Nemzeti úton 299 új formatervezésiminta-oltalmi
bejelentés érkezett a hivatalhoz, amelyek 899 mintát
foglaltak magukban. A hazai bejelentői aktivitás
erőteljes élénkülését jelzi, hogy a hazai bejelentések
48%-kal, a bejelentett minták száma több mint 7%-
kal növekedett az előző évhez képest. A bejelentők
éltek a több mintát tartalmazó bejelentések lehetőségével:
a bejelentésekben foglalt minták átlagos
száma 3 volt. A hazai bejelentések 68%-a egyéni
bejelentőktől származott.
A nemzeti engedélyezési eljárásban a befejezett bejelentések
száma 311 volt, ami 1089 mintát érintett;
a lajstromozások száma 242 volt, ami 951 mintát jelentett;
az eljárás 3 ügyben visszavonással, illetve
66 ügyben visszavontnak tekintéssel zárult. A hivatalba
6 megsemmisítési és 2 nemleges megállapítás
iránti kérelem érkezett. Az eljárás 7 megsemmisítési
kérelem és 1 nemleges megállapítás iránti kérelem
ügyében zárult le; az év végén 8 tanácsi ügy
volt folyamatban.
Az év végén 3881 nemzeti formatervezési minta
oltalma volt hatályban, 7%-kal több az előző évinél.
A hatályos mintaoltalmak jogosultjainak 77%-a magyar,
9%-a amerikai, 3%-a német volt. A hatályos
formatervezésiminta-oltalmak 59%-a 5 éves vagy
annál „fiatalabb”.

2.5. DESIGNS
Both the number of international design applications under the Hague Agreement and that of the included
designs decreased by 52% and 57%, respectively compared with the previous year. The HPO received 144
international applications, which included 547 designs. Although the amount of Community design
applications with an effect extending also to Hungary remained on the level of the previous year, that of the
included designs rose by 4%: 72 750 designs were included in 18 751 Community applications.
The HPO received 299 new design applications filed following the national route, which included 899
designs. The sharp upturn in the domestic applicants’ activity is shown by the fact that the number of
domestic applications increased by 48%, that of the designs increased by more than 7% compared with
the previous year. Applicants availed themselves of the possibility of applications containing more designs:
the average number of designs included in the applications was 3. Of the domestic applications 68% came
from individual applicants.
In national granting procedures 311 cases were completed, which concerned 1089 designs; the number of
registrations was 242, which concerned 951 designs. The procedure ended in withdrawal in 3 cases and
66 cases were considered withdrawn. In 2008, the HPO received 6 requests for invalidity and 2 for
declaration on non-infringement. The procedure was completed concerning 7 requests for invalidity and 1
request for declaration on non-infringement. At the end of the year 8 cases were pending before a board.

2.6. TRADEMARKS
In 2008, 4132 international trademark applications were received under the Madrid Agreement. As a consequence
of the draining effect of the Community trademark system, the number of international applications
was down by 9%, compared with the previous year. More than 87 000 Community trademark
applications also covering Hungary were filed with the OHIM. Hungarian applicants filed 277 Community
trademark applications, and 168 international (under the Madrid Agreement) applications.
