GYORSÍTÁSI KALAUZ<br />
A szabadalmaztatási eljárás gyorsítása szempontjából alapvető fontosságú, hogy a benyújtott bejelentés<br />
megfelelő módon legyen elkészítve. A sza bályszerű bejelentés elkészítésével biztosítható a bejelentési<br />
nap elismerése, elkerülhető az alaki felhívás szükségessége, és az érdemi vizsgálat is lerövidíthető.<br />
Az írásos véleménnyel kiegészített újdonságkutatás lehetősége több szempontból is előnyös a bejelentők<br />
számára. Gyorsabban, hat hónapon belül el ké szül az újdonságkutatás, amelyhez indokolást is<br />
tartalmazó előzetes vélemény társul az újdonság, a feltalálói tevékenység és az ipari alkalmazhatóság<br />
kérdésében.<br />
A bejelentő kérelmére a bejelentés korábbi idő pontban is közzétehető, így a 18 hónap elteltével esedékes<br />
közzététel ideje előbbre hozható. Az érde mi vizsgálat legkésőbb az újdonságkutatás el vég zéséről<br />
közölt hatósági tájékoztatás napjától szá mított hat hónapon belül kérhető, de a bejelentő akár már a bejelentéssel<br />
egy időben is kérheti, hogy a hivatal minél előbb megkezdhesse azt.<br />
Az újdonságkutatás és a közzététel után a hivatal megkezdi a bejelentések érdemi vizsgálatát. A bejelentők<br />
differenciált igényeihez alkalmazkodva a hivatal azoknak a bejelentéseknek az érdemi vizsgálatát<br />
intézi soron kívül, ahol a bejelentő gyorsan szeretne szabadalmat kapni. Azokban az ügyekben tehát,<br />
amelyeknél a bejelentő gyorsítani kívánja az engedélyezési eljárást, a hivatal szükség esetén a lehető<br />
leggyorsabban érdemi felhívás(oka)t ad ki, és a megadással járó teendőket (a megadás alap jául szolgáló<br />
változat kiküldése, felhívás a meg adá si díj megfizetésére) is a lehető leggyorsabban elvégzi.<br />
Amennyiben a bejelentő és a hivatal egyaránt megteszi a megfelelő lépéseket a gyors engedélyezés érdekében,<br />
az átfutási idő a következőképpen alakulhat. A bejelentés benyújtását követő vizsgálatot és<br />
az újdonságkutatáshoz és a közzétételhez szükséges részleges alaki vizsgálatot 1-3 hónap alatt végzi<br />
el a hivatal, és a 3-6. hónapban elkészül, majd kiküldésre kerül az írásos véleménnyel kiegészített újdonságkutatási<br />
jelentés. Ezután vagy ezzel párhuzamosan (kb. 5-8. hónap) megtörténhet a korábbi<br />
közzététel, és ezt követően elkezdődhet az érdemi vizsgálat. A felhívások számától és a válasziratok<br />
beérkezésétől függően a 10-11. hónaptól kezdődően befejeződhet az engedélyezési eljárás.<br />

use of the patent search services of the HPO offered against payment (novelty search, novelty search with<br />
preliminary patentability report, preliminary patentability report) may also assist in establishing wellfounded<br />
decisions concerning patent applications, thus, may contribute to the acceleration of the procedure.<br />
In the trademark field there also occurred a greater demand for shortening of the processing time. The HPO<br />
achieved significant results in the framework of its comprehensive programme launched in 2006. In respect<br />
of national trademark applications the period up to publication dropped from the earlier 12 months to 3.5<br />
months, while the average duration of the whole procedure was reduced from 18 months to 9.8 months. It<br />
is important to note that clients themselves may shorten the duration of the procedure if they prepare their<br />
trademark applications with due care, thus significantly reducing the risks of formal or substantial obstacles<br />
which may delay the procedure. Therefore, it may bear special importance if the client makes a search prior<br />
to filing the application to investigate if the sign for which protection is sought conflicts with an earlier<br />
trademark. The HPO, by its services, may assist the client already prior to the filing of the trademark<br />
application. It can also mean a step forward if the client pays the fee for filing simultaneously with the filing<br />
of the application or directly after it, thus gaining a two-month advantage.<br />
In addition to this, from 1 May 2004 it became possible to request that the HPO examine the trademark<br />
application in an accelerated procedure. In this case the HPO does its utmost to complete the procedure<br />
within six months. The accelerated procedure proved to be popular as in 2007 almost 10% of all the national<br />
trademark applications were requested to be examined in such a procedure. The HPO, however, realised<br />
that even this period may prove to be lengthy, in international comparison, for certain market players,<br />
therefore, on 1 January 2007 a procedural model with a brand new approach was implemented, which<br />
opened the way to the completion of the granting procedure within 1-1.5 months. The fast-track procedure,<br />
similarly to the accelerated procedure, may only be ordered by the HPO upon special request. The new tool<br />
proved to be successful primarily with the businesses for which monitoring the fast market changes is<br />
inevitable. Clients also took this opportunity with success when establishing proprietorship in the mark<br />
was pressing due to a legal dispute in the background.<br />
As regards meeting the diverse needs of clients not only the acceleration of the procedure for registration of<br />
trademarks may assume great significance but also individual and general interests may lie in a fast completion<br />
of the so-called status procedures concerning the validity of protection. The HPO, therefore, paid special<br />
