The compliance by Producer with the conditions set forth in<br />

this Article 21 likewise constitutes compliance as to all the unions.<br />

(f) Notwithstanding anything herein to the contrary, the parties<br />

hereby confirm the following understanding and practices of the<br />

Producers with respect to the Supplemental Markets provisions:<br />

(1) Article 21 does not require a percentage payment to be<br />

made with respect to motion pictures on which the only employees<br />

employed under the Basic <strong>Agreement</strong> performed post-production<br />

(including editorial) work; and<br />

(2) Article 21 does not require percentage payments to be<br />

made with respect to motion pictures which are produced by a producer<br />

which is not signatory to the Basic <strong>Agreement</strong> or the Basic Crafts<br />

<strong>Agreement</strong>s.<br />

(g) If any other Union or Guild negotiates, as part of its<br />

collective bargaining agreement with the AMPTP, residuals on product<br />

for iPods or similar devices, the Producers will meet with the Basic<br />

Crafts Unions to negotiate an appropriate residual formula.<br />

ARTICLE 22.<br />

Labor-Management Meetings<br />

The Producers and the Union agree to reinstate meaningful labormanagement<br />

meetings. A labor-management standing committee shall<br />

be established jointly by the Basic Crafts and the Producers which shall<br />

meet quarterly or on call of either the Basic Crafts or the Producers. A<br />

pre-meeting conference shall be held to review the subject matter of the<br />

agenda.<br />

ARTICLE 23.<br />

Safety<br />

(a) It is agreed by the parties that too great an emphasis cannot<br />

be placed on the need to provide a safe working environment. In that<br />

context, it shall be incumbent on each employer (herein referred to as the<br />

Producer) to furnish employment and a place of employment which are<br />

safe and healthful for the employees therein; to furnish and use safety<br />

devices and safeguards, and adopt and use practices, means, methods,<br />

operations and processes which are reasonably adequate to render such<br />

employment and place of employment safe and healthful; to do every<br />

other thing reasonably necessary to protect the life, safety and health of<br />

employees. Correspondingly, no employer shall require or permit any<br />

employee to go or be in any employment or place of employment which<br />
