preference and the International Brotherhood of <strong>Teamsters</strong> and such<br />
<strong>Local</strong> Union shall not in any manner discipline or threaten with<br />
discipline any such foreman or supervisory employee for failing or<br />
refusing to give or recommend any such unlawful employment<br />
preference.<br />
62. Seniority<br />
(a)<br />
Maintenance of the Studio Seniority Roster<br />
Except as provided in Paragraph 68(a)(2) of the 1988 <strong>Local</strong><br />
#<strong>399</strong> <strong>Agreement</strong> and in Paragraph 68(a)(2) of the 2001 <strong>Local</strong> #<strong>399</strong><br />
<strong>Agreement</strong>, the Producer has established and will maintain a separate<br />
Studio Seniority roster for each respective classification grouping as<br />
described in Sections (d)(1), (2), (3), (4) and (5) below of this Paragraph<br />
62. Each such Roster shall be composed of those persons in such<br />
classification grouping who were on the Seniority Roster as of July 31,<br />
1991. Such persons shall be listed on such respective grouping Seniority<br />
Roster hereunder in the order of their seniority, based on the calendar<br />
year in which they were assigned to said Seniority Roster.<br />
An employee who is removed or terminated from the Studio<br />
Seniority Roster, as provided in subparagraph (f) of this Paragraph 62,<br />
shall not be replaced and no further additions shall be made to such<br />
Roster.<br />
(1) One Roster Only: No person who is registered on any<br />
one grouping Seniority Roster as above provided shall be eligible for<br />
any other grouping Seniority Roster, and no person who is registered on<br />
any other Motion Picture Producer’s “Seniority Roster,” as herein<br />
defined, shall be eligible for any other “Seniority Roster” hereunder.<br />
Each applicant for a Seniority Roster at the time of application shall<br />
certify in writing that he/she is not on any other grouping Seniority<br />
Roster or on any such other Motion Picture Producer’s Seniority Roster.<br />
(2) Dispatcher: Notwithstanding anything herein contained<br />
to the contrary, the following shall apply:<br />
(i) A Dispatcher on the Dispatcher Studio Seniority<br />
Roster shall have the right to make, in writing to the Producer, one<br />
election only to be transferred from such Dispatcher Roster to the Driver<br />
Studio Seniority Roster. Upon making such election, such Dispatcher<br />
shall thereupon be placed on the Driver Studio Seniority Roster as of the<br />
studio seniority year that either (A) he/she had, if any, on the Driver<br />
Studio Seniority Roster, as of the date he was transferred to the<br />
Dispatcher Studio Seniority Roster, or (B) he/she has on the Dispatcher<br />
