ART. XXII, SEC. 8-9<br />

<strong>Local</strong> Union Bylaws adopted at the time of the adoption<br />

of the 1981 <strong>Constitution</strong> contained provisions permitting<br />

such election. Elected Business Agents and elected<br />

Assistant Business Agents may be removed only according<br />

to the trial procedures set forth in this <strong>Constitution</strong> or<br />

<strong>Local</strong> Union Bylaws. After the date of adoption of the<br />

1981 <strong>Constitution</strong>, no <strong>Local</strong> Union may amend its Bylaws<br />

to provide for the election of Business Agents, Assistant<br />

Business Agents, or other <strong>Local</strong> Union employees other<br />

than the officers comprising the <strong>Local</strong> Union Executive<br />

Board.<br />

Vacancies<br />

Section 9. The <strong>Local</strong> Union Executive Board and the<br />

Executive Board and/or the Policy Committee of all other<br />

subordinate bodies shall determine when a vacancy exists<br />

due to the temporary unavailability of an elected officer;<br />

provided however, that if an officer is unavailable for<br />

twelve (12) months or more, the office shall be considered<br />

to be vacant. When an office has been determined to be<br />

vacant, the Executive Board shall fill the vacancy by<br />

appointment for the entire remainder of the unexpired<br />

term. Vacancies in the position of elected Business Agents<br />

or elected Assistant Business Agents shall be filled by<br />

appointment by the person or persons designated in the<br />

<strong>Local</strong> Union Bylaws.<br />

In the event the <strong>Local</strong> Union Executive Board is evenly<br />

divided in its recommendation for the appointment to<br />

fill a vacancy in an elected office, the vacancy shall be<br />

filled by a vote of the <strong>Local</strong> Union membership under the<br />

same provisions and requirements for the election of <strong>Local</strong><br />

Union officers as set forth in this <strong>Constitution</strong>.<br />

No officer may run for another office in his <strong>Local</strong><br />
