potentially unacceptable risks arising from contamination at the site. Should<br />

the above criteria be resolved, no objections would be raised subject to a<br />

number of standard conditions.<br />

Tees Valley Regeneration – A condition of any development must be that<br />

sufficient provision is made for the coastal walkway.<br />

Traffic and Transportation – Object to the application on the grounds of<br />

parking. Existing car park on the Marina is at capacity, the proposed car<br />

parking does not meet standards and incorporates two spaces which are<br />

inaccessible. A suitable access has failed to be provided.<br />

Planning Policy<br />

10.8 The following policies in the adopted <strong>Hartlepool</strong> Local Plan 2006 are relevant to<br />

the determination of this application:<br />

Com12: States that proposals for food and drink developments will only be permitted<br />

subject to consideration of the effect on amenity, highway safety and character,<br />

appearance and function of the surrounding area and that hot food takeaways will<br />

not be permitted adjoining residential properties. The policy also outlines measures<br />

which may be required to protect the amenity of the area.<br />

Com4: Defines 10 edge of town centre areas and indicates generally which range of<br />

uses are either acceptable or unacceptable within each area particularly with regard<br />

to A1, A2, A3, A4, A5, B1, B2, & B8 and D1 uses. Proposals should also accord<br />

with related shopping, main town centre uses and recreational policies contained in<br />

the plan. Any proposed uses not specified in the policy will be considered on their<br />

merits taking account of GEP1.<br />

Dco2: States that the <strong>Borough</strong> <strong>Council</strong> will pay regard to the advice of the<br />

Environment Agency in considering proposals within flood risk areas. A flood risk<br />

assessment will be required in the Environment Agency's Flood Risk Zones 2 and 3<br />

and in the vicinity of designated main rivers. Flood mitigation measures may be<br />

necessary where development is approved. Where these are impractical and where<br />

the risk of flooding on the land or elsewhere is at a level to endanger life or property,<br />

development will not be permitted.<br />

GEP1: States that in determining planning applications the <strong>Borough</strong> <strong>Council</strong> will<br />

have due regard to the provisions of the Development Plan. Development should be<br />

located on previously developed land within the limits to development and outside<br />

the green wedges. The policy also highlights the wide range of matters which will<br />

be taken into account including appearance and relationship with surroundings,<br />

effects on amenity, highway safety, car parking, infrastructure, flood risk, trees,<br />

landscape features, wildlife and habitats, the historic environment, and the need for<br />

high standards of design and landscaping and native species.<br />

GEP2: States that provision will be required to enable access for all (in particular for<br />

people with disabilities, the elderly and people with children) in new developments<br />
