <strong>of</strong> my residences excepting however my fishing rods<br />

guns <strong>and</strong> rifles <strong>and</strong> as to such fishing rods I give to my said wife<br />

such <strong>of</strong> them as she may select for her own use <strong>and</strong> I give all my<br />

fishing rods other than those selected by my wife for her own use to<br />

my friend <strong>Sir</strong> Francis Sidney Graham Moon Baronet <strong>and</strong> I give all<br />

my guns to the said Henry Suttoii Timmis <strong>and</strong> all my rifles to rny<br />

friend Mark Firth. I give all my wines <strong>of</strong> every description to be<br />

divided equally between my said wife <strong>and</strong> the said Mark Firth Henry<br />

Sutton Timmis <strong>and</strong> <strong>Will</strong>iam Marshall Rhodes.<br />

4. I BEQUEATH to my said wife the sum <strong>of</strong> £5,000 to be paid to<br />

her within one calendar month after my decease for her immediate<br />

requirements <strong>and</strong> in priority to all other bequests hereby made.<br />

5. I BEQUEATH to each <strong>of</strong> my Executors in case they shall<br />

respectively prove my <strong>Will</strong> the sum <strong>of</strong> £1,000.<br />

6. I BEQUEATH the following legacies to the friends <strong>and</strong> relations<br />

hereinafter respectively named that is to say To the said <strong>Will</strong>iam<br />

Marshall Rhodes (in addition to the contingent legacy <strong>of</strong> £1,000<br />

hereinbefore given to him as Executor <strong>of</strong> this my <strong>Will</strong>) the sum <strong>of</strong><br />

£10,000 To the said Henry Sutton Timmis (in addition to the<br />

said contingent legacy <strong>of</strong> £1,000 hereinbefore given to him as<br />

Executor <strong>of</strong> this my <strong>Will</strong>) the sum L I To my godson the


son <strong>of</strong> the said Henry Sutton Timmis the sum <strong>of</strong> £5,000 To Sidney<br />

Munro the sum <strong>of</strong> £5,000 To Ada Darby the sum <strong>of</strong> £1,000 To each<br />

<strong>of</strong> the children <strong>of</strong> Caroline Spurling hereinafter named that is to say<br />

to Adelaide Spurling, Alice Spurling, Bessie Spurling, Alberta Reeves<br />

<strong>and</strong> Emily Wedgwood the sum <strong>of</strong> £250 To the said Mark Firth the<br />

sum <strong>of</strong> £500 To <strong>George</strong> W. Munro now at the Fairfield Works the<br />

sum <strong>of</strong> £1,000 To the said Francis Sidney Graham Moon £500 To<br />

each <strong>of</strong> the sisters <strong>of</strong> my mother hereinafter named that is to say<br />

Elizabeth Dunn Rebecca Clarke <strong>and</strong> Harriett Hubbard the sum<br />

<strong>of</strong> £1,000.<br />

7. I BEQUEATH to my Trustees the sum <strong>of</strong> £5,000 upon trust to<br />

invest the same in any mode <strong>of</strong> investment hereinafter authorised for<br />

the investment <strong>of</strong> the proceeds <strong>of</strong> sale <strong>and</strong> conversion <strong>of</strong> my general<br />

residuary estate <strong>and</strong> upon trust to pay the income <strong>of</strong> the trust funds<br />

<strong>and</strong> investments for the time being representing the said sum <strong>of</strong> £5,000<br />

to my cousin <strong>Will</strong>iam Robert Reeves during his life <strong>and</strong> upon the<br />

death <strong>of</strong> the said <strong>Will</strong>iam Robert Reeves the trust funds <strong>and</strong> investments<br />

then representing the said sum <strong>of</strong> £5,000 shall sink into <strong>and</strong><br />

become part <strong>of</strong> my residuary estate<br />

8. I BEQUEATH the following legacies to such <strong>of</strong> the persons hereinafter<br />

named or mentioned as shall be in my employment or service<br />

at my death <strong>and</strong> shall not then be under notice to leave whether given<br />

or received that is to say To J. B. Harding my Estate Steward at<br />

Chilton the sum <strong>of</strong> £1,000 To <strong>Will</strong>iam Becket my Head Gardener<br />

the sum <strong>of</strong> £200 To <strong>George</strong> Holmaii the Captain <strong>of</strong> my Yacht the<br />

sum <strong>of</strong> £200 To Ralph Simms my Head Keeper the sum <strong>of</strong> £200 To<br />

my Valet for the time being if he shall have been in my service for at<br />

least five years prior to my decease the sum <strong>of</strong> £200 <strong>and</strong> if he shall<br />

have been in my service for less than five years prior to rny decease<br />

the sum <strong>of</strong> £100 To my Head Butler at Chilton Lodge for the time<br />

being if he shall have been in my service for at least five years prior<br />

to my decease the sum <strong>of</strong> £200 <strong>and</strong> if he shall have been in my service<br />

for less than five years the sum <strong>of</strong> £100 To Robert Macintosh<br />

Head Keeper at Ralia £100 <strong>and</strong> to Arthur Hewitt Butler at<br />

Ralia £100.


