When a company or an individual<br />

becomes insolvent there are frequently<br />

outstanding insurance claims either part<br />

completed or yet to be submitted to insurers.<br />

The <strong>Insolvency</strong> Practitioner has to decide<br />

whether it is an appropriate use of their time<br />

and expense to attempt to pursue these claims<br />

with insurance companies and their appointed<br />

representatives – the loss adjusters.<br />

The loss adjuster will frequently endeavour<br />

to argue that the claim should be abandoned<br />

because of the insolvency. It is important to<br />

appreciate that the loss adjuster acts for and<br />

is paid by the insurance company.<br />

They have no duty of care to the insured<br />

– or the insured’s creditors.<br />

Loss adjusters are the eyes and ears for the<br />

insurers and will report to them concerning<br />

any issues surrounding the claim, as well as<br />

any potential settlement. Loss adjusters and<br />

loss assessors should not be confused. As loss<br />

assessors, <strong>Harris</strong> BalcOmBe llP act only in<br />

the interests of the <strong>Insolvency</strong> Practitioners<br />

and the creditors, NOT the insurance company,<br />

to pursue and negotiate the claim and obtain<br />

the maximum possible settlement under the<br />

terms of the policy.
