Turning outstanding
insurance claims
into realisable assets
Harris BalcOmBe llP operates on a contingency basis. No fee is charged unless
we are successful in obtaining a payment under the terms of the Insurance policy.
Outstanding insurance
claims pursued on
your behalf
When a company or an individual
becomes insolvent there are frequently
outstanding insurance claims either part
completed or yet to be submitted to insurers.
The Insolvency Practitioner has to decide
whether it is an appropriate use of their time
and expense to attempt to pursue these claims
with insurance companies and their appointed
representatives – the loss adjusters.
The loss adjuster will frequently endeavour
to argue that the claim should be abandoned
because of the insolvency. It is important to
appreciate that the loss adjuster acts for and
is paid by the insurance company.
They have no duty of care to the insured
– or the insured’s creditors.
Loss adjusters are the eyes and ears for the
insurers and will report to them concerning
any issues surrounding the claim, as well as
any potential settlement. Loss adjusters and
loss assessors should not be confused. As loss
assessors, Harris BalcOmBe llP act only in
the interests of the Insolvency Practitioners
and the creditors, NOT the insurance company,
to pursue and negotiate the claim and obtain
the maximum possible settlement under the
terms of the policy.

The Benefits
of using
Harris Balcombe
An asset may be capable
of being realised on behalf
of the creditors which may
otherwise simply be
abandoned.
As Harris BalcOmBe llP
operate on a “no win–no fee”
basis there is no downside
risk for the Insolvency
Practitioner.
The claim will be dealt with
by claims professionals
whose skill base will more
than match those put
forward by the insurance
company’s representatives.
No creditor or other party
(including the subject of
the Insolvency) will be able
to criticise the Insolvency
Practitioner for failing to
pursue an asset (the
insurance claim) or for
failing to take appropriate
professional advice.
