ment, or otherwise, beyond the expiration of the term of<br />

the Executive Board in office at the time such action is<br />

taken. This shall not prevent a <strong>Local</strong> Union Executive<br />

Board from entering into a bona fide collective bargaining<br />

agreement with another union covering <strong>Local</strong> Union<br />

employees; provided, however, that if the <strong>Local</strong> Union<br />

employees form a union following the <strong>Local</strong> Union election,<br />

or a new collective bargaining agreement covering<br />

such employees is negotiated after the <strong>Local</strong> Union election,<br />

the newly organized unit shall not be recognized, or<br />

the new collective bargaining agreement shall not be<br />

entered into on behalf of the <strong>Local</strong> Union, until such<br />

action is approved by the officers-elect.<br />

Terms of Office<br />

Section 3(a). The term of office of <strong>Local</strong> Union officers<br />

and elected Business Agents shall be no longer than<br />

that of International officers or that provided for by law<br />

and shall not be for a lesser period than three (3) years,<br />

except where necessary to bring the terms of office of all<br />

officers into concurrence or in order to provide for a<br />

schedule of nominations and elections in accordance<br />

with Article XXII, Section 4(a).<br />

(b). When an election is held in connection with the<br />

release of a <strong>Local</strong> Union from Trusteeship, the terms of<br />

the officers elected shall commence as of the effective<br />

date the <strong>Local</strong> Union is formally released from<br />

Trusteeship by the General President and shall terminate<br />

on December 31 of the second full year thereafter,<br />

unless the <strong>Local</strong> Union may legally have a term of office<br />

of four or five years and the <strong>Local</strong>’s Bylaws so provide.<br />

In such cases, the term of office shall terminate on<br />

December 31 of the third or fourth full year following<br />

release from Trusteeship, whichever is applicable.<br />
