where there is public access, places of employment, public transport and car parking<br />

schemes and where practical in alterarations to existing developments.<br />

GEP3: States that in considering applications, regard will be given to the need for the<br />

design and layout to incorporate measures to reduce crime and the fear of crime.<br />

GEP9: States that the <strong>Borough</strong> <strong>Council</strong> will seek contributions from developers for<br />

the provision of additional works deemed to be required as a result of the<br />

development. The policy lists examples of works for which contributions will be<br />

sought.<br />

Rec13: States that late night uses will be permitted only within the Church Street<br />

mixed use area, or the southwest area of the Marina subject to criteria relating to<br />

amenity issues and the function and character of these areas. Developer<br />

contributions will be sought where necessary to mitigate the effects of developments.<br />

Rec9: States that a network of recreational routes linking areas of interest within the<br />

urban area will be developed and that proposals which would impede the<br />

development of the routes will not be permitted.<br />

To1: States that this area will continue to be developed as a major tourist attraction<br />

and that the <strong>Borough</strong> <strong>Council</strong> will seek to protect the areas of water from<br />

development.<br />

Planning Considerations<br />

10.9 This application has been outstanding for some time in an attempt to negotiate<br />

a satisfactory scheme. There are still a number of issues outstanding which have<br />

yet to be resolved and discussions at officer level are continuing to be able to<br />

crystallise the <strong>Council</strong>’s position at appeal. These will therefore be discussed fully in<br />

an update report to follow. The issues relate to: design; siting; contamination;<br />

parking; access; drainage; coastal walkway; sea wall and lock, maintenance and<br />

harbour and boatlift access.<br />
