Section VII Internet Banking Please note carefully the Customer security duties set out in Clauses 3 and 10 below. If the Customer breaches any of the Customer security duties, the Customer may be liable for the transactions even if the Customer did not authorise them. TERMS AND CONDITIONS FOR PERSONAL INTERNET BANKING. These Terms and Conditions (“Terms”) explain the Customer’s responsibilities and obligations relating to services and information that the Customer uses or request from the Bank, or the Bank provides the Customer, through HSBC’s Personal Internet Banking service. 1. Applicable terms a. The Terms may be accepted online by following the Instructions set out on the relevant page. In addition the Customer agrees that any use of the services shall constitute the Customer acceptance of the Terms and Conditions. b. When the Customer uses the services, the Customer must comply with these Terms and Conditions and other applicable terms, including the Terms and Conditions relating to the Customer account, the website from which the Customer accesses the services and services that the Bank sources from other parties. The Customer must pay all applicable fees, including the Bank’s standard transaction fees. c. If this Terms and Conditions contradict other applicable terms, these Terms and Conditions will (in relation to the Customer use of the services) override those other terms to the extent that there is a contradiction. 2. The Customer Security duties a. The Customer agrees to comply with the Terms and follow the guidance and any security procedures mentioned therein and provided by us online. b. To use the Services, the Customer will need a unique identifier (“Username”), a Password and a Security Device (“Security Device”). c. It is the Customer sole responsibility to apply for a replacement if a Security Device has previously been issued but is subsequently lost or has failed to function. d. The Customer agrees to follow the guidance provided by us in designating the Username, the Password, Password Reset Questions, Security Code and any other authentication instructions from us to identify the Customer. e. For Offline Reset Password, the Customer may change the Password at any time but any change shall be effective only if accepted by us. f. To reset the Customer password online, the Customer needs to provide us with the Customer username, complete the Password Reset Questions, and provide authentication using the Security Device. g. The Bank may use the Customer Username, Password, Password Reset Questions and/or Security Code to identify the Customer. Clause 10 sets out the Customer liabilities for everything that is done with the Customer Username, Password, 38
Password Reset Questions and Security Code. h. The Customer must keep the Customer Password secret and secure at all times and exercise reasonable care and diligence to prevent unauthorised use of the Customer Username, Password, Password Reset Questions, Security Device and Security Code. At no time and under no circumstances shall the Customer permit the Security Device to come into the possession or control of any other person(s). i. Once the Customer has logged on to the service, the Customer must not leave the terminal or other device from which the Customer has accessed the service at any time or let anyone else use it until the Customer has logged off the service using the log off option. The Customer will be responsible for ensuring that the Customer have logged off the service at the end of each session. j. The Customer must notify us immediately of any unauthorised access to the Services or any unauthorised transaction or instruction that the Customer know of or suspect or if the Customer suspects someone else knows the Customer Username, Password, Password Reset Questions, Security Code or has unauthorised possession, control or use of the Security Device. The Customer may do so in person or by calling the telephone number(s) listed on the website. The Bank may ask the Customer to confirm in writing any details given. The Customer must also change the Customer Password immediately to a number or combination that the Customer has not used before. Until the actual receipt of such notification, the Customer shall remain responsible for any and all use of the Services by unauthorised persons or for unauthorised purposes. The Bank will require the Customer to help the police and the Bank in trying to recover any losses. The Bank may disclose information about the Customer, or their Account(s) to the police or other third parties if the Bank believes it will help prevent or recover losses. k. The Bank may have to ask the Customer for the Customer Username Internet Banking ID, but not the Customer Password, in order to provide maintenance services to the Customer. If the Customer supplies the Bank with the Customer Username Internet Banking ID, the Bank will keep it secure. NEVER REVEAL THE PASSWORD TO ANYONE, not even an employee of the Bank. l. The Customer agrees to be responsible for the performance and protection of any browser or Personal Computer used in connection with the service. m. The Customer agrees to check carefully their records of transactions and Statements of Accounts and to inform the Bank immediately of any discrepancy. 3. Instructions relating to the services a. The Customer requests and authorises the Bank to (a) rely and act upon all valid Instructions authorised by the Customer, even if they may conflict with another mandate given at any time concerning the Customer’s Accounts and (b) debit the Customer Accounts with any amount the Bank has paid or incurred with any Instructions. b. An Instruction will be considered as authenticated and accepted by the Bank if it has been effected through the services using an appropriate Username, Password, Password Reset Questions and/or Security Code, and any other additional verification imposed by us, if applicable. c. These <strong>Terms</strong> and <strong>Conditions</strong> (“<strong>Terms</strong>”) explain the Customer’s responsibilities<br />

applicable fees, including the Bank’s standard transaction fees.<br />
c. If this <strong>Terms</strong> and <strong>Conditions</strong> contradict other applicable terms, these <strong>Terms</strong> and<br />
<strong>Conditions</strong> will (in relation to the Customer use of the services) override those other<br />
terms to the extent that there is a contradiction.<br />
2. The Customer Security duties<br />
a. The Customer agrees to comply with the <strong>Terms</strong> and follow the guidance and any<br />
security procedures mentioned therein and provided by us online.<br />

Password and a Security Device (“Security Device”).<br />
