section below on India, India and Bangladesh have<br />

entered into a scheme of reciprocity by virtue of which<br />

medical degrees offered by various medical colleges in<br />

Bangladesh are recognised in India. Since the principle<br />

for this recognition is reciprocity, there would be several<br />

Indian colleges whose degrees are recognised in<br />

Bangladesh. Copies of the same could however not be<br />

obtained.<br />

Temporary registration of Foreign Doctors and<br />

Dentists: The BM&DC also provides for temporary<br />

registration of foreign doctors and dentists who are<br />

required to submit a standardised form to the Council.<br />

Such temporary registration typically seems to be<br />

awarded for a six-month period. 17 The following are<br />

the key requirements that need to be provided for such<br />

temporary registration 18 :<br />

• Original medical degrees certificate/copy duly<br />

endorsed/attested by high commission embassy or<br />

mission of the country of the candidate in<br />

Bangladesh.<br />

• Registration certificate of practice of the candidate’s<br />

country, original or attested as in (a).<br />

• Work permit from the government.<br />

Bhutan<br />

FDI-related Requirements<br />

FDI in Bhutan is governed by the FDI Rules and<br />

Regulations, 2005 read with the Foreign Direct Investment<br />

Policy, 2002. Under this framework, approval of<br />

the ministry of trade and industry of the royal government<br />

of Bhutan is required for all foreign collaborations/joint<br />

ventures.<br />

The FDI Rules and Regulations, 2005 in Schedule<br />

II provide the list of services that are open to foreign<br />

direct investment. 19 Health/hospitals is not in the list<br />

of services open to FDI. Consequently, only joint<br />

ventures or collaborations in the hospital/health sector<br />

will be permitted with prior approval from the<br />

Ministry of Trade and Industry, Royal Government of<br />

Bhutan.<br />

Under the said policy and regulations, all FDI in<br />

Bhutan needs to be registered with the Ministry of trade<br />

and industry. FDI registration (FDIR) certificate is<br />

typically issued by the ministry of trade & industry<br />

within two working weeks of submission of a completed<br />

application form. The certificate states conditions that<br />

must be fulfilled by investors. The nature of such<br />

conditions however could not be ascertained.<br />

Domestic Regulations Regarding Qualification<br />

and Licensing Criteria for Medical Practioners<br />

and Dentists and Nurses<br />

Regulatory Authority: The Bhutan Medical and Health<br />

Council established under the Medical and Health<br />

Council Act of the Kingdom of Bhutan, 2002, 20 is the<br />

regulatory authority responsible for regulating doctors<br />

and dentists in Bhutan. Registration with the Council<br />

is mandatory for the practice of the profession of<br />

medicine, dentistry and nursing in Bhutan.<br />

Recognition of Foreign Qualifications and Reciprocal<br />

Arrangements: The Bhutan Medical and Health<br />

Council Act provides that the Council may recognise<br />

degrees awarded by medical institutions both within and<br />

outside Bhutan. 21 Additionally, the council also has the<br />

authority to enter into arrangements for reciprocity<br />

with medical councils of other countries. 22<br />

The WHO’s assessment of Bhutan states that<br />

developing medical doctors is still very difficult as<br />

Bhutan has to depend on the neighbouring countries<br />

for medical education. 23 Bhutan reportedly does not<br />

have any medical college, and therefore candidates are<br />

sent to Bangladesh, India, Myanmar, and Sri Lanka<br />

for their MBBS courses. 24 While lists of recognised<br />

courses was not available, it can be inferred with reasonable<br />

certainty that degrees awarded in Bangladesh, Sri<br />

Lanka and India are recognised by Bhutan.<br />
