showing the names of those employees who have not claimed vacation<br />
pay and the amount of vacation pay due to each, together with a notice<br />
that unless claimed by July 15, such vacation pay will be sent to the<br />
Motion Picture Industry Pension Plan.<br />
(5) On or about July 15 of the second<br />
calendar year, unclaimed vacation pay will be contributed to the Motion<br />
Picture Industry Pension Plan and credited to the appropriate employee<br />
pension plan account. Money so contributed shall not be returned to the<br />
employee and shall fully discharge the Producer’s and Union’s<br />
obligations hereunder with respect to the payment of vacation pay.<br />
(iii) New signatory Producers shall adhere to the<br />
practice of paying vacation pay currently on a weekly basis unless other<br />
arrangements are made by them with the Union.<br />
67. Jurisdictional Disputes<br />
The Union agrees to cooperate in good faith with the Producer and<br />
other <strong>Local</strong> Unions in the industry in working out a method for the<br />
determination of jurisdictional disputes without work stoppages.<br />
Appropriate clauses shall be incorporated in this <strong>Agreement</strong> to cover any<br />
method or means that shall be agreed upon.<br />
68. Severance Pay<br />
(a)<br />
General<br />
(1) (i) An employee employed by the Producer under<br />
this <strong>Agreement</strong> or its predecessor agreements for one or more qualified<br />
years (as defined in subparagraph (f) hereof) whose employment is<br />
severed after August 1, 2012; or<br />
(ii) an employee who had at least one (1) qualified<br />
year (as defined in Paragraph 68(f) of this <strong>Agreement</strong>) as of August 1,<br />
1985 who has made the required application for retirement to the Motion<br />
Picture Industry Pension Plan at least sixty (60) days prior to retiring or<br />
has made the required application for retirement to any private<br />
retirement plan referred to in Article XV of the Trust <strong>Agreement</strong> of the<br />
Motion Picture Industry Pension Plan and who retires<br />
shall receive the applicable severance pay set forth below (as modified<br />
by subparagraphs (c) and (d) hereof) unless such employee is<br />
disqualified for severance pay purposes pursuant to subparagraph (e)<br />
hereof.<br />
