XI. Recommendations<br />
To the Government of Sri Lanka<br />
• End the practice of enforced disappearances by the security forces and progovernment<br />
armed groups, including the Karuna group, and EPDP, and<br />
prosecute those responsible.<br />
• Make public the names of all persons detained by the military and police<br />
under Emergency Regulations and other laws, and provide those detained<br />
prompt access <strong>to</strong> their families and legal counsel.<br />
• Make public the reports of the Presidential Commission on Abductions,<br />
Disappearances and Killings (Tillakaratne Commission).<br />
• Sign and ratify the International Convention for the Protection of All Persons<br />
from Enforced Disappearance.<br />
• Bring an end <strong>to</strong> <strong>to</strong>rture, arbitrary arrest and detention, and extrajudicial<br />
executions by state security forces and pro-government armed groups.<br />
• Institute disciplinary proceedings or prosecute as appropriate members of the<br />
security forces implicated in human rights abuses, including individuals<br />
criminally responsible as a matter of command responsibility when superiors<br />
knew or should have known of ongoing crimes but failed <strong>to</strong> take action.<br />
• Bring an end <strong>to</strong> child abductions by the Karuna group, and ensure that<br />
abducted children and young men are released and returned <strong>to</strong> their families.<br />
• Cease using the Emergency Regulations for arbitrary arrests, including<br />
interference with media, humanitarian NGOs, and other civil society<br />
organizations.<br />
• Cease the forcible return of internally displaced persons and instead work<br />
with displaced communities <strong>to</strong> provide for genuinely voluntary and safe<br />
returns.<br />
• Cooperate with humanitarian agencies <strong>to</strong> ensure that they are able <strong>to</strong> obtain<br />
access <strong>to</strong> populations at risk, including those in areas of LTTE control;<br />
• Work with donor governments <strong>to</strong> establish an international human rights<br />
moni<strong>to</strong>ring mission under United Nations auspices <strong>to</strong> moni<strong>to</strong>r violations of<br />
human rights and international humanitarian law by all parties <strong>to</strong> the conflict;<br />
• Ratify the Rome Statute of the International Criminal Court.<br />
