Program and shall bear sole responsibility for compliance with legallymandated<br />

alcohol and controlled substance testing<br />

(2) Each Consenting Producer agrees to comply with the<br />

procedures set forth in this Paragraph 85.1. Quarterly each year, CSATF<br />

shall provide the Union with a list of all Consenting Producers.<br />

(3) Each Consenting Producer shall inform CSATF of the<br />

identity or identities of any person or persons it has authorized to serve<br />

as a designated employer representative (“DER”). A DER is an<br />

individual identified by a Consenting Producer as being authorized to<br />

receive communications and test results from CSATF or other service<br />

agents, such as a medical review officer or substance abuse professional,<br />

and who is authorized to take immediate actions to remove employees<br />

from performing Safety-Sensitive Functions and to make required<br />

decisions in connection with the Testing Program. The DER must be an<br />

employee of the Consenting Producer.<br />

(4) It is understood that none of the provisions of this<br />

Paragraph 85.1 shall be applicable to any of the following: (i)<br />

individuals hired pursuant to the provisions of Paragraph 30 of this<br />

<strong>Agreement</strong>, (ii) employees of the Union, (iii) Location Managers who do<br />

not perform Safety-Sensitive Functions, (iv) Animal Trainers who do not<br />

perform Safety-Sensitive Functions, (v) Wranglers who do not perform<br />

Safety-Sensitive Functions or (vi) any dispatcher, autoservice person or<br />

mechanic who is specifically designated by a Consenting Producer as<br />

not being required to perform Safety-Sensitive Functions, at any time, in<br />

the course of performing services under this <strong>Agreement</strong> for such<br />

Consenting Producer (collectively “Excluded Employees”). It is agreed<br />

that each Producer, including each Consenting Producer, shall bear<br />

individual responsibility for compliance with alcohol and controlled<br />

substance testing mandates, if any, with respect to such Excluded<br />

Employees.<br />

(5) The cost of administering this Testing Program shall be<br />

borne by CSATF with contributions made by Producers.<br />

Testing Procedures<br />

CSATF shall maintain a list of approved collection facilities,<br />

including facilities located throughout as much of Los Angeles County<br />

It is understood that any entity operating under the Consenting Producer’s U.S.<br />

DOT number shall automatically be covered under the Consenting Producer’s<br />

Consortium <strong>Agreement</strong> without the necessity for separately completing, executing<br />

and returning to CSATF a Consortium <strong>Agreement</strong>.<br />
