Noise and Disturbance<br />

3.12 The proposed variation of the condition to allow the operation of the site<br />

between April to January inclusive is not considered to have a detrimental affect on<br />

the surrounding area in terms of noise and disturbance. The site is surrounded by<br />

mature hedging and there is a degree of separation between the site and<br />

neighbouring properties, which are scattered around the vicinity. Given that the site<br />

is approved to be operational between March to October, and no objections have<br />

been received in terms of noise and disturbance since it has become operational<br />

(March 2008), it is considered difficult to substantial an objection to the additional 2<br />

months proposed. Public Protection has not objected to the variation of this<br />

condition.<br />

3.13 With regard to the provision of an acoustic fence the site has been operational<br />

since March 2008 and no objections have been received by Public Protection in<br />

terms of noise and disturbance. Public Protection have no objection to this acoustic<br />

fence not being provided and given the amount of screening around the site and<br />

separation distances between the site and surrounding properties it would be difficult<br />

to sustain an objection to the removal of this condition. With regard to the letter of<br />

comment suggesting that the condition should not be enforced but reviewed in 4<br />

years time consideration has been given to this proposal however the basis for<br />

imposing conditions are that they must be reasonable and necessary. It is<br />

considered difficult to substantiate rewording the condition to be reviewed given no<br />

objection has been received regarding noise and disturbance.<br />

Other Issues<br />

3.14 Concerns have been raised regarding the viability of the site during the<br />

additional months proposed, however the <strong>Council</strong>’s Tourism officer has assessed the<br />

proposal and has no objection, particularly as it will extend the visitor season to<br />

<strong>Hartlepool</strong> and therefore the visitor economy at a potentially quieter period.<br />

3.15 Concerns have been expressed by both objectors and the Dalton Piercy Parish<br />

<strong>Council</strong> in terms of the clubhouse being used as a public house. There is a condition<br />

imposed on the licensed clubhouse which restricts the use of the premises to only<br />

resident occupants of the touring caravans and tents on the site at any particular<br />

time. It should be acknowledged that Public Protection and The Police have visited<br />

the site on a number of occasions; as a complaint was received from one of the<br />

objectors who has objected to this proposal; and they have not found any evidence<br />

to suggest the clubhouse is not being run as the condition/license specifies.<br />

3.16 With regard to an objection which states that a beer garden has been<br />

constructed, the case officer has visited the site and although there was a “picnic<br />

area” adjacent to the club house, this has now been sited in the correct approved<br />

location.<br />

3.17 There is no proof to substantiate music being played outside, the <strong>Council</strong>’s<br />

Public Protection team have confirmed that they have not received a complaint<br />

regarding music being played outside.<br />
