employment to or employ any person subject to this <strong>Agreement</strong> who<br />

shall have reached his normal retirement date and shall have retired<br />

under the provisions of the Retirement Plan for employees of<br />

Metro-Goldwyn-Mayer, Inc.<br />

(b) Notwithstanding any provision of this <strong>Agreement</strong> or of any<br />

other agreement between Technicolor, Inc. and the Basic Crafts Unions,<br />

Technicolor, Inc. shall not be required to offer employment or to employ<br />

any person subject to this <strong>Agreement</strong> who shall have reached his normal<br />

retirement date under the provisions of the Retirement Plan for<br />

employees of Technicolor, Inc.<br />

(c) Notwithstanding any provisions of this <strong>Agreement</strong> or of any<br />

other agreement between Twentieth Century-Fox Film Corporation and<br />

the Basic Crafts Unions, Twentieth Century-Fox Film Corporation shall<br />

not be required to offer employment to or employ any person subject to<br />

this <strong>Agreement</strong> who shall have reached his normal retirement date under<br />

the provisions of the Retirement Plan for employees of Twentieth<br />

Century-Fox Film Corporation and certain subsidiaries.<br />

ARTICLE 13B.<br />

Loan-Out Companies<br />

During such time as an employee is engaged by a borrowing<br />

Producer through the employee’s loan-out company, the borrowing<br />

Producer shall make pension and health and CSATF contributions<br />

directly to the Motion Picture Industry Health Plan and the Motion<br />

Picture Industry Pension Plan on behalf of the employee so employed<br />

based upon hours worked or guaranteed. Contributions may not be<br />

made by loan-out companies.<br />

ARTICLE 13C.<br />

401(k) Plan Feasibility Study<br />

A committee shall be established consisting of representatives of<br />

the Producers, the IATSE and the Basic Crafts Unions to conduct a<br />

study of the feasibility of establishing a 401(k) plan funded solely by<br />

employee salary deferrals for participants in the Motion Picture Industry<br />

Pension Plan. In particular, the study is to focus on the following:<br />

(a) Whether the establishment and administration of the plan will<br />

cause the Producers to incur increased costs.<br />

(b) Whether the Motion Picture Industry Pension and Health<br />

Plan would be able to administer the 401(k) plan as a separate plan.<br />
