ART. IX, SEC. 9<br />
(b) are politically motivated, or (c) were filed in bad faith<br />
in an attempt to embarrass or destroy the Union or the<br />
Union officer or representative, or (2) if a majority of the<br />
General Executive Board in its sole discretion determines<br />
that the expenditures should be made.<br />
(b). The provisions set forth in subsection (a) above<br />
shall also apply to such expenditures made by all affiliates<br />
other than <strong>Local</strong> Unions if the appropriate governing<br />
body of the affiliate in its sole discretion determines<br />
that the expenditures should be made.<br />
(c). A <strong>Local</strong> Union is authorized to pay any and all<br />
the above expenditures in any cause, matter, case, or<br />
cases where an officer, representative, employee, agent,<br />
or one charged with acting on behalf of the <strong>Local</strong> Union<br />
is charged with any violation or violations of any law or<br />
is sued in any civil action or actions (1) if a majority of<br />
the <strong>Local</strong> Union Executive Board in its sole discretion,<br />
subject to the approval of a majority of the members<br />
present and voting at a regular meeting (or a majority of<br />
all the members present and voting at all the regular,<br />
craft, or divisional monthly meetings held in lieu of a<br />
single monthly regular meeting) determines that said<br />
charges or lawsuits (a) are unfounded, or (b) are politically<br />
motivated, or (c) were filed in bad faith in an<br />
attempt to embarrass or destroy the Union or the Union<br />
officer or representative, or (2) if a majority of the <strong>Local</strong><br />
Union Executive Board in its sole discretion subject to<br />
the approval of a majority of the members present and<br />
voting at a regular meeting (or a majority of all the members<br />
present and voting at all the regular, craft, or divisional<br />
monthly meetings held in lieu of a single monthly<br />
regular meeting) determines that the expenditures<br />
should be made.<br />
