parking and loading areas; the location of garbage receptacles;<br />

iv) the existing and proposed elevations of the lot and the elevations of roof levels<br />

related to the site elevations;<br />

v) identification and location of any significant natural and historic features of the<br />

site;<br />

vi) any additional information related to the site, buildings, or adjoining properties<br />

as may be required by the Development Officer to determine if the proposal<br />

conforms to the provisions of this <strong>By</strong>-<strong>law</strong> of the Town.<br />

vii) where the Development Officer is unable to determine whether the proposed<br />

development conforms to this <strong>By</strong>-<strong>law</strong> he may require that the plans submitted<br />

under Section 28 be based upon an actual survey by a Provincial <strong>Land</strong><br />

Surveyor.<br />

e) Any development permit issued shall expire twelve (12) months from the date of issue<br />

of such permit should no development begin within the aforementioned time period.<br />

The expiry date of a development permit shall not be extended beyond the initial<br />

twelve months. A new application for a development permit may be completed.<br />

3A. Where a property is subject to a rezoning approved between December 1, 2005 and<br />

April 29, 2006, the Development Officer may reduce the requirements adopted to<br />

implement the <strong>Regional</strong> Municipal Planning Strategy, to the greatest extent possible to<br />

allow the proposed development that was the subject of the rezoning. (RC-Jun<br />

GENERAL PROVISIONS: USES<br />

4. Multiple <strong>Use</strong>s and Zones<br />

a) Where any land or building is used for more than one purpose, all provisions of this<br />

<strong>By</strong>-<strong>law</strong> relating to each use shall be satisfied. Where there is conflict such as in the<br />

case of lot size or lot frontage, the higher standard shall prevail.<br />

b) More than one zone may be applied to any given area within the Town and when land<br />

is zoned in this manner, the regulations under the zone appropriate to the proposed use<br />

shall be applied.<br />

5. Non-Conforming <strong>Use</strong>s<br />

Non-conforming uses shall be subject to Sections 90 - 94 of the Planning Act of Nova Scotia,<br />

Chapter 346 of the Revised Statutes, 1989.<br />

6. Temporary Construction <strong>Use</strong>s Permitted<br />

Nothing in this <strong>By</strong>-<strong>law</strong> shall prevent the use of land or the use or erection of a<br />

temporary building or structure which is necessary and accessory to construction in<br />

progress, such as a work camp or construction camp, mobile home, sales or rental<br />

office, tool or maintenance shed or scaffold, including a shipping container which<br />

serves as one of the foregoing, except as a mobile home, sales or rental offices, provided<br />

that a development permit has been issued.<br />
