(4) Industry Group 3: then, next, preference shall be given<br />
to such available, qualified persons who are in Industry Group 3.<br />
(5) Others: In the event that there are insufficient<br />
available, qualified persons from such respective related job<br />
classifications grouping who are in the respective seniority calendar<br />
years, or the respective Industry Groups 1, 2 or 3 to meet the<br />
employment requirements of the Producer in such respective related job<br />
classifications grouping, then Producer may secure employees from any<br />
source.<br />
Notwithstanding the foregoing, in the event that two<br />
percent (2%) or fewer of the persons in Industry Group 1 are available<br />
for work, the Call Board may dispatch persons in Industry Group 2.<br />
Similarly, when two percent (2%) or fewer of the persons in Group 2 of<br />
the Industry Experience Roster are available for work, the Call Board<br />
may dispatch persons in Industry Group 3.<br />
Notwithstanding the foregoing, the parties agree that<br />
their past practice with regard to the selection of cook/drivers and<br />
drivers of special equipment shall continue.<br />
(6) Call Board: With respect to such calling and recalling,<br />
the Producer may notify the <strong>Local</strong> Union of its need to fill calls for<br />
“extra” employees in such respective classifications grouping and may<br />
also specifically request particular named persons from the Industry<br />
Experience Roster. Upon such notice or request, the <strong>Local</strong> Union will<br />
undertake to obtain and dispatch to Producer such persons so<br />
specifically requested or, on the other hand, when persons are not so<br />
requested, any available, qualified eligible persons, as the case may be,<br />
from the appropriate Industry Experience Groups in accordance with the<br />
above preference of employment provisions. Producer reserves the right<br />
to select those to be hired or rehired, as the case may be, from among<br />
such eligible persons who are so dispatched to Producer as above<br />
provided. Neither as to such undertaking or dispatching by the Union<br />
nor as to any other portion of this <strong>Agreement</strong> will the Union discriminate<br />
either in favor of or against any person because of membership or<br />
non-membership in the Union. Producer shall not in any manner be<br />
liable hereunder for any alleged violation of this Paragraph 62 because<br />
of the Producer’s employment of any person through the dispatching<br />
facilities of the Union, as above provided. The <strong>Local</strong> Union agrees to<br />
keep its offices open Monday through Friday during such hours as may<br />
be required to adequately service the Producer. Notwithstanding<br />
anything herein to the contrary, an employee on Producer’s Studio<br />
Seniority Roster and/or Industry Experience Roster who has been<br />
