PRAVOBRANITELJ PACIJENATA – PRO ET CONTRA<br />
Autor u radu raspravlja o mogućnostima uvođenja u naše zdravstveno<br />
pravo novoga pravnog instituta ombudsmana, odnosno pravobranitelja za<br />
pacijente. O ovim pitanjima raspravlja i sa stajališta važeće zdravstvene legislative.<br />
Razmatrajući navedena pitanja, autor je građu sistematizirao tako<br />
da u prvom dijelu rada iznosi sadašnje stanje – pravno i stvarno – zdravstvene<br />
djelatnosti i daje ocjenu sadašnjeg stanja. Zatim iznosi polazište<br />
pro et contra uvođenja ombudsmana, registrirajući i argumente oponenata.<br />
Autor pledira u korist ombudsmana i izražava stajalište da je zahtjev za<br />
njegovo uvođenje inherentan s važećim zdravstvenim sustavom; on iz njega<br />
nužno proizlazi. De lege ferenda osvrće se u bitnome na sadržaj rada i<br />
postupovne odredbe pravobranitelja za pacijente, iako je to sedes materiae<br />
poslovnika pravobranitelja.<br />
PATIENT OMBUDSMAN – PRO ET CONTRA<br />
The author discusses the possibilities of introducing the new legal<br />
institute of ombudsman, i.e. patient ombudsman, into Croatian medical<br />
legislation. These issues are also presented from the point of view of the<br />
medical legislation in force. In the first part of the paper, the author outlines<br />
and assesses the current state – both legal and actual – of the medical<br />
profession. In the second part, he states the pro et contra reasons for<br />
introducing the ombudsman, taking also into consideration the opponents’<br />
arguments. The author is in favour of and advocates the ombudsman, and<br />
further claims that the request for the introduction of this institute is inherent<br />
to the medical system in force. Moreover, it is its direct consequence.<br />
De lege ferenda points to the subject matter and procedural provisions of<br />
the patient ombudsman, although it is sedes materiae of the ombudsman’s<br />
rules of procedure.<br />