9. I BEQUEATH the following charitajgle legacies that isjojja^ to the<br />

Savernake Hospital the sum <strong>of</strong> £500 To the Shipwrights' Company<br />

the sum <strong>of</strong> £500 To the Missions to Seamen whose <strong>of</strong>fices are now<br />

situate at 11 Buckingham. Street Str<strong>and</strong> AV.C. the sum <strong>of</strong> £2,000 • To<br />

the Oxford Diocesan Commission the sum <strong>of</strong> £1,000 UPON tmst to<br />

apply the income there<strong>of</strong> for the purpose <strong>of</strong> increasing the stipend <strong>of</strong><br />

the Vicar for the time being <strong>of</strong> <strong>Hungerford</strong> Parish Church JTo the<br />

/^Trustees for the time being <strong>of</strong> the <strong>Hungerford</strong> Parish Church House<br />

built by me the sum <strong>of</strong> £2,500<br />

Church House AND I DECLARE that the re-vipt <strong>of</strong> the Treasurer or<br />

other proper <strong>of</strong>ficer for the time being <strong>of</strong> any <strong>of</strong> the said Institutions<br />

Societies or Authorities shall be a sufficient discharge for the legacy<br />

given to such Institiition Society or Authority.<br />

10. I DECLARE that all the legacies hereinbefore given shall be<br />

free <strong>of</strong> duty.<br />

11. I DEVISE <strong>and</strong> BEQUEATH all my real estate <strong>of</strong> every tenure <strong>and</strong><br />

whether situate in Engl<strong>and</strong> Scotl<strong>and</strong> or elsewhere AND all my<br />

personal estate <strong>and</strong> effects whatsoever <strong>and</strong> wheresoever not hereby<br />

otherwise disposed <strong>of</strong> (including as well real as personal estate over<br />

which I have any general power <strong>of</strong> appointment or disposition by<br />

<strong>Will</strong>) UNTO <strong>and</strong> to the use <strong>of</strong> ray Trustees their heirs executors or<br />

administrators respectively according to the nature there<strong>of</strong> UPON<br />

tr-ust that my Executors shall sell call in collect <strong>and</strong> convert into<br />

money the said real <strong>and</strong> personal estate <strong>and</strong> premises at such time<br />

or times <strong>and</strong> in such manner as they shall think fit (but as to reversionary<br />

property not until it falls into i n unless it shall<br />

appear to - my Trustees that an earlier sale will be beneficial) <strong>and</strong> so<br />

that they shall have the fullest powers <strong>and</strong> discretion to postpone<br />

the sale calling in collection or conversion <strong>of</strong> the whole or any<br />

part or parts <strong>of</strong> the said premises (including leaseholds or other<br />

property <strong>of</strong> a terminable or wasting nature <strong>and</strong> including also all<br />

my shares in the Fairfield Shipbuilding <strong>and</strong> Engineering Company<br />

Limited <strong>and</strong> in Camniell Laird <strong>and</strong> Company Limited < during such<br />

period as they shall think proper <strong>and</strong> to retain the same or any part


there<strong>of</strong> in its present form <strong>of</strong> investment without being responsible<br />

for loss. PROVIDED always that the trust for sale hereinbefore declared<br />

shall as regards the Chilton Lodge Estate be subject to the direction<br />

in Clause 12 here<strong>of</strong> contained.<br />

12. I DIRECT that my Wife shall during her life be entitled to the<br />

personal use occupation <strong>and</strong> enjoyment <strong>of</strong> Chilton Lodge aforesaid,<br />

together with the stables, coachhouse, gardens, pleasure grounds <strong>and</strong><br />

appurtenances belonging or therewith held <strong>and</strong> that while my wife<br />

shall desire to use the said house as her residence the Chilton Lodge<br />

Estate shall not be sold without her previous consent in writing.<br />

13. MY Trustees shall out <strong>of</strong> the moneys to arise from the sale,<br />

calling in, collection or conversion <strong>of</strong> my said real or personal estate<br />

or forming part <strong>of</strong> my said personal estate, pay my funeral or testamentary<br />

expenses <strong>and</strong> debts <strong>and</strong> the legacies bequeathed by this my<br />

<strong>Will</strong> or any Codicil hereto <strong>and</strong> make provision for the duty on any<br />

legacies bequeathed free <strong>of</strong> duty.<br />

14. MY Trustees shall at their discretion invest the residue <strong>of</strong> the<br />

said moneys in the names or under the legal control <strong>of</strong> my Trustees<br />

in any <strong>of</strong> the modes <strong>of</strong> investment authorised by the Trustees Act<br />

