PART 24<br />
FLOODWAY (FW) ZONE<br />
No development permit shall be issued in any Floodway (FW) Zone except for one or more of the<br />
following uses:<br />
1. a) public and private parks and playgrounds<br />
b) playing fields<br />
c) outdoor tennis courts<br />
d) roadways which permit access to the foregoing uses<br />
e) parking areas, provided the land is not filled or altered or the capacity of the floodway<br />
is not reduced<br />
f) uses of a similar nature to the foregoing<br />
g) uses accessory to any of the foregoing uses including, but not limited to, benches,<br />
bleachers, lighting structures, playground, equipment<br />
h) conservation related uses.<br />
2. SPECIAL REQUIREMENTS : ERECTION OF STRUCTURES<br />
a) No structure shall be erected or constructed to be used for human habitation, whether<br />
permanent or temporary, in any FW Zone.<br />
b) A structure or structures, if permitted, shall be constructed and placed on the site so as<br />
to offer the minimum obstruction to the flow of flood waters and shall be firmly<br />
anchored to prevent floatation.<br />
3. SPECIAL PROVISIONS: ALTERATION OF LAND LEVELS<br />
a) Within the 1 in 20 year floodway, and unless otherwise permitted in this Part, no<br />
alteration of land levels or filling in of the floodplain is permitted for the purpose of<br />
erecting a permanent structure or building.<br />
b) Within the 1 in 20 year floodway no alteration of land levels or filling in of the<br />
floodplain is permitted which affects the capacity of the floodway or increases flood<br />
heights.<br />
c) Such fill and other materials shall be stabilized through the use of landscaping or other<br />
appropriate means to prevent erosion.<br />
