Natural England – No objection. The proposal poses no risk to designated sites<br />

and there is only a limited possibility of damage/disturbance being caused to<br />

protected species, breeding birds. Recommended that construction work takes<br />

place outside the bird nesting season. It would be beneficial if the proposed included<br />

measures to restrict use by off road motorbikes .<br />

Community Safety Officer – Any comment will depend on whether retail floorspace<br />

is to extended/format of building altered/extended etc. Details of proposed variation<br />

of goods to be sold to identify potential security implications. Any notification to<br />

change trading hours would be appreciated. What are existing, if any security<br />

arrangements and car parking provision/monitoring.<br />

Economic Development - In general terms I fully support further investment into the<br />

Park encouraging private sector investment and job creation. The proposals fit with<br />

the emerging Southern Business Zone strategy and support a number of the themes<br />

within the strategy. In terms of specific uses I do not have any particular objection to<br />

a broad range of uses including food retail in economic development terms, however<br />

this particular use will need to be considered in the light of retail studies and Local<br />

Plan policies.<br />

North East Assembly – The proposal is in general conformity with the Regional<br />

Spatial Strategy, subject to the local authority’s satisfaction that the scale of the<br />

development cannot be accommodated in the town centre, and that the vitality and<br />

viability of the town centre will not be compromised as a result of the development<br />

proposal. The NEA has raised other issues in this response (travel, transport plans,<br />

use of renewable energy/reduction of energy consumption), which if addressed<br />

would improve the conformity of the development proposal with the RSS.<br />

One North East - I understand that this application follows a previous approval (ref:<br />

H/2005/5921) for development of additional retail units at this retail park. The<br />

previous application pre-dated the commencement of One North East’s statutory<br />

planning consultation role and therefore the Agency did not comment on that original<br />

outline application.<br />

It is noted that concerns relating to the potential impact of the proposed retail<br />

development of this site on the town centre resulted in the imposition of conditions by<br />

the planning permission to restrict the use, range of goods to be sold and minimum<br />

size of the units.<br />

The current application seeks to vary those restrictive conditions to enable:<br />

• reconfiguration of units and increase in overall floorspace provision;<br />

• not more than 8933sqm of floorspace to be used for the sale of food (other<br />

than ancillary café sales, confectionary, hot snacks or meals or any other food<br />

which may be agreed by the Local Planning Authority);<br />

• not more than 2508sqm of floorspace to be used for Class D2 leisure<br />

purposes;<br />

• use of three units for Class A3 purposes.<br />

Clearly the issues relating to the protection of the vitality and viability of the town<br />

centre which were a concern to the Local Planning Authority (LPA) in determining<br />

the original application remain. I understand that the LPA is currently considering the<br />
