DETERMINISM AND FREE WILL IN THE AGE OF GENETICS<br />
Theoretical-Legal Concerns about Predictive Genetic Tests<br />
Every scientific discovery in genetics is very often publicized either<br />
with enthusiasm or with scepticism. A very heated debate concerns the<br />
important yet controversial topic of predictive genetic tests, which predict<br />
susceptibility, not the certainty of developing a certain disease. Many ethical<br />
questions arose with regard to political, criminal and social decisions<br />
based on the feeble assumption of susceptibility.<br />
In general, the topic of genetic tests has a transverse meaning as it can<br />
be considered a particular element of a bigger puzzle dealing with fundamental<br />
topics: the relationship between science and law and the relationship<br />
between determinism and freewill. The paper deals mainly with the<br />
use of predictive genetic tests in medical research, within a philosophical<br />
framework based on the Is-Ought Question and on the meta-ethical view<br />
of non-cognitivism and non-objectivism, which is used to evaluate legal<br />
provisions in this topic at different levels.<br />

Teorijsko-zakonski osvrt na prediktivne genetičke testove<br />
Svako znanstveno otkriće u genetici često se objavljuje ili s entuzijazmom<br />
ili sa skepticizmom. Žučna rasprava bavi se važnom iako kontroverznom<br />
temom prediktivnih genetičkih testova, koji predviđaju podložnost,<br />
ali ne i potpunu izvjesnost za razvoj određene bolesti. Nejaka pretpostavka<br />
podložnosti inicira mnoga etička pitanja povezana s političkim, kaznenim i<br />
socijalnim odlukama donesenima na temelju te pretpostavke.<br />
Općenito, tema genetičkih testova ima transverzalan značaj budući da<br />
se može smatrati određenim elementom veće slagalice koja se bavi temeljnim<br />
pitanjima: vezom između znanosti i prava te vezom između determinizma<br />
i slobodne volje. Izlaganje se većim dijelom bavi uporabom prediktivnih<br />
genetičkih testova u medicinskim istraživanjima, unutar <strong>filozofsko</strong>g<br />
