Reference is made to Paragraph 50, "Promotions," of the 1988<br />

Producer-Studio Transportation Drivers, <strong>Local</strong> #<strong>399</strong> <strong>Agreement</strong>.<br />

During the 1988 negotiations between the Producers and <strong>Local</strong> #<strong>399</strong>,<br />

it was agreed that the Producers would not employ additional Gang<br />

Bosses as a subterfuge to avoid hiring drivers in accordance with<br />

the seniority provisions of the <strong>Agreement</strong>. At the same time, the<br />

parties recognized and acknowledged that there are situations in<br />

which more than one First "On Production" Gang Boss is legitimately<br />

employed on a production.<br />

It is impossible to set forth an exhaustive list of these situations.<br />

Accordingly, the following examples are mentioned in an<br />

effort to provide guidelines for the conduct of the industry in<br />

this area:<br />

(1) An additional First "On Production" Gang Boss may be<br />

properly employed on a production where production is scheduled<br />

to take place in diverse locations. For instance, a Producer may<br />

choose to employ a First "On Production" Gang Boss in Los Angeles<br />

and another in Seattle where production is scheduled in both cities.<br />

(2) An additional First "On Production" Gang Boss may be<br />

employed where there is more than one (1) shooting unit. As an<br />

example, in episodic television, when episodes are being shot<br />

"back-to-back," the Producer may employ a First "On Production"<br />

Gang Boss on the first episode and another on the second episode.<br />
