“Off Production” Employees - Ten Hour/Four Day Workweek<br />

The Producer may schedule “off production” employees to work on<br />

a daily basis with a ten (10) hour minimum call at straight time,<br />

provided the employee is guaranteed forty (40) hours within his<br />

workweek. An individual employed on the basis of a ten hour/four<br />

day workweek shall be paid time and one-half for the fifth or sixth<br />

day worked within his workweek and double time for the seventh<br />

day worked within his workweek. The guaranteed pay of such<br />

employees who absent themselves without the Producer’s consent<br />

may be reduced one-fourth (¼) of the weekly guarantee for each<br />

day of absence.<br />

Exempt Employees - The Producer and the individual employee<br />

shall enter into individual negotiations prior to the start of<br />

employment in such classification for the purpose of establishing an<br />

individual flat rate which shall be considered as exempt from the<br />

Fair Labor Standards Act and related applicable state laws and shall<br />

not be subject to overtime, meal periods, meal penalties, call-back<br />

provisions or other premium pay conditions contained herein;<br />

(provided, however, that for purposes of Motion Picture Industry<br />

Health Plan and Motion Picture Industry Pension Plan<br />

contributions, see Article 11, Article 12(d) and Article 13(d)).<br />

When working “on production,” a Transportation Coordinator shall<br />

be paid not less than the lowest paid full-time driver employed on<br />

such production. There shall be no self-dealing in the application<br />

of this provision.<br />

Driver Gang Boss - The first “on” production Gang Boss employed<br />

by the shooting company shall be paid at the rate set forth in the<br />

wage schedule and shall be considered the primary Gang Boss.<br />

Such premium rate shall be limited to one such Gang Boss on the<br />

shooting company. All subsequent “on” production Gang Bosses<br />

hired and all “off” production Gang Bosses shall be employed at<br />

the rate set forth in the wage schedule designated as “all others.”<br />

The rate for Occ. Code No. 3502, All Other Gang Bosses, and Occ.<br />

Code No. 3543, Dispatcher, is $1.00 per hour above the rate for<br />

Occ. Code No. 3521.<br />

The rate for persons employed in Occ. Code No. 3502, All Other<br />

Gang Bosses, in the film processing laboratories shall be $33.62 per<br />

hour for the period July 29, 2012 to and including August 3, 2013;<br />

$34.29 per hour for the period August 4, 2013 to and including<br />
