(ii) On the last day of suspension, employee must contact<br />

the Producer from which employee was suspended for next day’s job<br />

assignment, if any.<br />

(c)<br />

Tardiness<br />

An employee who reports for work one-tenth of an hour or<br />

more after his or her call time will be deemed tardy. The following<br />

discipline will be administered for unexcused tardiness:<br />

(i)<br />

(ii)<br />

suspension.<br />

(iii)<br />

suspension.<br />

(iv)<br />

First offense: One day suspension.<br />

Second offense within any 12-month period: Three day<br />

Third offense within any 12-month period: Five day<br />

Fourth offense within any 12-month period: Discharge.<br />

NOTE: When practical, suspension shall start on the day the<br />

employee was tardy or on the employee’s next scheduled work day.<br />

(d)<br />

Meal Penalty<br />

No employee shall be entitled to meal penalties unless he or<br />

she has informed his or her supervisor, no less than one (1) hour prior to<br />

a meal penalty being triggered, that a meal period is due. The foregoing<br />

shall not apply when, under the circumstances, prior notice is<br />

impracticable.<br />

85.1. Alcohol and Controlled Substance Testing<br />

(a)<br />

Preamble<br />

U.S. Department of Transportation regulations set forth in<br />

Title 49 of the Code of Federal Regulations (“CFR”), Parts 40 and 382<br />

(the “DOT Regulations”) require employers of individuals who possess<br />

commercial drivers’ licenses and operate, or stand in readiness to<br />

operate, commercial motor vehicles to establish a program to test their<br />

drivers for alcohol and controlled substance use. Producers and the<br />

Union reaffirm their commitment to maintain a safe, healthful and<br />

efficient working environment and to comply with all applicable laws, as<br />

they now exist or may exist in the future, governing alcohol and<br />

controlled substance testing.<br />