1893 including first charges registered under the L<strong>and</strong> Transfer Acts<br />

1875 <strong>and</strong> 1897 on freehold or leasehold hereditaments in Engl<strong>and</strong> or<br />

in or upon the debentures debenture or rent charge or the guaranteed<br />

or preference stock or shares <strong>of</strong> any Railway Company in Great<br />

Britain incorporated by any Special Act <strong>of</strong> Parliament or in or upon<br />

the stocks funds or securities <strong>of</strong> the Government <strong>of</strong> any British Colony<br />

or Dependency <strong>and</strong> my Trustees may at such discretion as aforesaid<br />

transpose any such, investments into others <strong>of</strong> any nature hereby<br />

authorised.<br />

15. MY Tmstees shall pay the income <strong>of</strong> the said trust premises<br />

for the time being constituting or representing my residuary estate<br />

(hereinafter referred to as my residuary estate) to my wife during her<br />

life <strong>and</strong> so that during any coverture such income shall be for her<br />

separate use without power <strong>of</strong> anticipation.<br />

16. After the death <strong>of</strong> my wife my Trustees shall st<strong>and</strong> possessed<br />

<strong>of</strong> my residuary estate in trust for all or any my children or child


who being male shall attain the age <strong>of</strong> 21 years or being female<br />

shall attain that age or marry if more than one in equal shares<br />

absolutely. AND if I shall not leave any child me surviving who shall<br />

attain the age <strong>of</strong> 21 years or being female shall marry under that age<br />

my Trustees shall st<strong>and</strong> possessed <strong>of</strong> my residuary estate in trust for<br />

Trinity College absolutely.<br />

17. Mr Executors <strong>and</strong> my Trustees may employ <strong>and</strong> pay a Solicitor<br />

or any other agent to transact all the business <strong>of</strong> the trust <strong>and</strong> any<br />

Trustee for the time being who shall be a Solicitor shall be entitled to<br />

receive all usual pr<strong>of</strong>essional charges <strong>and</strong> emoluments notwithst<strong>and</strong>ing<br />

his acting as such Trustee.<br />

18. The exercise <strong>of</strong> the statutory power <strong>of</strong> appointing new Trustees<br />

shall during the life <strong>of</strong> my wife be subject to her consent.<br />

Codicil to my <strong>Will</strong>, which bears date the ora day <strong>of</strong> May 1906. I


HEREBY REVOKE the appointment o£ <strong>Will</strong>iam Marshall Rhodes as<br />

one <strong>of</strong> the Executors <strong>and</strong> Trustees <strong>of</strong> my <strong>Will</strong> AND I REVOKE the<br />

legacy <strong>of</strong> £1,000 bequeathed by my said <strong>Will</strong> to the said <strong>Will</strong>iam<br />

Marshall Rhodes as an Executor <strong>and</strong> Trustee there<strong>of</strong>, but I hereby<br />

confirm all other gifts made by my said <strong>Will</strong> to the said <strong>Will</strong>iam<br />

Marshall Rhodes beneficially. AND I HEREBY APPOINT <strong>Will</strong>iam<br />

Henry Whaite <strong>of</strong> No. 8 Winchester Place, Highgate, in the County<br />

<strong>of</strong> Middlesex, Esquire, to be an Executor <strong>and</strong> Trustee <strong>of</strong> my said<br />

<strong>Will</strong> in the place <strong>of</strong> the said <strong>Will</strong>iam Marshall Rhodes AND I DECLARE<br />

that my said <strong>Will</strong> <strong>and</strong> all the devises bequests powers <strong>and</strong> provisions<br />

therein contained shall be construed <strong>and</strong> take effect in all respects<br />

as if the name <strong>of</strong> the said <strong>Will</strong>iam Henry Whaite had been<br />

originally inserted therein throughout in lieu <strong>of</strong> the name <strong>of</strong> the<br />

said <strong>Will</strong>iam Marshall Rhodes as an Executor <strong>and</strong> Trustee there<strong>of</strong><br />

<strong>and</strong> I bequeath the sum <strong>of</strong> £1,000 to the said <strong>Will</strong>iam Henry Whaite<br />

in case he proves my <strong>Will</strong> AND in all other respects I confirm my<br />

said <strong>Will</strong>.<br />

I HEREBY REVOKE the legacy <strong>of</strong> £10,000 by my said <strong>Will</strong> bequeathed<br />

to <strong>Will</strong>iam Marshall Rhodes <strong>and</strong> I HEREBY REVOKE the bequest <strong>of</strong><br />

wines in my said <strong>Will</strong> contained so far only as the bequest <strong>of</strong> one<br />

fourth part there<strong>of</strong> in favour <strong>of</strong> the said <strong>Will</strong>iam Marshall Rhodes is<br />
