provision, an employee who has not worked in the classifications<br />

covered under this <strong>Agreement</strong> within a consecutive two (2) year period<br />

shall be deemed to have left the motion picture production industry for<br />

gainful employment elsewhere. Provided, however, this shall not<br />

include:<br />

(A) Any person who was employed by the<br />

International Brotherhood of <strong>Teamsters</strong> or any of its affiliated <strong>Local</strong><br />

Unions;<br />

(B) Any person who was employed in any<br />

capacity in the motion picture industry within such two (2) year period;<br />

or<br />

(C) Any person who had a work-related<br />

disability which prevented him from performing work assigned to<br />

craft(s) or classification(s) in which he was formerly employed.<br />

(vi) Retirement under the Motion Picture Industry<br />

Pension Plan or private company pension plan; provided, however, the<br />

Producer may continue to employ any such employee who retired prior<br />

to August 1, 1991 as though he/she had not been removed from the<br />

Studio Seniority Roster.<br />

(vii) Death.<br />

(viii) Unauthorized leave of absence. An employee<br />

hereunder shall not be granted a leave of absence for the purpose of<br />

accepting employment with another employer in the motion picture<br />

production industry in a job classification covered by this <strong>Agreement</strong>,<br />

unless such action is mutually acceptable to the Producer, the employee<br />

and the Union.<br />

(ix) An employee on Producer’s Studio Seniority<br />

Roster who has been suspended from work by such Producer and who<br />

accepts work with another Producer while on suspension shall forfeit his<br />

Studio Seniority with the Producer by whom he was suspended.<br />

(x) Absence because of illness or injury exceeding<br />

two (2) years, provided Union receives prior written notice before the<br />

employee is taken off the Roster.<br />

(2) A person shall be removed by the Producer from its<br />

Industry Experience Roster for any of the following reasons:<br />
